Can companies garnish on my defaulted Payday loans?

I have defaulted on some payday loans so can the companies garinsh my wages? I live in Texas and with the research I have done,I don't think that they can but I wanted to be sure. Once I get caught up I have intentions of paying these people back, but the 8 payday loans are taking food out of my 4 kids mouth and I had enough. I could care less if I could ever get another payday loan. Can you request that these collector not call you place of employment and just contact you in writing or home phone. Thanks for your feed back.


You will need to revoke any wage assignments. These are like garnishments, only they don't need a court order because you "agreed" to it in your contract.

All you have to do to revoke these is send them a letter stating "I revoke any and all wage assignments I may have signed with Company X". Keep a copy in case they still try to put one through.

I have submitted a letter in writing closing my bank account. I read some of the advice here and it is great. I have to leave for an appoinment but I will be back tomorrow becasue I had some more questions.

Does any one know if Cash Call will accept partial payment? Does anyone have a mailing address for the Cash2today4u Company or any of the companies below? I have gotten lot of valuable information here that I'm going to use. My bank account is closed and I preparing written letters to each these companies to request a payment plan.

1) Payday Services $500.00(taken in Jan 2007) I started paying 142.50 in finance charges until around
Mar and they begin to taken the finance charge plus $50.00. I have paid this loan down to about $200-250.

2) Cash4u2today-$200.00(taken Jan 5, 2007) start paying finance charge with a descending amount $75, 70,65,60,55 etc until it was down to 35. They call me and wanted me to pay a total of 265.00 to clear the balance. I told the gentlemen I would pay him when I could?

3) Oneclickcash- $400.00 receive in May and I have $120.00 and 120.00 so far

4) Payday Cash link $300.00recevied in May and I have had to payments of $90.00 and 90.00 debited

5)Delprado- $400.00 received on 04/23/07 have paid $120.00 and $170.00(finance plus extra $50.00) This loan is in good standing but won't be after this payday. 350.00 remaining balance.

6) NLS (CASHADVANCE) - $146.00 received on 05/2007 paid $46.00 and then tried to have the whole amount (196pricn+finacne) debited but only it was debited in 2 parts $150.00 which cleared and the $46.00 was returned. They are willing to let me mail the remaining 46.00 on the next payday.

(7)Quickdrawcash $350.00 have not made payment because when debit was done my account was overdrawn and finance charge was returned. They have been kind of difficult to work with. The rep will nit give me the address to mail payment, she states that they only accept money order or money gram.

8)MTE FINAMCIAL-$300.00 received 4/26/2007 I have paid $90.00,$90.00 and $190.00, this loan is in good standing but will not be after this pay day because may account is closed. Remaining balance $260.00

9) (storefront) Pay-Day cash advance $280.00 rec loan in May I have paid 2 finance charges of 71.00 and was in good standing until this payday because of the bank account being closed.

10)Cashpawn(storefront)$150.00 rec in May I have paid the finance charges of 28.00 twice.

whew!! I wanted to know if anybody had any other information that would help my get these people off of my back and have these people paid on MY terms.

Cash4u2today is part of GFS aka. cashtoday limited. Dont bother paying them. You have already paid them more than what is due and they have no legal means to collect whatever amount they tell you that you owe. They are under all kinds of investigation and have been fined and will be prosecuted if any U.S. authorities can get their hands on these crooks.

They will try to collect by calling every phone number you gave them repeatedly. Simply answer by saying "You are operating illegally in the U.S. and have no legal means to collect. I will not pay you. If you want to collect then sue me in court." Then hangup. Speak over the person on the other end even if they are talking while you are saying this. The phone call should last no longer than 15 seconds. After you told them one time they will call back probably another 20 times so you can either answer and say the same thing or do not answer at all. After a few weeks of this they will probably quit calling at least for a while then you might have to repeat the process again for a couple weeks.

The rest you can do a search here and find information on how others have dealt with them. I would calculate the total amount paid to each company and compare it to the amount borrowed. Then look at your state laws to determine if you over paid any of them. Some states like Kentucky (where I live) it is illegal for companies to give loans over the internet. If Texas is one of those then you legally owe them nothing even if you did not pay the initial borrowed amount. You can contact your Texas office of finance to find out the exact laws that govern pdls but this site also has them generally listed at this link.

I had a funny feeling about those people from cash4u2day. I got a $250.00 loan througth these people and I paid a total of $475.00(70,65,60,55,50,45,40,35,30,25). I will take your advise dollarsandsense. They have called once but the receptionist at my job screens all of our calls and any person that call for me here and ask for me by name, they get my voicemail. So there is no address I could send them a cease and desist letter to stop call me at my place of employement?

It has been a blessing since I have found this site. I was so worried about this like was the end of this world. Has anyone dealt with a company be the name of Payday services? I can't find an address for them. Yes morningstarr if you have any contact infomation please advise. Thanks

You can never tell when it's over $1000, it could go either way. It depends on the bank and how aggressive they are. It may also depend on whether they're a TARP bank - they may be required to seek legal action. How far behind are you? Do you think you could settle the debt if you could get a decent offer?
