Last weekend I rented a car, I didn't apply for any credit cards, I just rented a car and returned it. Today I get a notice from the credit monitoring service I have that a new (hard) inquiry has been posted to my account from that car rental place. Is this legal??

Not every inquiry that appears on your report affects your score. Only hard inquiries can drop your credit score by many points. A hard inquiry is the inquiry that you make when you apply for a credit card or inquire about any type of a loan or store credit, or may be a collection agency review. Too many of such credit inquiries really count against your score. However, credit report requests made by you, credit inquiries made by potential employers, creditors with whom you have already a credit with, or the businesses that want to offer you their services. This type of an inquiry is called a soft inquiry and should never have a negative impact. If a soft inquiry is listed in your report as hard inquiry then you should resolve the error immediately.

It is clearly listed with the hard inquiries such as when I applied for my credit cards. I get a TON of soft inquires a month and they're listed in a completely different area. I reviewed everything I signed and found no mention of a credit check. If they were going to do this legally shouldn't I have been notified. I contacted customer service and they wrote me some letter quoting that they are allowed to check for reasonable business purposes (FCRA sec 1681b) but can they do that w/o permission?? They don't seem to be able to differentiate between hard and soft inquiries either.

this happened to me when I used a debit card to reserve and pay for a rental ... they did not tell me in advance, but when I asked about it, they referred me to a spot on the contract that I signed that disclosed that they could order my credit. You can chose to either not rent from that company again, or use a credit card rather than a debit card to reserve and pay.
