From what I have read here they can if they choose not to work with the settlement company and you don't live in a non garnishment state. They probably will work with the settlement company however. It is to their advantage. Going to court cost more than what they will lose by settling in most cases.

As Frogpatch said they can choose not to work with your consolidation company. They would have to serve you, sue you, get a judgment and file for garnishment first though before they can start the garnishment assuming your state allows it and the judge allows it.
