Thanks, tina. :wink: I wasn't aware that I was "whining about my poor life choices". And, boy, I sure am glad I know it's "never too late to change my behavior". At least my "choice" is to help people know their rights and help them regarding illegal debt, rather than my "choice" being to come to a forum and say negative remarks to people.

Did you know it is illegal to borrow money and not pay it back? It's simple cannr...you all try to complicate the issue because you want to get out of your responsibilities. I know that some people truley have things happen to them in life that make it impossible to pay back their creditors (and i do sympathize with them). However i can tell that this isn't the case w/ any of you. People that have to take out payday loans have already burnt other creditors and proven their worth as "responsible" adults.

Yes, I will agree that taking out a payday loan is a mistake but I guess you wouldn't know about mistakes as you seem to be perfect and not make them. Well, good for you, we are all so happy for you. There's no reason to come on here where people are trying to get help and direction, for you to start harshly judging everyone and making unnecessary comments. cannr, you keep saying "illegal debt". That makes no sense b/c everyone of these people AGREE to the debt when they enter into the agreement. It IS a rip-off, that's why it's so stupid to get a payday loan. There's nothing you can do about it once you agree to have the funds wired into your checking acct. You shouldn't EVER get a payday loan. It's highway robbery so it'd be a good idea to find another way to come up with some cash.

Tina...i would like to compliment you on giving the first poignant response since i have been posting on here. I can see where your coming from. The truth is that i was browsing the net, just happened accross the site, and was a little erked by the one sided glorification of not paying people back. It's not that i hate the people on here (i don't hate or dislike any of you personally), I just think that most of you have made some very poor decisions. I think that a lot of you are deliberately avoiding your responsibilites because you are scared, unsure, and discouraged. I do feel empathise with those of you that truly do want to pay people back, and realize that you made a mistake. I also think that there are many people that see these loans as being "free money", and from the get go intend on weaseling their way out of paying. I do work for a collections agency, and honestly come in contact with more people that are not willing to pay because of b/s excuses more than anything else. People that never intended on paying the lender back are the most plentiful. However their are people out there that truly have come upon hard times, and just made a bad decision or two. I feel sorry for those people and help them out the best that I can. The problem is that many of the people that truly need help don't communicate, and think that by ignoring the problem it will go away. That is not the way to deal with anything in life, and often times becomes a recurring theme that keeps people in this situation. I know that a lot of collections people are jerks to deal with, but you have to understand that you did agree to pay these loans back 2-4 weeks after the contract date. If you were unsure of your ability to do so then you shouldn't have taken the loan out at all - excuses and justifications are a dime a dozen (most collectors can tell between a ligitimate reason vs. a b/s reason based on many factors). I agree that the fees and interest are rediculous, and that payday loans are a predatory form of lending. However without them many of you would have had you lights turned off, car repossed, or given an eviction notice. When you come to collections you may run into a # of collectors that are unpleasant, but many can reasonable if you talk to them and are reasonable yourself. Admit that you made a mistake and ask for help. Be genuine and honest. Sure, some collectors may not be affected by this, but there are many more that will and can help you upon doing so. I agree...many of the loans you took out were probably paid many times over and they still want money--- but come on...read the contract! Look at the fee breakdown link on the websites (it is one of the clearest links on the page), and be sure to pay it off on your next payday. Don't pay the renewal payments 10 times (generally 60-90 dollars every pay period). None of it goes towards your principle, and it just puts it off to the next and the next pay period. I agree that payday loans are a horrible thing, but you have got to have a little sense. I know that you were desperate at the time for money, and had very few options available, but if this becomes a decision you make you should live by it and honor your word. Tina, I assure you that I am not perfect and have made many poor decisons in my life. The difference is that i don't make excuses for them...I admit that i made a stupid choice, attempt to correct my behavior, pay the consequences if necessary. I am sorry Tina, and I agree that I have been overly harsh in my previous posts. If anyone wants to be honest with me about what happened to them, and what their situation is I REALLY will try to give you some advice on how to resolve your loan problem. I assure you that their are ways to get these paid manageably if you know what to say and ask for (and if you are HONEST). I leave this offer open to anyone that has legitimately tried to pay off their debt, and had truly unavoidable things happen to them preventing repayment. I just want both sides of this payday loan arguement made, and I do not dislike any of you personally. I may not have made positive comments before on this blog cannr, but the truth isn't always something that we like to hear.

Also, I agree that no one should take out pay day loans. I also agree that it is highway robbery. I don't agree with personal attacks though.

cannr...you are right, and apoligize that i have been so harsh. I did not intend to direct my remarks to anyone specifically. My emotions regarding this topic definately got the most of me, and i am sorry for judging you. My remarks are intended for people that never intended to pay thier creditors back, and use any excuse they can to mask their behavior. it was a mistake for me to assume that you all are like that, and i do sincerely apologize for this. if anyone does need help, and is sincere about resolving their debts, i would like to help however i can. there are some tips and techniques you can use to resolve these payday loans that i could provide you. my email is (email removed for safety. cannr). for anyone needing advice please email me w/ your situation and i can definately save you a lot of money...by doing so please promise to not take out another payday loan. they are evil by nature, and only lead to more problems.

Yes, I know you appologized but it was still very rude. I am not looking for sympathy but here is my story. At the great age of 21 I was diagnosed with cancer, went into remission and was diagnosed again at 23. Did I mention I was a single mom, with a very poor family, and in college trying to support myself and my daughter yet fighting for my life at the same time. Anyway, I had to file bankruptcy b/c of this. Went into remission and again one year later diagnosed again. Have you tried getting a "traditional" loan with bankruptcy and not to mention having no one in your family with enough credit to co-sign a traditional loan? Have you had to pay $2,200 a month for medication, and make just enough money for the gov't to not be able to help you. If not, don't judge, when you need food for your children, medication and a roof over your head and have no other options, people will do what they have to do. I to have been on this forum looking for help to get out of this cycle. I did not take out these loans looking for a "get rich quick" idea. I took out the loans because I needed them to survive!!!! I have been paying back store front loans for years, week after week, month after month. I have paid so much in interest I could problaby buy one of the stores. I have tried doing the honesty thing with the stores and internet PDL's and to be honest most of them don't care one bit about you or your family, or your sob story and they will continue to harrass you even after you have paid back the "money you have borrowed" 10 or 20 times over again.

Tmoe, I am very sorry to hear your story. I am not surprised to hear that collectors were not swayed by it. there are many people that unfortunately only care about their own bottom line, and it doesn't matter to them who gets trampled on along the way. I assure you that if you had told me that story I would have helped you as best I could. The fact of the matter is that collectors generally are coached to look at you as a debtor and not a person (not saying that it is right but it is the truth). Please keep in mind that we as collectors encounter a lot of people that truly never intended to pay back their loan, and many of us are soured towards any reason for non-payment no matter how ligitimate it might seem. Payday loan collectors are constantly forced to determine whether someone is telling the truth or not. Many of the people that I deal with truly are looking for a way out of paying anything back, and I have to determine if what they are saying is fraudulant. You would be surprised at the number of elaborate lies I catch people in every day to get out of paying. This being said...your situation is not typical of what I normally encounter, and after listening to it I am truly saddened. I am sure it was very discouraging for you when nobody seemed to care about what had happened. You are not alone in your struggle. Just the other day I talked to a lady who had a mental breakdown and was calling from her doctor's office. She is currently living in a group home, and was so bent out of shape when she called that her doctor had to come on the line and talk for her during the majority of the call. Her balance had grown 5 fold due to her inability to pay - obviously stemming from her mental episode. I was able to document what had happened to her, and convinced the owners of our company to write off the debt and stop calling her. I hope this shows you that all collectors are not heartless, however I realize that many of them seem to be. I wish you luck in fighting your cancer, and hope things in life start looking up for you. In response to aminah...there are many things that I could help you with. As cannr pointed out I do know how all this operates on the other side (being a collector of payday loans), and depending on the situation there are many ways to deal with these debts manageably if you know what to say and ask for. I have a husband who cant work because of a tumor the size of a grapefruit on the back of his neck. That being said, My medical expenses are through the roof and thats with health insurance. The insurance company will only cover but so much. I know I owe 3 IPDL companies some money but not all of it. I am willing to pay the money that I owe but not all at once. I dont have it. I live paycheck to paycheck and my account is always in the negative. What am I supposed to do? I only make $15 an hour and with my family illnesses I dont always get a full paycheck because I have to take time off to take them to appointments and care for them. I even tried applying for SSI for my husband and my son and was denied because of "my" income. Which still baffles me, because Im not applying for myself. Anyway, I dont like to complain but all this stress now has me ill. I have been dealing with some health issues myself ever since I lost my job in April and didnt have another one until June. I have been trying to play catch up for the longest. All my credit cards are over their limits and all I can pay on them is $20 a month. How can I get back on my feet financially? Before I lost my job, I paid all my bills early and had no need for payday loans. I for one am not a deadbeat. I dont like owing people money and by the looks of things, the only way I will be able to repay what I owe is when I get my income tax refund. Because no one is going to give me a loan to consolidate every credit into one payment. So Im stuck between a rock and a hard place. :cry:

aminah...very sorry to hear of your situation (i appreciate your candidness). here is a little info i hope you find helpful: 1) Payday loans are very rarely litigated, so no matter what you are told it is not very likely that legal action will be taken (so you should be able to wait until tax time without penalty-other than nagging phone calls demanding payment). 2) when tax time rolls around tell the payday loan collectors that you recieved a letter in the mail stating that you could resolve you debt for fifty cents on the dollar, or fifty percent of the total debt amount (sometimes the original creditor will send a letter like this to a select few of their debtors, and we as collectors are not informed on who recieves those letters...if we are told this we will give you the settlement amount that you claimed to have recieved on the letter) fyi-you may be able to get some loan companies to settle for a little as 30% - if they give you slack about it tell them that they can take it or get nothing at all, or say that you recieved a letter stating that it would be accepted as full and final payment 3)request a cease and desist order the next time you recieve a call as provided by the fdcpa (this will force collectors to stop calling you, and they then will only contact you by mail)...again, the fact of the matter is, worse case scenario, if you don't pay these back you won't be able to take out any more payday loans..fyi-most payday loan companies don't report their debtors to credit reporting agencies. If you have any more questions please feel free to ask, and I hope things start looking up for you.

another thing that payday loan collection agencies are plagued by are bad checks...if you can convince a collector that you can really only afford 50 a month and that the minimum payment they are asking for is completely out of the question, most of the time they will take it if you can GAURANTEE it will be good. be sure to stress that you truly want to pay more but don't want to return a check on them, and dually emphasize that the smaller amount is really pushing you to the limit. Tell them that it is the best you can do, and apologize for not being able to do more. If you can make them believe that you are genuinely doing the best you can, and you will make the payments good, most collectors will set up the arrangements with you. When we agree to do so you will most likely be asked to set up payment for a period of 3-4 months ahead of time. If it is possible for you to do so then I would suggest that you do it, and make DARN sure the money is there each time. If you agree to the payment, and burn them with a bad check, it is unlikely that they will be as generous the next time around. FYI-once your account has reached collections no more fees or interest will accrue on you laon (no matter what they tell you), so each small payment you make will go directly off the principle (it's true!). Even though they will initially say that they won't accept a small payment stay on the line, take up their time, wear them down, and they will eventually concede. Good luck!

I got a phone call from this PDM company. The person who called me left a voice mail on my cell phone. She was pleasent but so vague that I was immediatly suspecious. I don't trust any company that's vague or purposfully tries to trick people into calling them. Thank you SO MUCH for doing the digging so that I can at least identify who in the #@*! this company is.

When I had WebPayDay, I had overpaid (of course) the principle amount of what I borrowed. After sending them "the letter" and filing with the BBB and my state AG, I received a response from WebPayDay informing me that they were refunding my overpayment. All they got was their principle amount that they deposited into my account & they refunded every penny that I paid over that - which was over $200.

white, good! Work on those letters and also don't forget to spend your days filing complaints! I know it's a lot of work, but it'll pay off. I promise. WebPayDay was actually pretty easy to deal with. If I remember correctly, they were the first ones to respond and it was resolved quickly. I think they got a bit scared when contacted by the BBB.

When you file with the BBB online, it will walk you through the process and once you are done it will send the complaint to correct bbb for the address you list for the company. It will also tell you which bbb received your complaint. I never had my references contacted, they only tried to contact me constantly on my cell and at work.

white, once you get on the BBB site, your complaint will be directed automatically to the correct BBB office. It goes by the address of who your complaint is about. So, don't worry about that. It'll go to the correct BBB office. Now, are you talking about references being contacted by INTERNET pdls? Because honestly not one of my internet pdls contacted any of my references and I had 12 of the damn things!

white, I read through the post you're talking about. I think they were just saying they were concerned with the pdls calling the references. I swear, not one of my internet pdls called any references. They just called the hell out of me. Now, storefronts will call references like crazy if they don't hear from you. But as I stated, I had 12 internets and not one called my references. And I know roxy had quite a few and none called her references. They just called the hell out of her also.
