I have seen people sued where I live by LVNV,Pallisades, and a few others, that aren't located here. Someone else may have a clearer answer or have experienced this..Karen

Ok here's my story: CACH is located in Colorado but they have lawyers that work for them all over the states, u can find this info on budhibbs site. So, in turn CACH turns it over to a lawyer in my state and they file the suit. Now it comes time to go to court, as i understood it, each state has different laws where this is concerned but in my state of LA, the lawyer that works for CACH in my state then hired yet another atty from my local area, parish here, to stand in for them! Whewww.... clear as mud huh?
No wonder this debt has tripled from origninal debt now that i posted this!!!

I fell behind, and they sold my Debt to Arrow Financial, now I have SPL calling me demanding payment, very harrassing and meanacing calls, they have call me at work even after I asked them not to. I have never received any notice from Bank of America, that they have charged off my loan and sold it. The collector, said that he had my credit report and that I had a line of 9,000 available on my discover card. Why don't I pull the card out and give him the number so we can settle at 9,000.00! I have filed several complaints with the Federal Trade Commission. and I still continue to get harrassed by these thieves! so seeing that this is the third time this loan gets purchased can this law office sue me or garnish my wages. Any input would be appreciated.

They can sue you but they can't win
Not if you answer the summons...and follow the system. There is absolutely no benefit to paying a third party creditor. The OC has already reported this as a charge off on your credit and paying some bottom feeder is silly.
Third parties buy on pennies on the dollar and they know they are buying high risk. 95% of the time they cannot validate and prey on consumers pushing the panic button.
If anyone needs help I would be happy to discuss further. So far I have won 2 separate suits pro se and got with prejudice judgments. Both bottom feeders were forced to remove my information from the credit bureaus.

A law office bought my charge off account and is now taking me to small claims court. I requested the itemized bills from the law office and they sent me a statement that had original amount owed and finance charges. They are suing for more than what is owed and will only settle for $200 less than what they say is owed. The statement from credit card company says "charge off". How can I find out how much they paid for the account?

What they paid for the debt is worthless, they can collect on the total amount owed plus legally allowed fees and interest. Get from the court clerk a form requesting documents from the plaintiff demanding that they provide documents proving the amount they claim is a legal amount.
Also go to court regardless of what the lawyer will tell you show up at court and appear before the judge. Otherwise you more than likely will get a default judgement for whatever amount they say.

i was served a claim for civil court by Patenaude & Felix on behalf of Capital One. I received one letter from P&F in Oct. i didnt respond. got numerous messages left on my home phone and cell phone. I didnt answer them . and now i get served. My credit report shows that the account was charged off for $1,619. in July of 2007. i dont know what i have to do next. i owe capital one, not P&F. and i am barely making enough money right now to pay for rent,food,and living expenses. cant afford a lawyer and dont know how to answer the civil claim against me.
