thank for great site - sadly found it too late.
I'm only 7 years in US (legally -Green Card), but did a lot of mistakes with CC.
Now trying get rid of debts.
Sad part - my wife's credit was damaged too (after she's got brain surgery).
She's got Chase CC with 5k limit, that was used for medical /emergency. Last tarnsaction was in dec 2005.
Then the debt was sold several times. In May we recived letter from Maima attorney working for CACH LLC,
My mistake - I did'nt sent Validation letter. They called twice, that is it. And yestarday we've got letter from local lower that according to public records CAch sued my wife and this attorney wants to represent her.
I called county court clerk and she confirmed this and told me that the summons will be delivered by sherif.
Q:
1. Is it too late to sent request for validation letter?
2.Since debt rose to approx 10k - this is not small claim anymore and we need attorney or could I represent my wife? (she speaks English not good)
3.What defence strategy could be?
4. If negotiation possible? directly or throu attorney?
5.What court could decide? My wife is not working, but we bought house, 3 years ago - and we both on title, so could court put lean on house?
6.How to find good attorney? and what they charge for service?

Make sure that you answer any paperwork or request a continuance with the court so that they don't win by default.
Have you tried phoning them and seeing if they will work something out, it is never tooooo late. goodluck.

(or citaton, what they call it here) I have a template on how to answer one but u may want to hire an atty to make sure it's done correctly! Don't want it thrown out of court! Do as Fed suggested and see if they have a consumer atty near ur area, also if not, most of them DO travel! My atty lives over 4 hours away!
I can't tell u enough times to answer this summons! Do NOT ignore it, speaking from experience!
