They are now only lending to California residents. So they aren't totally down, but this is still great news!!!

That's too funny about Gary Coleman. He sank so low that he had to do a high interst loan. He couldn't even get a normal bank to lend to him. Funny, but sad, I guess. But, great news about another one having to shut down. I never thought that the sub-prime mess would affect payday lenders like that. DiTech....that was very interesting to read. I'll keep that in mind when I ask people what they're paying on their mortgage and who it's with. Good ammunition to have.

They have been calling my job and harassing me and whoever answers the phone. I have made a complaint today to the attorney general's office about the calls to the job. They are demanding their money now and said we will sue to get it back. Did anyone get sued by them?

I see. I am trying to get the money together to make a payment but just don't have it at this time. As far as being sued how do they collect the money? My job does not allow any type of garnishments unless it's child support, taxes or student loans.

It would actually be up to your state laws. If they sued you, and received a judgement, then depending on what your state allows they would either garnish your wages, sieze your bank accounts, or a few other rare things . . . It doesn't matter what your employer allows, because a court order is a court order. Your employer cannot refuse to acknowledge it. If your state laws did not allow garnishments for consumer debts, then the creditor could file a motion with the court to seize any bank accounts you may have, or any assets you may have (although seizing assets is very rare).

OMG...this really brightened my day, Goudah!! I've never dealt with CashCall, but have seen so many horror stories regarding their lending practices that I cringe every time I see someone post that they have a CashCall loan and can't afford the payments, and ask how to stop them....and have to respond that you CAN'T stop them. It kills me to tell people they have no choice but to either continue paying the loan and getting harrassing phone calls when they are late with a payment, or stop paying and get sued - neither choice is an attractive one.
I can't wait to see these leeches go down - completely. Permanently. Forever. Finis.

After reading the above posted article, I was wondering what happens if they do go under,
I am behind a month and plan on making payment tomorrow, and will continue to make payments to them,
but if they go under what do you think will happen to
all their outstanding accounts, I'll be happy even if
they lower (really lower) the interest rate, at least
then I'll be able to afford the payment as more money
will go towards the loan

I don't know, but I doubt they will forgive all the loans. They will still try to collect on them, they just aren't giving out any new loans.

also - as I am reading some of the post I see about putting a "hard debit hold" or "freeze" on your bank
account - how does this work - will any ach debits be

write a check to get money out for money orders to pay my regular bills - mortgage, gas, electric, etc.

No problem. Once you make the decision to stop these places from taking more money, you pretty much have to open a new bank account. The old one will be unusable . . .

Hey that is great news! I agree in hoping they are not able to resume business again. That would be wonderful. What would even be better is if they got in trouble for charging outragious interest and ended up owing people some of their money back! Thanks for the great news Goudah!!

I have to get all my stuff together, to see what I can
do about cash call and my other pdls.
once I have everything together I will post it here,
this is just soooooo depressing - this is my 2nd run in with this pdl mess and I have to figure out what to do
I was going to pay cash call today for 2 months, but now I know I can make one full payment - but trying to
figure out how to come up with the money for the other payment to get myself caught up.

I would just be happy to have cash call lower the rates and make it more reasonable for payments without them calling you all day and calling your contacts - why can't they be more reasonable when you
are trying the best you can to deal with them and work something out
Sharol, You can ask that they not call you at work or by phone.
Sharol,
You can ask that they not call you at work or by phone. In order to show that you want to pay this debt off in good faith, you have to give them at least one method of communication, either by email or regular mail.
I know that that they have a bad habit of calling three million times a day and in my personal experience, I have called them myself and have had them read me the notes they have documented on my account and worked it so they won't call until the day I agreed to pay. It has worked for me, so I hope it can work for you.

Thanks for the info kscornell, I did talk to them the
other day and the person I talk to then was very nice and helpful, but everytime you call you get someone
different
so I'm just doing the best I can and trying to pay on
time and hopefully soon pay some more towards it.

Sharol, fyi, you don't have to sign up with the consultant first to get your logon for the forum. You can sign up without so that you can start getting your points for all of posts! Then worry about getting all your debt info together. And I know what you mean about trying to talk to someone. I've even had a name and extension, but no one wants to put me through and there doesn't seem to be a while to dial that extension direcly!

Cash call Scum
I got a loan for 2500.00 and a year latter I still owe 2602.58. Rate 96% Term 42 months, payments 216.00. We do not have a checking account so we money gram it to them every month with an added charge of 7.50. We hardly survive.

I just decided to turn my account with Cash Call to an attorney that deals with debt settlement. I just want to get them off my back.

TAKING ADVANTAGE OF POOR PEOLE, UPING THE INTREST RATES, NOW YOU CAN NOT MAKE IT WEEL KNOW YOU SEE HOW THE REST OF US FEEL YOU DO NOT NEED ANY OF YOUR MONEY BACK BECAUSE YOU ONLY LOANED TO RIP PEOPLE OFF HEY SEND ME A LOAN SO THAT I WANT PAY BACK EITHER GOODY GOODY GOODY
Behind in payments by 4months!
I was recently sent a settlement for much more than the loan originated. It was a $5,000 loan and I borrowed it I believe 2yrs. ago. I payed @ $250.31 a month. From time to time I was late and besides harassing phone calls, I received a surprise visit on an early Saturday morning around a year ago. To my surprise, even after they received my money via auto debit, yes a week later, following a letter of demand, disturbing me at home, by handing me the same letter with demand of payment. This representative of Cash Call, after asking who's at the door, made me feel somewhat embarrassed, because she stated her name as a Cash Call rep. so loudly my neighbors had to hear, that early in the morning. Getting back to the present, I have no available money for them right now. I agreed to pay them in 2wks and send a voided check once again giving them my acct. information. I started some time ago only paying by money gram for more control and change my number, for they stressed me the HELL OUT!!! No response yet, after there settlement only offer. I gave them my girlfriends number for a message line and a fax number to send me another settlement for another date. The last date they gave was 1/14/09. No one at Cash Call can give me any information only their account manager, Rin Om. Any suggestion, for I already filled in 2005 a Ch.7 and don't want to do a Ch.13 :(

I have a loan with Cash Call too. My payments are current. I was thinking of going with a debt settlement company so that I can get everything settled. Anyone had any luck with Cash Call and a debt settlement company? Should I just not include them in my settlement and keep paying until I can add to the principal every month?

I spoke to an attorney some time ago and he's well informed about Cash Call, in fact, he called them vultures. His suggestion was to file a chap.13,for me, but that anyone could file a chap.7, if you never filed that before. He said basically, they never quit harassing anyone until they have it all.

So they're having money troubles, hm? Maybe their executives could try for a high interest loan elsewhere and pay back part of their loan by being pitchmen for that company? Hey, it worked for Gary Coleman..... ;)
cashcall loan
I can't believe i was dumb enough to take out a loan from this company. When you do get behind, they talk down to you like you're a 3 year old, then they call you endlessly trying to get money from you that you obviously don't have, or you'd make your payment. Anyway, I've been paying 250 a month for over two years on a $5000 loan and, as of today, my payoff amount is 4,073. That is just WRONG!! When I took out hte loan, I thought I'd be able to pay it back quickly and not have to rely on the monthly payment option--Big mistake!! at this rate i'll pay more than $21,000 before it's paid off. This kind of business practice should be banned in the United States. What a shame that companies are allowed to take advantage of us when we are most in need. I'm hoping they'll go under and I'll somehow get the payments I've made added to the prinicpal rather than just interest. Thanks Garry!!
