My wages are being garnished $326.00 a pay since May 2006. To payoff the judgment I have found out that the total would be $6918.00. I have had over $9000.00 taken out so far. I brought this to the attention of my HR person and called the collection agency to find out that they have not received any payments from my work since 1/3/07. For the last three weeks I have been getting excuses of my account being researched, phones made to my company and the collection agency to no avail. What can I do? Is there some legal recourse I can take to resolve this matter?


Finsfan is a great resource! I would go back to my HR person and ask why no payments have been received since January--and start by confirming that they are sending them to the right address. Either way, you have overpaid by almost 3000 dollars and it is up to your company to tell you what is going on.

Since it is a court ordered garnishment, I would think that the company could get into some legal trouble if they were not sending them in as they should be.

I couldn't imagine a worse senario - Your paycheck getting garnished, and the money just disappearing!

Do you have the original garnishment order? If so, there may be a number to the court that ordered the garnishment. I would call them and see if they can tell you anything.
