Help for PDLs in Oregon

I'm wondering what company to talk to, because the last one I talked to told me they couldn't help me with Cash Call. But people here have said they'll help with other payday loans. And I just recieved another call where I was told, they don't work with payday loans and especially not cash call.
I've looked at doing it myself, but I can't do anything with my bank, as I'm overdrawn. They can't put a stop to the Internet Payday Loans, because they can't charge me the fee if they know I'm over drawn. I just had my dad put in $1000, and when my rent and car payment go through, I'll be back down there again and that doesn't include any of my other bills, most of which are overdue now. I can't put a full stop on my bank because then my car and rent won't go through and I'll be in serious trouble there. As well I wouldn't have access to any money and would be equally as screwed. I can't go to prosper because I already have a loan from them, and my girlfriend can't get one because her credit is too bad. Even some of the newer peer to peer I can't use because they either aren't in my state or I'm not a college student. I can't get a loan from a bank because of my recent bankruptcy and I can't secure it.
Does anyone know of rich caring giving people who loan money if you can't provide me a consolidation company to work with. All I have is the payday loans... I'm getting desparate and don't know what to do anymore....

Okay, that is a good idea. I'm just kind of in panic mode and that makes me withdraw and not want to do anything. So I submitted my first complaint for Geneva Roth. I'll submit the second for CashNet. Then I will send an email to CD letting him know they have been submitted. Then I will contact the two lenders.
I know I'm being repetitive, but this will help me get it into my head that I need to get this done. Because seriously I just want to close out all my windows and play a game or something. I hate that feeling in my chest whenever I think about this stuff.
I wonder about the others. Did they get my letters? I was unable to send them certified, I honestly did not have the money, I used 70 cent stamps I had gotten to send postcards and letters to my friends in Scotland. There was barely enough to send only one letter certified. I just sent them. The others haven't contacted me, but they keep attempting to withdraw on my closed account. I'm still able to check it online (I keep fearing it will pop up someday in the red, some how back open). ameriloan even submitted a paper check, for 355... Kind of a random number, or as they thought their fees were equalled to that amount by that point. But they haven't contacted me yet. I suspect they will soon, saying I owe them close to 1,000 a piece with all the interest and fees from not paying them. I really do worry about them accepting (at most for two of them) $210. I can't see it being easy and I don't like that feeling. Maybe yeah, that is when I'll talk with Lanhorne again.

We've all been in your shoes, and know how it feels. But it does work. I cleared up all my pdl's before the laws changed in Oregon. It can be done. I had 9 internet ones and 2 storefronts.
I would start emailing them the letters too. If you dont' have email addys for them post what companies you need them for and I'd bet someone here has some. It's a start.
Just take things one step at a time. One day at a time. We are here when you need help or encouragement or support! :D

I've been out in the field all day, and will be for the next couple of days. I won't have a lot of time to be on the computer... I haven't gotten the email addresses yet, but my previous searching has led me to their websites so I can hopefully find them there... Most of them are [support@loan.com] anyway....
I did finally receive a refund from USA Credit, that was nice, that gives me extra money for camping this weekend. Though with all the fires, there might be a campfire closure even in the upgraded campgrounds! I also got financed via Modest Needs, to help pay my water bill. All my bills are up-to-date or at least only behind for this month and not more! It is kind of a good feelling. Slowly but surely.... And still cautious waiting for the storm....

So I get back from work today. I have two emails that stress me out. One is from my father, once again he is getting calls from the student loan, the one I just faxed my forbearance forms too. I guess they like to take a while, so they can keep trying to get more money out of you quicker. I don't know... I think they now know that if they call him he'll just pay them.
Actually I just checked my phone, they tried to call me first. I've been googling all the numbers though so I know who is calling and putting them in my phone, they called with a different number this time so I didn't know it was them. I think my dad payed them, but he's mad at me, even though I did take care of it. I'll have to call them.
My second stressful message was from a Prosper member, asking if I was working on screwing up my credit again... I know I've already ***'d it over may a times by now, honestly it is so bad right now, I don't see how missing a payment will make it that much worse. I did email people trying to see what I could do about the fact I couldn't pay because of a medical emergency, but no one ever gets back to me! But now they've released my name to my group and they are out to get me. And I emailed the group leader, long before I couldn't pay, to ask what to do.... Glad they were so helpful....
So I'm frustrated and stressed now, waiting for something else to come along and give me a swift kick in the pants!

So that is my latest email. I had sent an email to them telling them that the payment was going to be returned and explained my situation. Then I get two messages (one cell one office) from them asking me to call as soon as possible as it was a "time-sensitive" matter. I wonder if they are going to use scare tactics with me or if they actually are willing to work out a decent arrangement. Any thoughts?
Also got a call from the OR Banking Dept, although not Charles Donald, concerning my Geneva Roth complaint. I'll keep you updated on how that one goes.
One thing I'm having problems with right now is over coming that urge to just go home and do nothing right now. I'm tired, I've been tired all week and I don't want to be on the phone right now. I have to call the Banking Dept, CashNetUSA, and my Student Loan... And I just don't want to do it right now. And tomorrow I'll be leaving early for a mini-vacation, camping in the forest with my in-laws.... My first camp trip that didn't involve work.... So I don't see myself making any phone calls this weekend. And then that next week I'm off to camp for work again, won't be back until Thursday at the latest, and then will probably be too tired again to make calls.
I guess I just need to get over myself and get this taken care of instead of hiding and making it worse. I am an ostrich!

I do have a helpful hint for those out there. Search engines are a wonderful thing. You just type in a phone number and ta-da! you most likely have a name for them. I've been adding them into my phone so I know who is calling me next time the call. They are taking up a lot of space in my phone book (but it isn't filled with much else) and they aren't numbers that I can even call back (they have a different one for those). It is great when they call from a different number. But there is potential to be helpful for when they call back again so I know who to answer to and who not too! Anything not listed does not get answered and especially anything with (no number) or (anonymous)...

The representative didn????????t seem interested in why, just kept telling me to pay, trying to get me to give them an account number or telling me how to send it through various money sending companies. Oh yeah, and that they????????ll keep calling until I reach an agreement, i.e. give them said account information or say when exactly I will be sending them a moneygram.
But I can????????t do that. I don????????t know when I can pay them. I know that this paycheck (on Monday) goes directly to rent (the landlady is tired of it being late, which was only the second time, so I can????????t wait until my next check on the 10th), a late car payment (which come that paycheck on the 10th, it will be late again, and I probably can????????t pay it then even), and car insurance, which too due before the tenth, only this one I probably can wait, I would just rather not but at least I????????m not a whole month late.
I pretty much can????????t pay anything until after B????????s first paycheck comes in. She starts October first, and depending on the pay schedule we might not see a paycheck til the beginning of November. So I can????????t pay I tell her. Then I get to the point where I tell her they are charging me too much anyway. I said that the new laws say it is capped at 36% and I????????m being charged 553.99%. I understood that the change in due date (the July 3rd loan went from July 17th to August 15th), would lower that rate but it was still above??????? I just wasn????????t sure how much. But she didn????????t really want to listen to that either. In fact she went quite, then told me to call them when I could pay them, but the collection calls would continue until then. That was the end of that conversation.
So I called Mike. He had called and left a message about my complaint I filed about Geneva Roth. I was very happy to hear from him. He did talk to them, explained to them they were operating without a license and that I only owed them $210 (that was a $300 loan minus one $90 payment). They agreed. I????????ll be hearing from them most likely via direct mail and they????????ll get their money when I get around to it. And it will be paid in full, no fuss no muss. That is one taken care of. I????????ve got three more illegal ones I haven????????t heard from yet, but now I know where to call. I took this opportunity after the good news to discuss my current problem... CashNetUSA.
He was very helpful in helping me with the numbers. That date change had resulted in a 180.37% apr which is certainly above the 36% cap. And my actual finance charge between July 3rd and August 15th, would be $19.12 and not $95.62???????. And he said that I should try to speak to a manager and if I had any more problems to call him back.
Which important information that I also learned. Charles Donald has retired and Mike (McCormack is the last name I believe) is temporarily in his chair. I thanked him for the work he had done and wished him luck on it becoming a more permanent position.

Geneva Roth just called, hoping to get their $210. I told the lady I can't right now, and I won't be able to until October. She said maybe split it in half, I said I can't. I can't make any payments right now.
She asked why'd I take a loan that I can't pay back. I said I plan to pay it back I just can't right now.
I said I'd rather not discuss it at work and not to call me. She didn't like that idea and started badgering me. Why'd I take I loan I wasn't going to pay back. I guess she didn't get the point that I was going to pay it back I just coudn't right now. Since she was implying me a thief I asked her why they were operating illegally. She started going off "Illegally?!? blah blah blah." So I hung up.
I'm sure some office nearby over heard. I'm not happy about it, I've kept it pretty under wraps at work, giving them only enough details, especially when it came to getting my direct deposit over, but not much more than that.
In fact I'm not in a very good mood at all. It put me in a very bad mood. That was just the topping for today. I never called CashNet back until today, because I camped for fun and then for work and just got back to get quite a few messages from them. So I called. This time I got an arguer on the other end when I mentioned the apr. He said I signed a contract. I was so frustrated again that I hung up. I haven't contacted Mike again yet, but I will.
I did send an email in response to CashNet's most recent email demanding their money. I stated why I couldn't pay, the excessive APR and how two of their representatives were not very helpful... They sent me their standard response, similar to the last one.

Well at least this time they made notes. I don't see them considering waiting to be an acceptable payment arrangement however. And I also suspect that Geneva won't be waiting either and the phone calls will begin again.

Seriously, you will make it through! Don't stress about not being able to pay them right now. They will get their money when you can afford it. Period. It's not like they can do anything to collect. Just stay strong. Let me know if I can help in any way.

I was thinking of emailing them back, because honestly I'm done with the phone, and asking if "sometime in october" is considered an acceptable payment arrangement. But I suspect I will get the standard reply of "please contact our office." What is the point of having email correspondence if they only tell you to call them back?
As for Geneva Roth, I'm not sure what to do about that phone call. Should I call Mike right away and let him know they were rude? What good would that do? He already set it up so that I'd only have to pay back what I owe. And let me tell you when the Lady on the phone mentioned, "looks like they are willing to accept 210..." she had this tone that was just irrating. She was ready for a fight like "you are lucky, you thief, to be getting out of all that you owe us."

Because I am done with the phone, but that doesn't mean I'm going to up and give them their money right away and put me back into deep hole. My dad keeps doing that with my school loans, even though I've applied for forbearance, they are just taking their sweet time to taking a look at it. And now they know my dad will pay with one little phone call, so they keep calling him.

It is from Cake "No phone, No phone, I just want to be alone today." But I don't hear it during the day as I turn my phone to 'light only' and only know someone has called when it beeps as it hangs up or if it sends signals through my headphones just before it starts to ring...
So I think if I get back in time tomorrow I'll be making that phone call. Most of the messages on my phone today were from my car loan... I need to call them and let them know to take it out Monday... I might do that today.
But I definitely will make some complaints. I've got a print out and a copy of all the emails they've sent me. Including one today that says I'm past due but still hasn't changed the amount.
Hah, and my phone just lit up, Cashcall calling me right now. I answered but no one was there, or they didn't hear me say hello. Probably looking for my bank account information again. They won't get it until I know I have money in there, in a stable flow for them to take it out, along with sending them extra. I'm so glad to have entered all of them in my phone book it is nice to know who is calling, it is hard to keep all those 800 numbers straight...

Their attorney called me and settled this thing immediately if I agreed to withdraw my complaint. The last letter I got from the AG was a copy of a letter to them staing if they did not respond to the complaint they would be served a subpoena. I guess the AG did not accept my withdrawal.
Cash Net is a schizophrenic company. Half of them wants to be threatening and abusive and the other half wants to settle. They are there own worst enemy. I still owe them money 6 months later. I have tried to ssettle with them but they ignore all my communication. They send me settlement offers but they give you an expiration date that is usually the day I receive the notice. They are their own worst enemy. Hopfully the next offer will come on a day when I have the money and can wire it to them. Good luck with them. Please do not give anyone your bank account info ever again. I am serious! They will empty it on you!

Pokogeo has a really good case against Cash Net USA right now. Since the laws changed in Oregon, Cash Net USA hasn't reduced the amount owed like the law states they should. This happened to another Oregonian here, and once the complaint was filed, Cash Net caved and made them only pay principle.

But I figure, since they were operating without a license, and to me that means illegal even though that word sent the representative on the phone into a hissy fit, they can wait for their money. But for now it is settled and I will make sure when I talk to the Dept of Banking again they know about that phone call.
As for CashNet, I think I know what you mean. I think it goes that way for most of the PDLs, it is like flipping a coin to see if you get someone willing to help or someone who just wants to argue and call you names. But in terms of them not following the laws, like Goudah pointed out, that I will file a complaint about. I've tried to get them to understand my situation about why I can't pay and kindly point out to them that they are breaking the law. And I figured being nice about it they'd see the problem and fix it without any complaints being filed. Especially since it is important to them as they are licensed and can have that revoked... But so far I've only been met with a rude representative and a new email in my inbox stating I still owe as much as they said before.
As for giving out my Bank account, that is a BIG NO on that one. I have used it to pay my car and my insurance, which I didn't want to do but didn't really have many other choices. But those are not set to automatic and if they start taking money out unauthorized I will be causing some heck for them. A few of them keep trying to get my account number, like CashCall, they'll keep harassing me to get it, but I think it might be easier to let them take their automatic payments and watch very carefully to where it goes, as well as send them extra money grams to go to the principal. Still undecided about that though...

Out sick today but stopped into the office to take care of something real quick. And I find a message on my work phone. A Ms. Shaw wanting to talk to me about me Geneva Roth complaint phone number 800-351-8820. Almost sounds like the call could be from someone like at the dept of banking, or something wanting to talk to me more about my complaint right? That is the way they made it sound.
But it wasn't of course. I check all phone numbers before I think about calling anyone back. I was right, who does that number belong to? Geneva Roth. She was calling to get that 210 out of me is what she was doing, but anyone unsuspecting would have fallen for it. Thank goodness I'm wary of all phone messages. And the fact that she didn't identify herself specifically, and had a slight southern twinge on her accent (something you don't find too often in Oregon), I was suspicious.
I guess today is the day to make my phone calls I've been slacking again. But I also haven't been feeling well. Time to go home relax on the couch until I get up the gumption to make some complaints.
Oh yeah and I got a prosper notice that my account will be sent to collections in four days! Still haven't heard word from the group leader or the lender who emailed me on what I can do.....

He also had some good news about Geneva Roth. They are being sent a Cease and Desist letter!!!

So in the good news CashNetUSA has a payment plan set up and they waived all the fees. Thanks to Michael McCord (finally got the whole name) from the OR Dept. of Banking!

Well the calls haven't started yet, and I don't remember opting in to getting the text messages in the first place, but occasionally I get them, telling me my payment is due, make sure I have the money in the bank, or offering me another loan.
Not sure what to do. I know I shouldn't call them. And if I contact Mike to call them, then they'll be like Geneva wanting their 210 I owe them (which is exactly what I owe UCL as well) I guess I should wait for the phone calls to start? I will eventually have to call Mike on them but I really don't want to get into the settlement thing until I have the money to pay them so I can just get it taken care of all quick like, and not be worried like I am about Geneva Roth that they'll be calling me and harrassing me!

poko, they send you text messages? Good Lord! Personally, I wouldn't call them. But that's me personally. If you're up for the phone call, call them up and see what they want. $1,000, I'm sure. But if you're not prepared for them yet, don't call. Let them contact you and tell them you will only correspond via email. Nothing else. They will email you.

I wouldn't worry too much about Geneva Roth. Oregon's new laws are very clear about internet pdl's. They will not want to mess with Oregon anymore.

I have everytime they've sent one, and I don't remember opting in in the first place. But that is usually how it goes, they don't give you the chance until you start getting them. And the only reason they give you the option is because they have to.
And I don't have a text deal on my phone so each one received costs me.... Which is dumb. I miss my pay-as-you-go Orange phone I had while in Scotland, I didn't have to pay for anything that came in, only outgoing....

Geneva Roth: 210 owed, agreed upon after complaint with the Dept of Banking (will pay when I have the money)
Now the ones I haven't heard from (much) yet.
Authorized Payday: 120 owed (out of Utah, don't know much about them)
United Cash Loans: 210 owed (an MTE, got a text so far)
Ameriloan: 100 owed (also MTE, haven't heard from them yet)
That leaves me $1090 in debt with iPDLs.... Can't wait to update when I get that number to go down!

CashCall made a deal with me in August. If I paid them for August (which I was late) they'd send in for a deferrment.... Well guess what those (insert lots of swear words here) did? They forgot to.
When Renee said that I called back with my MoneyGram number she would send it. But since I didn't give it to Renee, because they didn't transfer me, said they could take care of it themselves, which ever rep I spoke to, it never got to RENEE so she never sent it. And now I'm screwed.
Of course for them to send it in again I need to pay them. Well guess who has 216.55? Not me! I've got my car to pay and my insurance, and luckily that is mostly it for bills this paycheck, but I've also go to go visit my parents, get B to the doctor for a checkup and get her more stuff so she can be ready for work.
I don't know what to do? Can I call Mike in on this one and get them to take my deferrment anyway since that what I was promised? Or is it my fault that I didn't make sure Renee got it. I should have called them before Sept 1st and checked on the status. I'm so angry right now I'm about to burst into tears!

But Cash Call is hurting pretty bad right now. This is kind of risky, so please do not just take my advice. Think about it first. If this debt could get to a collection agency you would be much better off. I know that they have been selling most of their defaulted accounts off lately. But I don't know for sure that they would do it in the future. I don't want to suggest that you not pay and hope that they sell your account, but that is an idea . . . . It would be risky though, since we don't know for sure the account would be sold off.

Of course not, but the guy I just spoke with said it was all written down in the system, it just wasn't sent. If I manage to scrape up the money for this month then I will try to get something in writing and call and harass them until I know its gone through.
I'm worried about not paying them though. I'm not a big fan of getting lots of phone calls and getting harassed, or the chance of all of my references getting harassed too (silly honest me putting down actual references!). But I honestly don't see how I can do it. We can't not take B to the doctor. We'd only have 150 left over if I did pay everything, and I usually estimate wrong or forget something and so it is probably way less that than, and that is not enough for all the driving and shopping we have to get done.

I just don't feel like I have a lot of confidence in my voice, and I get confused and frustrated when I speak to people on the phone. I really hate speaking on the phone. I used to get panic attacks even when I'd plan to be speaking to someone I knew. But this stuff, yeah it makes me hurt just to think about it.

You are doing great! I have the same problem with getting flustered on the phone, but what I've found that helps is to write out all my points on a piece of paper, and have that paper in front of me while I'm talking. That way I don't forget anything, and I have it clearly in front of me.

Rashod was ver helpful, he submitted it and said that I should call back this evening before close or tomorrow morning and I should know my status. He did it right quick too. I know I had that tone in my voice that said **k with me and I'll kill you. I don't know how I kept it up but it worked... For now.
I suspect when I call later I will be denied because I am behind currently. That is when I'll raise heck. They are not getting any money from me this month, and they better not try to get it. It is not my fault they messed up. Their people should do their jobs! And if they still tell me know I'm going to mention that I know about the companies financial situation and that makes me suspect that the deferrment was purposely ignored in an attempt to get more money out of me. I think that might light a fire!

B told me that was weak willed and I had to be strong when I talked to them, because it was their fault and all of that. I think that inspired me. Pokogeo, I think the best way to handle all of these guys, and this is the way I do it because I learned this here, is to send all coorespondence through the USPS certified mail with return reciept. This way I have a record and I do not get excited. I will not talk to any of them on the phone.
