Need some help with payday loans
Date: Mon, 07/02/2007 - 16:55
I live in Pennsylvania, and have read some conflicting information about the laws there. Can someone help me figure this all out? I don't really know what my first step should be or what to do, but my payday is coming up on the 5th, and I'm going to be evicted if these places take all my check again.

CLOSE THE ACCOUNT TOMORROW! I know these are internet pdls because this business is prohibited in PA. Get your complaints into the Attorney General's Offices also.

Jenn, Anything that I post on the subject of Pa gets corrected. So here is my advice to you. Contact your Attorney Generals office consumer divison. I spoke with them the other day. Tell them your situation and see if they can help you. They are the BEST in your state laws and thats what they are there for. Payday loans are Prohibited in the state of PA. Attorney Generals are sucessful mediators and they are free. Best Wishes Kyside38

I will go to the bank tomorrow morning . . . But can't the places sue me? I'm scared to death of ruining my life even more then I have.
If they are prohibited in PA, how can these companies lend to us?
Once I close my bank account, what do i do? From what I've read these places will call you and be very nasty.

Listen to kyside, she knows alot about the pdl laws and works closely with her state. She is probably one of the most knowledgeable folks on here when it comes to dealing with the ipdls. Listen to her, I did, and I am pdl free.

They will not sue you in a state where the loans are PROHIBITED!! They break the law and lend in states where they are not supposed to. I am from WV and they are illegal here to. Go to the WV AG website and type in payday loans in the search and read about them. KYSIDE38

Okay, here's the places I have loans with:
Cashnet USA - borrowed $300, paid back $450 , still owe $385
Fast Wire Cash - borrowed $300, paid back $485, owe $410
Payday OK - borrowed $200, paid back $325, owe $240

Hold on here - you can't owe more than you have borrowed! I don't know what the cap is in PA, but if you borrowed 300, paid back 450 how can you owe 385? (just and example). You have over paid four of these by my count. It seems that they owe you money. Just my opinion.

So they can't sue me? It sucks, I'm scared if I pay them, and I'm scared to not pay them. I really need to get things put back together, I'm about to be on the streets. My landlord told me no more excuses, and I don't have the money to move. I wish i hadn't waited so long to look for help, but i really thought I was the only person that took out so many loans.

Because i pay to renew the loans each pay period. They say that i still owe the total principle, plus the fee for that pay period. I'm just going in circles and will never be able to pay these off at the rate i'm going.

I know that Kyside is around - I know that she or Mishele or Steelers can answer you better, but they are illegal in your state - they will threaten to sue you, and through you in jail and send people to you home or job, but they will not! They will use many illegal scare tactics on you - do not listen to them. File complaints with the attorney general, the FTC, the FBI and your state banking authority.

You said that they owe me money, well that is the most wonderful thing i've ever heard! How do i get it?

Hi Jen :) if you find you have overpaid Payday Ok and Payday Select, they will be quick to settle with you. I emailed them and let them know my state's laws and after two or three times going back and forth, they marked my account paid in full. They are really easy to deal with once they know that you know your laws. Good luck :)

Jen...take everything one step at a time. The first thing you must do is go to your bank..explain the situation and close your account. Then open another at a different bank. Make your payments arrangements with the ones that are not internet pdls. Now you have your check back you can pay your rent and get some sleep. They can not arrest you or sue. Then once you have looked over the laws for your state and/or talked with Kyside...you can figure out exactly what you should have paid these internet pdls..then you can send them letters revoking the permissions you gave them before, to contact you or debit your account...you can ask for refunds and demand they mark you paid in full. Refunds are always icing on the cake...some people have been successful with some of them...others not at all. But the point is to get control of your finances...and pay what you honestly owe according to your state laws.

Can anyone tell me what I owe according to my state laws? That the part that is confusing me the most. All of my loans are over the internet.

Okay, my break is over at work . . . . Tomorrow when i wake up (i work the swing shift) I will go straight to the bank and close the account.
If someone could help me out with the laws, what i owe, and all that stuff I'd really appreciate it. You guys really are lifesavers! I don't even want to imagine what would've happened if I hadn't found this site!
Thank you! Thank you! Thank you!

Laws
Someone on here can post your state laws regarding pdl's. Yours are all internet, so they're sucking you dry and taking more money than they're allowed. Your state law will state the maximum amount to be paid back on your loan. You've overpaid yours. Not sure if all of them, but definately some of them. CLOSE YOUR ACCOUNT. Put a HARD DEBIT BLOCK on it if you can't close it. Some ACH debits will FORCE OPEN your bank account and your pdl debits will still go through. Then you'll be poor and have charges from your bank. It sucks. Then you have to fight with the bank too. So, if anything, go to your bank and put a HARD DEBIT BLOCK on your account. NOTHING will go through except credits. When you get paid, open a new checking account at a completely different bank. But make sure NO MORE DEBITS COME OUT OF YOUR ACCOUNT! You've paid these people off and then some. But, if allowed by you, they will continue to debit your account into the thousands, if you read alot of the posts. You need to stop them from debiting you. You will then have a full paycheck again and pay your rent and buy your groceries and get your gas. These internet pdl's are ruthless. Some are okay, but the majority are ugly. But it's worth the fight. First, get the bank thing taken care of. Then come back and post. Meanwhile, someone can post the state laws for you?? Please someone??? Then we can figure out how much you legally owed these people and how much you've overpaid. Then you can begin the fight! And, no, you're not alone. This site SAVED MY LIFE! Listen to the advice, read all responses to your posts, read other posts relating to any of the pdl's that you have. You'll learn a lot. And post any questions. Everyone here is ready to offer their experiences with them and their knowledge. kyside knows a lot about the AG. Listen to kyside and the others. But take us little people into consideration also. Because we've taken their advice and done what they've told us and it's been such a life changing thing. I thought I was alone and stupid. I'm not and neither are you. We are in this together. Go to the bank. Put the debit block on it. Open a new account at a new bank. Then we'll work from there. Believe me, the pdl's will still be there. We'll help you through it. They will call. They will blow smoke up your butt. We'll help you figure out who to file complaints with, how to send letters to the pdl's, whatever. We've been there, we're still there, we're still fighting. But we're making progress with the help of this forum. You've come to the right place. My only regret is that I didn't find it sooner. Please listen though. You're with friends now.

I closed my bank account on Tuesday. I just got in the mail a little notice from my bank saying that i have a bunch of nsfs. I called my bank and they said that the ach transactions made the account reopen. Now the account is -$485. I don't have this money! And it is all nsf fees!
Plus I got an email back from cashnet usa telling me they are legal and my info is wrong! What should i do? I'm freaking out again!
jen
jen, do NOT freak out. I did. Same thing happened to me. I closed my account and ta-da the pdl debits went through that night and it "forced" my account open. I was in the negative around $600. I went straight to the bank branch. Told them they were UNAUTHORIZED debits and they did a "dispute" on each and every pdl debit. Of course, I had to wait (yeah, yeah) for a response as to if they would actually credit that back to my account. They were also charging me their bank fees (as they are required to do - I was told!) so in a couple of weeks, I was then negative over $900. I wrote a letter of complaint to the president of my bank. Explained everything. I emailed my bank branch and told them I contacted the corporate office. A rep from the bank corp office called me. Explained everything again. Viola! Within a week, all the pdl debits were credited back on my account. I emailed my bank branch and informed that what was going on. Viola! Within another week every bank charge was credited back to my account - which got me back to zero. In the meantime - PAY ATTENTION TO THIS - put a HARD DEBIT BLOCK on your account. Now that is has been "forced" open, the pdl's will continue to debit your account (since you can't close an account with a negative balance). Once you put a HARD DEBIT BLOCK on the account, only credits can go through and all pdl debits will be rejected. I'm hoping you already opened a new account at a completely different bank? Try my tactic regarding your bank. Fight them like you are fighting the pdl's. I wouldn't give up. My account is still technically "open". It has a HARD DEBIT BLOCK on it so nothing goes through, but I've gotten refunds from a few pdl's and they credit my account. So it's almost good that the stupid account was "forced" open. LOL! So my account is sitting there with a HARD DEBIT BLOCK on it still open. I don't care. Let it sit. If you get refunds, the pdl's will credit your account. But fight your bank!!! They will reverse those charges. And about your response from the pdl. They can go to hell. I've been told everything under the sun regarding mine after I told them my state laws. They don't have to comply with my state laws, they are going to take me to arbitration, blah, blah, blah, blah. It's all crap. Did you verify that this pdl is NOT licensed in your state? If they are not, they can blow away in the wind. Send them a letter AGAIN telling them your state laws and you abide by your state laws because you are a resident of your state. If they are not licensed, they are wrong. So be sure they are not. Which they probably aren't, but I don't know. Send them your letter again. Mail it, fax it, email it. Hound the crap out of them. And also, I'm assuming you've filed your complaints to the government agencies?
