wage garnishment in TX

Who wants to garnish? Who it is makes a huge difference. If it is an education loan, college loan, it can be garnished no matter what state you work in and payroll state. Child support can garnish with no problem either. Most all other garnishments would have to have a court judgement, in which you would be notified to attend and defend your side.

Wage garnishment is not allowed in Texas. Even if the company is headquartered in a different state, they have to follow the laws and be a licensed business in your state before taking any legal actions. See more on this topic in the thread below.

Anthony is correct..For a non-consumer debt, such as IRS, child support, etc garnishment in Texas is legal. For consumer debts, though, like credit cards, garnishment is not allowed. What is allowed is seizing of your accounts, which can be worse than garnishment.

A judgment against you in Texas is worth about as much money as the paper is printed on. You could still easily settle on a judgment their for pennies on the dollar.

Are you being sued? By who? If it's not the OC, then I would fight tooth and nail? What county are you in?

no im not being sued im just worried... that credit card companies can garnish my wages..i plan to file bankruptcy with my income tax but thats not until next year...

What do you mean employee debt? Did you borrow money from your employer? Or is this for lost or un-returned equipment? Accrued vacation taken but not yet earned? More details please.

They are about to get a judgement for breach of contract.

If a judgement is awarded in your state and you move to another, then the judgement would first have to be domesticated to your new state. Do a Google search for the UEFJA (Uniform Enforcement of Foreign Judgements Act) and read up on it. For $45k, they would likely attempt it but Texas is a very debtor friendly state and post-judgement enforcement is very difficult. Wages are exempt from judgements but must be identified as wages.

I wouldnt think domesticated would benefit them at all, they still wouldnt be able to collect. Or am I wrong??

They would need a judgement first in order to do anything but wages are exempt from garnishment in Texas. Has the truck been auctioned yet?

wondering if I can stop a garnishement granted in another state for a vehicle that I voluntary returned in 1997. The company sent court info to different add. and by that time they had recieve their judgment. the car was $3995.00. They want over $11, 000 now. I still work for the same company but I now live in texas. can they still garnish, they have already garnished mor then the car is worth. and they say thaey want all of it. which is only intrest. as I was told.

you can not have your wages garnished in Texas unless you have a judgement or a court order. If you file for bankruptcy, Chapter 13 to be exact, you most likely have your plan payments taken out of your check. people argue that they can't do this but mind you it is a COURT ORDER from a U.S. FEDERAL COURT. It is legal and they will do it.

From my understanding, no. Wages in texas are nongarnishable.

it depends on the creditor if wage garnishmnet is allowed in another state and you move to texas (which is exempt ) your wages can still be garnished , because of the court system in the oringinating state the garnishmnet may follow u.

My ex-wife has a judgement against me for maintenance (no children involved) arrears in Colorado. I moved to TX. My nephew who is in his second year of law school says Texas will honor a garnishment from Colorado even for maintenance. Does anyone know if this is true?

Another question, I've seen a few posts that say they can levy against (drain) a bank account. How do they get the bank account number?
