Got a response from the BBB regarding US Fast Cash - who has been totally ignoring me & sending my emails back to me. They stated their exact same worded document that I've received from my other MTE Financial pdl's. Exact wording. However, they state that my loan for $350 is now $560.00. They then went on to state that they will offer me a "reduced settlement" of $350 if I pay by Money Gram by 7/20/2007. If I don't pay $350 by 7/20/07, they will then proceed with collections for $560.00. Ummmm....if I had $350 laying around, do you think I would be in this whole pdl mess? My point is that US Fast Cash (who is MTE even though they deny it) is not licensed in Kentucky. My DFI states internet lending is illegal - period. So if they do send me to collections, will that, in fact, mean they are going to try to collect on an illegal loan??? I haven't responded to them yet. I'm waiting on advice from you guys. PLEASE GIVE ADVICE! My #1 point for you all to remember though is that this is MTE. Like I stated, it's the same "form letter" response, word for word, I received from the BBB on my 2 other pdl's with MTE. HELP!


I would respond to the BBB saying that US Fast Cash is ignoring the whole issue at hand, that they are illegally loaning to KY residents. You will not accept their settlement offer, since you have already paid more then you legally owe (if you have).

If they send you to collections, check with your DFI again and see if collection agencies have to be licensed. Most states require a license for a collection agency to collect in that state.

Just keep at them! They are in the wrong!

Thank you for your advice. I know I should just say NO WAY. But I always feel "cornered" when they respond. And showing that it's the same "form letter" I've already received twice before might help.

I do believe I'll file "new" complaints with US Fast Cash, Quickest-Cash-Advance, and One Click Cash. All MTE's. All have responded to the BBB with the same "form letter" and "settlement". Guess it's worth a shot. Love the way they accuse me of using a "form letter" with "misleading information". Then every response from them is a "form letter" word for word. I've about given up on it...............

MTE is just a vehicle a number of lenders use to protect themselves from AG complaints. Companies like USFastCash, Rio Resources, Paycheck Today and dozen others pay the Miami Tribe a fee to list itself as the "lender" on their loan documents. But the company, not the tribe, puts up the money, runs the operation and is the real lender. Then if you or an AG try to sue them they claim tribe is immune from lawsuits. (It's like the old "rent-a-charter" model that the FDIC clamped down on last year where lenders would hook up with banks and claim the bank was the lender.)

What do I suggest? Do nothing. Ignore their calls. If you've already paid more than you legally owe - let them try to sue you. Don't worry they never will. Why? Because the only way they can sue you is if the tribe waives its immunity from suit. In other words, the minute USFastCash files suit you can sue the Miami Tribe. And I bet THAT isn't part of the tribe's deal.

Thanks, freaky. You always make sense. I don't know why I get so friggin amazed at the responses from these MTE pdl's. Lord knows I've had a few of them! A little advice and opinion from this forum goes a long way with me! Thank you so much. I'm starting to calm down now!

Be strong Cannr. There is no way they can sue you and win. The loan was made illegally plus you overpaid according to our state laws. Sending you to collections usually means in house for these guys so they don????????t fall under the fdcpa but if they outsource just send a C&D letter. If it is inside the company just ignore them completely. As long as they are not showing up on your credit report or serving papers I would just let them sit and rot.

Oh, thank you, dollars. You make sense. I need this advice! When alone, I tend to freak out! I do believe you're correct. The loan is illegal. I have confirmed this. So to try to collect on an illegal loan? That kind of blows me away. I'm not taking their calls or responding to the pdl's themselves. I did respond to the BBB telling them that "no" I will not accept their "settlement" and explained the WHOLE situation AGAIN. Lord! So they're going to send the "big dogs" after me now for an extra few hundred bucks over the loan amount. However, like you said, the loan was made illegally. How the hell do you collect on an illegal loan? I swear, it's just MTE. They are the ones that are eating my brain out! I always appreciate your advice!

Cannr, my friend, chill out! You KNOW they are ILLEGALLY LENDING, you KNOW they are full of SHIT, you KNOW that you are in the RIGHT here. So, what else is there to say girl? Do not cave in to them, that is what they are counting on!!! They are no different than any other collection company calling, wait, except they are ILLEGAL, just ignore them!

I am dealing with both of these companies tight now, I contacted the AG ( by the way I am in Florida) neither of these are licensed in my state and niether is MTE, but the lady that emailed me back said they may be immune to licensing and registration laws????? How is that and how do I find out for sure if they are illegal 100% so I know when they come after me I can tell them to shove it. I have already closed my account, revoked authorization from them to ach debit and I don't know what else to do. They gave my bank account info to another co and they took money, I got the claim and the stupid bank put it back into the closed acct instead of mailing it to me so then instead of me getting my mnoey back the other company got it again the same day the bank put it in. I am so frusterated at this point I just want to flip out on someone and no one will cooperate with me not even my own bank which is bank of america and THEY SUCK, I will never do business with them again. I know I am rambling I am just so pissed that two 100$ loans have turned into such a mess, It would have been easier to just let the electric get shut off and deal with that than all this bull shit. Any advice is appreciated and if any one can tell me for sure if these guys are def illegal in my state I would really appreciate it, I would love to tell them to kiss my ass and hang up the next time they call.

Okay. I finally mustered up the STRENGTH to respond to the BBB regarding US Fast Cash's response to them. I had to let it wait a few days. They make us wait. So whatever. I finally let it rip. Told them the whole story. US Fast Cash telling me they are NOT US Fast Cash, telling me they will not respond to my emails, forwarding my emails back to me, that I do not use "form letters" and that my information is not misleading - as it is from the AG and the DFI. And then, I just had to do this - included in there that US Fast Cash accuses people of using "form letters"; however, this is the THIRD "form letter" I have received as a response to the BBB word for word for word. And, after reading it VERY CLOSELY, I found a few spots where they had "missed" changing their "form letter" from the word "he" to "she". So - I HAD to point that out to them also! I told them that they need to proofread their "form letter" responses to the BBB because they missed a few spots where they should have changed the wording from "he" to "she" and then asked "Who is using form letters? Thank you very much." Okay. Sent the response. They can stick it up their ass. Just to let everyone know -this is the "form letter" response from MTE Financial. I got 3 of them. One for One Click Cash, one for Quickest-Cash-Advance, and one for US Fast Cash. So if you have any complaints in to the BBB on any of them (or other MTE Financial pdl's), please print it out. You will have total major documentation of the form letter. Friggin amazing. I'm going to print them out and highlight the hell out of them and they're going off to the DFI. Give me a break!
