I received an e-mail from Payday Loan Yes...(CashNet) today... we are experiencing a problem with your checking account and I was instructed to contact Tim Atkins, Branch Manager.

YA THINK!!! Yest there is a problem with my account, you people have robbed me blind......

Anyway....I was going to e-mail him back with a copy of the letter I sent, faxed etc. Should I. Like I have said. I would much rather argue in writing, a) I am better at it and b) then I have written documentation. I also would at least like to be available for contact in an effort to keep them from calling me.


roxy, congratulations on the first one! On the second one, do NOT take it personally. This is a "form letter" email that the pdl's send out to everyone. Must be from page 436 of the PDL Bible entitled "Form Letters To Email". Believe me. It is a generic form letter. You will probably see more of them. Aren't they fun? But you got one PIF! Good going! :D

Roxy, you already know about how you have to deal with paydaycashlink. Since you have overpaid on the account, send all correspondence to the AG of your state and request them to investigate on the company. You will pay only that much that your state laws allow and not a single dime extra.

Why not you start a new topic on the success story forum and write about INSTANT LOAN NOW. It will encourage others and learn from your experiences.

Thanks A..it is on there too. I put it here because I did not know about success stories.. I guess it would have helped me to scroll to the bottom of the page. .. I just found it today. Initially when I posted this morning, I did not know about the refund. I was just happy to get the PIF and to know there would be one less company e-mailing and one less calling. :D

roxy, calm down. It's okay. Illegal company. Remember? Most likely the "outside collection agency" will be illegal also. This may be a scare tactic to get you to call them. It's okay. They kept insisting they are going to keep calling you and also that the fees will continue to be charged. Here is what I would do. Email them (again) your original pdl letter stating everything. Remind them that they are illegal. It is now time to not "be nice", roxy. You need to fire back on this one. I'm being serious. Resend your pdl letter, remind them they are illegal, tell them not to contact you via telephone. Fight them. And, I mean it. Be sure you include in your email that the government agencies have been contacted regarding them and they will be contacted by them. Please do this. You need to be firm this time, roxy. They are still illegal! They are still threatening you! Fight this one, girlfriend. Email them back.

Actually, Brick and Mortar law is a term used to describe laws that only apply to businesses that have physical locations in that state.

They are saying that your state has no jurisdiction over them because they don't have any physical locations there. Unfortunatly for them, if I remember correctly, Kentucky law does not only cover "brick and mortar" businesses. It covers any business that transacts with a consumer in that state. So they would be under the jurisdiction of Kentucky law.

Okay, they are partially correct. Kentucky does only license "brick and mortar" businesses. To get a license in KY you must have a storefront. They will not license you otherwise. BUT - They do seem to require that the company be licensed to lend in KY. So since they cannot possibly be licensed, they cannot do business.

If you haven't already, I would PM Cannr and ask if she has anything else. She is from KY and I know she has some information from the Dept of Banking that says the business must be licensed by KY to lend legally.
