Geneva Roth...again!

Ok, so I filed with AG, BBB, DFI, and FTC on these guys and no word from them. I defaulted in May, and I only got 1 phone call from these people since then. I had faxed and sent them an email directly. The BBB is giving them until July 19th to respond. I am getting worried they may do the arbitration thing like they did to kscornell. :( I took out a $200 loan with them and paid $540. I closed my bank account, so I have no idea if they've been trying to hit it with more attempts or not.


Joshua...I have pretty much the same experience with my group of ipdls. I closed my account May 17th and defaulter that week for the first time...sent out all my complaints and letters to revoke, etc. It is just recently that I am getting a few emails and a few messages on my voice mail...I am sure they will all get ahold of us in time...foloow up with your AG and maybe your DFI office also...that is what I am trying to do...to see if I can get any other answers.

I will have to follow up with the DFI's office. When I sent my complaints to the AG office, they notified me that they had been forwarded to the DFI, because in WI, I guess complaints of my nature are handled there. So the DFI is going to be hearing about these guys again. I just noticed that they have an arbitration clause in the contract, and I really don't need the stress or have the money to be paying these guys' overcharged fees, if it comes to that.

joshua, are they even legal in your state? And you overpaid them according to your state laws? If they are unlicensed in your state & you've paid over your state maximum anyway, I can't believe that they would travel to have an "arbitration meeting" with you. But are they legal in your state?

The reason I was asking is because one of my pdl's has informed me that they are "ready to go to arbitration", which scared the crap out of me. However, after being in contact with my DFI regarding all of this, basically what it boils down to is that my state won't even recognize this as a debt. So, I find it incredible that these pdl's would attempt to take a person to arbitration when they will be on illegal grounds. How are they going to back themselves and their fees up if they're not even licensed and legal? I took my pdl threat as just that - a threat. A scare tactic. Now, I might be surprised & they might send me something about arbitration, but I would amazed! They don't have a leg to stand on - let alone get any more money out of you. Just my opinion, but if it happened to ks - who knows, I think it's yet another scare tactic. Right up there with going to jail.

Oh, goudah! Good clarification! I keep forgetting they're not illegal in all states! But, if they're not LICENSED, does that mean not legal? Since they're not licensed to do business in your state?

That's why I'm saying I would be surprised if they did that to you. They are not even licensed to do business in your state. And they're going to come and have an arbitration meeting? They'd have to be awfully darn brave to show up in a state that they're not licensed to do business in and demand money!

Ok, so the date of July 19th is actually the 2ND attempt the BBB will have made to get a response from GR. The BBB of DE sent them my complaint on 6/26, and as of 7/9, they heard nothing, so they resent it again. So if GR doesn't respond again by July 19th, then does the BBB consider it closed?? And does the mean GR has decided not to collect any more?

joshua, from experience with complaints with the BBB, if the company does not respond to the BBB, the BBB will close it. But it will be marked "no response from company" or "unresolved" or something like that. It does not mean that the company has stopped disputing it or settled it or anything. It just means that the company is basically ignoring the BBB.

Ok, that's what I thought. So what steps should I take if GR is ignoring the BBB for the second time? Like I stated in my previous posts, they haven't called, written, or emailed anything after they gotten complaintsfrom the agencies. What steps should I take to make sure they don't collect on this in the near future?

joshua, keep sending letters to the pdl. You can file a new complaint with the agencies and state that the pdl is not responding to your correspondence. Keep on sending them. And file new complaints. A lot of the pdl's just ignore the BBB and don't respond.

If you don't feel safe contacting the Geneva Roth themselves, then don't. But like sassnlucy said, they will reappear. They didn't disappear. They're laying in wait. However, it wouldn't hurt (and they wouldn't know) to file complaints against them again. Just "updated" complaints that they are not responding to your repeated attempts at contact. This way, you're showing that you're still trying to get this resolved, but they are not cooperating. If you sit back and do nothing and think they've forgotten about you - the day they jump back up to haunt you, you might wish to God you had filed complaints! LOL! Just my opinion, but at least file the complaints to let the agencies know you are trying to resolve this, but Geneva Roth is not responding. You will also then have documentation that you kept trying. Only my opinion!
