Collection agency charging more than my balance and more
Date: Tue, 07/03/2007 - 23:39
I have 3 credit cards that are in small debt. I started a consolidation program. The money and proposals have been sent to them.
2 of the credit cards were charged off. One of them was sent to some attorney's office. This atty office sent me a bill with $1000 extra (my balance + $1000). Are they allowed to that in FL? Should I bypass the atty office and talk with the original creditor?
Also, the SOL on at least one of the credit cards is over but I can't afford to not pay because of my pending student loans. My CR reports these credit cards as past due. My student loan lender wants proof that I started payments. They want a letter from each of my lenders saying that I did satisfactory payment arrangements. The creditors say that I should just get that letter from my loan consolidation program, b/c I deal with it directly. The lenders want them from the creditors, who have sent my accounts to CAs.
Also, I highly doubt this monster atty's office will give me such a letter. They call incessantly and are very mean on the phone.
What do I do? I need my student loans! I'm working towards paying off my debt and I'm not given credit unless the creditors give me letters!

I have 2 credit cards in collections in collections, they both are suing me. One lawfirm is representing the original creditor and the other is representing a collection agency who purchased the debt. A few questions for you?
Are these firms representing the original creditor? or is a collection agency trying to collect on debt they purchased?
The money they are adding on may be intrest accured, that is how they explained all the excess money to me, they say it is legal, yet they use the total amount as a bargaining tool on the one that is with the original creditor and came up with a settlement amount with me. crazy, you would not think they would bargain on this one, but did. I had to take care of it because of it being the original creditor, even though it was inflated, the settlement was much less than they wanted.
They other I will fight because it is not the original creditor, they purchased the debt and are not giving any room for negotiations. They are real jerks.
Please let us know more of your situation so we can help you.

I'm sure it's a call bank using the attorneys name. But, report the attorney anyway to Florida Bar (where the attorney is located) for unprofessional conduct.

I really need help.
Should I talk to the credit card co itself and negotiate with them and keep the atty office out of it?
Again, I need letters from my 3 creditors saying I made payment arrangements.
My 3rd creditor, the atty (I don't know if he represents my creditor or if he bought my debt) wants the balance in full. I can't afford that. So no way will he give me such a letter.
I'll ask my debt consolidation co and see if we can deal with the credit card co and bypass the atty.
Does that sound good?

The credit card co just referred me to the atty that's collecting the debt for them. It's the same atty that's calling psycotically.
I'm so upset.
I was counting on paying the credit card directly rather than the stupid atty collector.
Have u sent them a debt validation letter yet?? Plz do that imme
Have u sent them a debt validation letter yet?? Plz do that immediately and make sure to send it return receipt or they will say they never got it (once again speaking from experience)
That's ur starting point to settle this matter!
Good Luck and hold ur head up high, don't let this upset u too much! It will all work out in the end, life has a funny way of doing that!
If you have any more questions plz feel free to ask!

ahhh sorry for getting a bit confused here! So ur saying this is already being taken care of thru ur consolidation co? Then i would suggest calling them and get something from them proving that u have indeed been paying on this!!!
Again, so sorry i got confused! happens sometimes, seems to happen to me quite often! LOL
I'm sure proof from ur consol co will be sufficent!

Ang, I went to a debt cons co b/c I need to fix some gliches on my CR so I could be approved for some student loans.
Then I stumbled on this website and learned my rights. Now I want to backtrack with one of the accounts that I'm paying off. I want to make arrangements with discover card and not the atty representing them. This atty is charging me more than my balance. But the customer service employee with discover just referred me to their atty. The atty didn't even accept my offer from the debt cons co.
Any suggestions on how to convince discover to bypass their atty?

A debt validation letter asks for evidence. Many collection agencies try to bully innocent consumers by trapping them. These agencies force the consumers to either pay for the debt which they don????????t owe or demand an outrageous amount for a delinquent account. Debt validation letter enables the consumers to know whether the collection agency really owes the debt and the amount they are demanding is accurate or not.
