Section 807 of the Fair Debt Collection Practices Act prohibits
Section 807 of the Fair Debt Collection Practices Act prohibits a debt collector from using any "false, deceptive, or misleading representation or means in connection with the collection of any debt. Ellis Crosby & Associates uses words such as "investigator, officer and process" in a false and deceptive manner. I mean come on, after someone tells you that you have been charged with a serious federal crime and check fraud, then proceeds to tell you that an "officer" is waiting to "process" you, does that not IMPLY that you are going to be arrested? I repeatidly asked Mr. Wakefield what he meant by officer and if I was being arrested for something. He refused to answer me by speaking over me and interrupting me. Nevertheless, I have spoken to a consumer protection lawyer who is very familiar with these tactics and has assured me that stating or IMPLYING false and misleading information is ILLEGAL and the things Mr. Wakefield said to me in the context that he said are clear violations.

Good news everyone, I successfuly retained a lawyer to take my case against Ellis Crosby & Associates. He has reviewed my complaint and has assured me that they clearly violated the law and that I have a valid case. I will keep you informed as things progress. All I can say is THANK YOU to everyone who responsded to my postings and that I look forward to more. This forum has really helped me in coping with the whole ordeal and has given me valuable information.

Does anyone think about the fact that these payday loan companie
Does anyone think about the fact that these payday loan companies lent you money in an URGENT time of need? What would make the need to have that money returned to them any less URGENT?
It is true that we should be thankful to anyone who understands
It is true that we should be thankful to anyone who understands our financial problems and do their best fulfilling our urgent needs.
But later, that company should not commit such kind of things which reduces the worth of that urgent help. Let good things come to an end on a good note. These companies that offered help to us in times of urgent needs should continue the same good work by doing business within the lines of Federal and State laws. We are willing to pay our debt but at the same time, we do not want to get cheated by falling in the wrong hands and anyone taking advantage of the gratefulness offered. Do I sound unfair? I do not wish to hurt anyone but I just felt it in general terms. I can be corrected if I am wrong.

Well said everyone. I dont think any of us are denying the fact that we owe money. Which is why we are here in the first place, to receive guidance and assistance in getting out of debt. A lot of us have fallen victim to predator lending because we became desperate. However we should not be subjects of such collection practices because of it.

GUEST-- although you have a valid point for the opposing side, we must remember we all have rights, and the second we turn our backs on our rights they will be gone. I for one am not willing to lose anymore of my rights as an american. We all must stand up for our rights, like they are the only things we have left.
We protected our rights with the abuse from Ellis Crosby and with God willing they will pay for the injustice they brought upon themselves.

Just as Rhonda28 has explained, none of us have denied the fact we owe money...it's the way Ellis Crosby & Associates is attempting to collect the money we have the real problem with. Again, how hard is it for a dept collector to be honest and truthful about the dept they are trying to collect?
GUEST, in case you have not noticed, this forum is for consumers with valid complaints regarding illegal and abusive collection practices. This forum is designed to help and inform consumers. It is not here for your personal oppositions.

Tracy, obviously you know you are in the wrong and on the offensive. You owe money and never paid it back. Loans that haven't been paid don't immediately go to a collection agency, so if YOU would have been honest and truthful, you would have made more of an attempt to take care of it.
In case YOU haven't noticed:
1.This is a FREE country. Freedom of speech.
2.It is up to the MODERATORS and ADMINS to ban/block/delete someones post, NOT you.
3.Seems like these forums are for getting out of debt and staying out of debt. Sounds like if you learn personal responsibility and quit blaming others for your actions, you wouldn't have an issue. :)

BUT, you are very wrong in saying loans dont immediately go through a collection agency. Not ONCE has the original creditor tried to contact me at home, at work or even by mail. I didn't even know that I had an outstanding balance with them until I got a call last week from Ellis Crosby & Associates.
But that is beside the point, this forum is help consumers with credit problems and/or have had their civil rights violated by a collection agency. Yes, you have the right to voice your opinion, but your opinions are not doing anyone any good here.

If you believe your rights have been violated by abusive collection practices, consult an attorney for advice. But FIRST, file formal complaints with the collection agencie's Attorney General's Office, your state's Attorney General's Office, the BBB and the FTC. All these agencies work with consumers in resolving complaints and if determined the collection agency has violated any laws, appropriate action will be taken. Florida's lawsuit against Ellis Crosby & Associates is proof and it would have never came to pass if consumers such as had not stood up for our rights.

Tracy you are right, I had my loan with FSM processing, missed one payment, less than a few days, tried to call them to pay in full and they told me they had already sent it to Ellis Crosby... I blame them just as much, what is there problem, not working with you, just sending it to these awful people, they should be in trouble along with Ellis, they have to know how they collect!

I pulled my credit report and learned who the orginal creditor was that Ellis Crosby & Associates was attempting to collect a debt for. I sent them a two page letter today, explaining to them the horrible experience I had with Ellis Crosby & Associates and the subsequent complaints I filed and actions I am seeking. I also told them that I was not aware there was an outstanding balance and that I wanted to work out payment arrangements with them. I assured them that the actions I am taking against Ellis Crosby & Associates is in no way to attempt to have my debt resolved, but to enforce the right to seek justice for my civil rights that had been so violated. I am hoping they will respond in a possitive way and are willing to work with me.

My pleasure Roxette.I truly understand the guilt and worries consumers feel when they find themselves in a position where they can not pay a debt. What makes it worse is collection agencies like Ellis Crosby & Associates who simply don't care and use abusive and illegal tactics to scare us into paying them.
I am hoping for the best as well. I just hope Ellis Crosby & Associates NEVER contacts and harasses me again. I have done all that I know to do and I really owe it all to this forum.
