"An Attorney Has Not Yet Reviewed Your Account" (?

I received a letter from a collection attorney who is representing a CA. It says my account has been referred to them for collection. It also says "an attorney has not yet reviewed your account". So why the letter? Should I respond to this with a DV? One of my neighbors told me they received a similar letter about 8 months ago and nothing ever came of it. Never heard another word. Not sure what to do with this letter.

Definitely send a DV letter. It sounds like they are telling you that if you don't respond to them they will attempt to sue you eventually. What CA is it?

It is required wording from a collection attorney to satisfy some cases coming out of the federal circuit concerning collections. They are basically covering their butt.Dv just like a normal collection.

Thanks Cajun and Finfan13! I will send them a certified DV. And, lo and behold...the CA is none other than LVNV!!! Why am I not surprised. Seems LVNV is now automatically sending uncollected debts to local attorneys on a wholesale basis.

Hey Cajun....that's interesting. What kind of cases are coming out of the federal circuit that would have them scrambling to cover their butts?
To Guest....I would agree that you should send the attorney a DV letter...certifed mail. I would bet that somewhere in that letter is the standard statement that you have 30 days to dispute, etc...Treat it as any collection letter and preserve your rights.

There were some cases involving overshadowing which is a fdcpa violation and the lawyers got together to help create this safe harbor language. An example of overshadowing is asking for immediate payment or making legal threats and showing your 30 day validation notice in the same letter. You would be amazed at the money consumer lawyers get for people because companies do not know how to write a legally correct validation notice letter.

Finsfan13...I know what you mean. LVNV strikes again! I'm starting to wonder if they do any actual collections anymore. They are becoming a lawsuit-referral service for local collection attorney's. Maybe collecting is not their revenue stream anymore or they are so bogged down in lawsuits against themselves that they have no time to collect.
