Spoke with Bank

I spoke with my bank and the rep said they can try as many times as they want. She said she can not close my account since I now have a -$596.00 balance. She was very nice, but she could not do anything. She switched me to the fraud dept. The rep. there said she would put a hold on the account. She was very nice. She said once the account is paid in full, they will close it out the account and open a new one.
I should have asked for an extension, because 60 days in neg. balance they send you to collections. I guess I will make a couple of deposits, then call and ask for an extension.
I filed complaints with the AG of NY, and the FCC.
Does anyone know if I will ever be able to recover these NSF fees?

Did they say they would reverse the pdl debits? You need to be able to get those pdl debits reversed. Is that why they referred you on to the fraud department? To get those straightened out? I understand your account is negative, so no, they can not close it. According to your bank, by putting what they call a "hold" on it, does that mean all debits are completely blocked? You need to be sure of this. These pdl companies, as you have now found out, do not pay attention to your revoking their debit authorization. It's mainly done to cover your butt and show proof the the bank/agencies/etc that you told them to stop. But they will not. I'm asking about the "hold" because you need more than just stopping ACH debits. They need to block ALL debits including paper checks and electronic checks.

The hold that I have prevents ALL debits from hitting my account.
There was no mention of getting the PDL debits reveresed, except for US Fastcash for $50.00 that came out of my account AFTER I informed the bank they were prohibited.
Am I missing something?

You need to tell your bank that all the transactions the PDL made were fraudulent and get the bank to reimburse you all fees and penalties associated with those transactions not just the $50 transaction. Basically the bank is screwing you because they are trying to make $35 per bounced transaction. It cost the bank nothing on these transactions by the way unless they actually paid one of the PDLs when you had a negative balance like an overdraft protection. There is absolutely no reason for you to pay the bank $600 in fees when it cost them nothing.

Be careful doing that - If the companies can prove that at the time of the transaction they did have authorization the bank will come after you for that money. It just happened to another user here that had gotten their bank to credit a bunch of past payments . . . . . But if it just the most recent transactions, and you can prove you revoked authorization in a timly manner

Also...every bank is different in how they handle these NSF fees. I have been overdrawn since 05/19 and my account was finally closed by the bank 07/12. I owe in excess of $1100. now. Loss Prevention was very nice in helping me make payment arrangements and not reporting to Chexsystems...and they explained it's totally up to the Bank manager/president of each branch to ask the LP dept. to remove some/all the nsf charges. She suggested I make a couple of payments and then appeal to the bank. So you may want to talk to your LP dept. and see if they have the same suggestion..or talk directly to the bank manager.

mystery, this is why we tell people to send out a letter to the pdl's revoking any debit priviledges and revoking any wage assignment that may have been included. This documentation is needed at some banks to prove that you told them to stop the debits; however, they continued to do so. Documentation is the key here. If you haven't already, send every single pdl you have a letter via email/fax/mail revoking their privilidges. At least you have documentation for yourself - and if the bank needs it - you'll have it in your hand. Since it has been turned over to fraud, they might be able to help in getting the other fees reversed; however, they may not be able to. In my case, my bank didn't make me show "proof" that I revoked authorization. But some banks do make you show "proof". As far as the fees are concerned, you can work with the bank to get those reversed. The branch manager is usually the only one who can get this done for you. You may want to speak with the branch manager regarding the fees they put on your account for those transacations. And, I am SO GLAD that you called your bank and verified what a "hold" was. Sometimes these banks can be tricky! They will only block ACH debits and let other forms of debits go through (paper checks, electronic checks). So that's a good thing. Now the pdl's can't hit your account any longer. It wouldn't hurt to contact your branch manager and ask about the fees since these were transactions from companies that are illegal. And ask what exactly the fraud department does. Do they look into the past transactions and hopefully help you out? You're doing good. You've got the ball rolling in the right direction. But, remember, get documentation of EVERYTHING. Send out those letters to your pdl's. Tell them to only contact you via email or USPS so that you may keep accurate records of all correspondence. Your bank may need this information. And, you'll need it just to refer back to when the pdl's start getting nasty with you. Also, you need all the documentation you can possible have when you file your complaints with the government agencies. Have you filed complaints yet?
