last year i got sucked into american webcash.com instant rebate if i signed up and had 42 dollors get taken out every week.. after looking at it i decided to send them a revoke letter for automated withdrawl.. they keep hiting my account making it negitive 900 dollars and the bank finally closed my account.

About 6 mounths later i got a letter from Fredrick kelley saying i owe 2700 dollars i validated it and it showed how many times american web cash has hit my account.. after doing research and with the help of everyone here american web cash is not licensed in minnesota.. and i send a revokation letter to them..is the contract considered null and void? they claim i have to pay a early termination fee.. any help will be appriciated. ive already paid fredrick kelley 305 dollars to this date..


perry, call me stupid, but what is this? Was it a pay day loan? I've never heard of it. Someone else may have, but it doesn't mean a thing to me. Apparently it was something over the internet?

Okay, so you signed up for this rebate thing. Did it state that you had to pay such & such amount of money every week? And, if so, for how long? Forever? But you did send them a revoke letter from debiting your account; however, they continued to debit? Do you still have any documentation from this company? Or the letter you sent them? If you've checked and they are not licensed to do business, you can file complaints against them. This other company that's contact you regarding them, are they a collection agency? I would check to see if they are licensed also.

i sent them a revokation letter before the 1st withdrawl thay said 40 a week for a year and the validation from fredrick kelley showed they keeped hiting my account even after i was closed sometimes 5 times a day.. there not lincesed in minnesota or anywhere.. ive paid fredrick kelley the attorney that doing the collections for american webcash.. he claims i owe 2700 ive paid 305.. is the contract with american web cash null and void cause there not lincesed.. can i get my 300 dollars back?

Okay, let's see. You sent your letter to them before the first debit payment was due. They kept hitting your account until your bank closed it. Did they ever try to contact you regarding this? Or did this "attorney" just pop up out of the blue and say you owe a million dollars now? And, do you have ANY kind of documentation regarding this transaction? The agreement you made with them, maybe? Something that has their "terms" on it? The letter you sent them revoking the authorization of debits? This "attorney" person, he did validate the debt? Can you ask him to provide you with the documents that you agreed to? If you don't have them somewhere yourself, that is.

They are not licensed in your state. I understand this. However, are they licensed in the state where they are? And the attorney did provide the documents to you? Does it state in there anything about how long the contract was for or how many times they will debit your account or anything along those lines? This isn't a pay day loan, it's a contract of some sort. So it should have terms and also state how payments are made via ACH debits. I can not tell you that it's null and void. You need to read the documents carefully and see what it says regarding payment or cancellation of the contract. Actually, I would personally contact one of my state agencies and ask them about it. Read the documents carefully first, then contact your state agency and ask what can be done regarding it. And ask what can be done regarding collections on it. Since this is not a pay day loan, it's completely different.

I would certainly ask the attorney where they are coming up with $2700 owed. If your documents state a $400 early termination fee, then where in the world is $2700 coming from? That would be an interesting question for that attorney. And also ask that attorney about the company not even being licensed. I'm glad you finally found an address for them. That will help. But, I think you're right about getting on the attorney regarding the amount truly owed ($2700 is quite a big difference than $400)and also ask his "opinion" regarding paying a company that is not even licensed to do business. Doesn't hurt to let him know you're aware of this fact.

fredrick kelley is a crocket attorney there are past post about him treating arrest and he repersents the payday loans.. ill ask him how did he come up with 2700.. ill send a letter telling him american web cash is not licnsed and that i revoke ach withdrawl.. can i seek a refund for american web cash repeatedy hiting my checking account causing it to go negitive? ill write a letter to fredrick kelly and if he dosnt respond ill go to the bbb the texas and mn attorney general and the bar associton.. i think he would come to his sense if i tell him hes collection something illegal

perry, I would certainly talk to the attorney first and see what his answers are. I'm curious as to his response when you tell him that you are aware that the company is not licensed to do business. You are always free to file complaints to the agencies. I would ask him these questions first and see what kind of answers he gives you. Talk to him and let us know what his reponse is. Especially to the $2700 amount owed.
