How to write a written response to a summons

I have received a summons by capitol one, and i am in the process of filing bankruptcy. I have to file a written a response. The problem I am having is how to write this letter. I have looked for examples of a written response, and i cant find anything that relates to my case or how one should look. I do have a lawyer but I am still coming up with the money to file. Can someone please help?

Being "in the process" of filing bankruptcy is a little ambiguous. If you have already filed, all collection efforts should be "stayed", meaning that your creditors cannot move beyond the point where they were when you filed. At that point, everything is under the control of the bankruptcy court. If you have yet to file, and you are being sued, you need to contact your attorney ASAP....you need to stop everything quickly. Call your chosen lawyer and see if he/she would accept a partial payment so that you can at least respond to the summons to say that you have retained a lawyer. If the attorney won't do that, look around for another one.
