I have been trying to locate the company that holds the last of my old debts. The bank I had the credit card with has sold out so I sent a letter to the last collection company that had contacted me in 2005 (Financial Recovery Services, Inc). I then received a call from LTD Financial Services that claimed that they had my letter because it had been forwarded to themand they now owned my account. On the phone I would not agree to anything and told them to send me proof that they indeed owned the account. What I received was a letter attempting to collect the debt which was almost double what it should have been. I know that I now need to send a formal letter asking for proof that they own the debt. Can anyone give me a copy of the type of letter I should send? I was not able to find one the fit

Here is a sample of a debt validation letter at http://www.debtconsolidationcare.com/forums/about216.html courtesy of Cajun. There are sample letters on this site too. You need to adjust the letters to fit what you are doing. Don"t give personal or bank info to any collection agency, and if you pay, pay by money order. Also, keep copies of everything they send, you send, and correspondence with them. Feel free to ask questions, we are here to help you!..Karen :D

On the 7th I mailed out my request for DV letter to LTD. (I'm still confused on how they got the letter that I sent to Financial Recovery Services, Inc) But since then ???????Peter from LTD has left me 2 voice messages to please call him. So returned his call and he asked me if I received their letter with the account number on it that proves that they hold my account. I said, Peter, I need DV and I need it in writing. To this he played dumb and wanted to know what I meant because the letter they sent me had the account number on it. I said ???????Look Peter when you receive my letter, please respond via mail and do not call me unless you can come up with the required proof??????? ..Click... In less that ???? hour Owen (Peter????????s Manager) called saying that he had been told that I needed clarification of my account. He said that he could make a much better offer then the first letter. Again I told Owen I had sent a DV letter to which he played dumb about what that meant, so I repeated the same thing I had told Peter and hung up.
Are they allowed to call me once they receive my Letter? Any advice?
I have also checked 2 of my CR????????s and LTD is not listed on either one of my credit score is at 846 (which makes me very happy)

The letter that I sent to FRS, which LTD now has had the account number on it. I don't think they have any more information about the account!

I think the letter is just perfect. Why should we be nice to them, we are rightfully entitled to the information about the debt they are trying to collect on.

If you haven't heard anything within the 30 day time frame send another one. Chances are they have sold your account to another collection agency and therefore cannot provide validation.

What is the date of the last payment activity on it. Make sure it is not past the statute of limitations for your state You stated that the bank sold out, do you mean another bank took over, if so try contacting them to see what they did with the old accounts.

The account with People's bank can not be traced. People's and the new bank have no records because the account was charged off before the bank was sold/closed.
The only clue I had was a few conversations with someone from FRS in 2005. That is why I sent them a letter to begin with. I have no idea how the letter to FRS ended up in the hands of LTD. It all sound fishy to me.
There must be something shady going on because both FRS & LTD have not reported anything on my CR. The Peoples bank charge off is due to come off as of in 2008
