Child support can garnish with no problem either. Most all other garnishments would have to have a court judgement, in which you would be notified to attend and defend your side.

Anthony is correct..For a non-consumer debt, such as IRS, child support, etc garnishment in Texas is legal. For consumer debts, though, like credit cards, garnishment is not allowed. What is allowed is seizing of your accounts, which can be worse than garnishment.

Do a Google search for the UEFJA (Uniform Enforcement of Foreign Judgements Act) and read up on it. For $45k, they would likely attempt it but Texas is a very debtor friendly state and post-judgement enforcement is very difficult. Wages are exempt from judgements but must be identified as wages.

wondering if I can stop a garnishement granted in another state for a vehicle that I voluntary returned in 1997. The company sent court info to different add. and by that time they had recieve their judgment. the car was $3995.00. They want over $11, 000 now. I still work for the same company but I now live in texas. can they still garnish, they have already garnished mor then the car is worth. and they say thaey want all of it. which is only intrest. as I was told.

you can not have your wages garnished in Texas unless you have a judgement or a court order. If you file for bankruptcy, Chapter 13 to be exact, you most likely have your plan payments taken out of your check. people argue that they can't do this but mind you it is a COURT ORDER from a U.S. FEDERAL COURT. It is legal and they will do it.

There are companies out there that find bank accounts. Don't ask me how - I dont know, but they exist and they will find accounts, especially of those accounts are with big banks like BOA, wells fargo, chase, ect...
But the judgment holder must go back to court and get a court order from the judge. Once the judge issues the order, the creditor presents it to the bank and the bank takes the money from you.
