He goes one further to state that Rannefeld & Associates is a law firm that is the basis of this alleged complaint. In response to your letter dated August 9, 2007, ahd the complaint by xxx Rannefeld & Associates provides the following as a response to xxx complaint.

Ducrest v Alco Collections, Inc. (M.D.La. 1196) 931 F. Supp. 459. Further, "it has also been held that a collection agency does not necessarily have to stop it collection efforts during the validation period so long as its efforts do not threaten a consumer's right to dispute the validity of the debt" See Smith v. Computer Credit, Inc., (6th Circ. 1999) 167 F.3d 1052, 1055. No where in the letter dated June 30, 2007 does Ms XXX ask to cease and desist communication with her. (YEAH BECAUSE THERE WAS NO LETTER SENT TO THEM ON JUNE 30, 2007 SINCE I DIDN'T RECEIVE THIS NOTICE UNTIL JULY 14, 2007)
The second letter Ms xxxx sent was dated July 14, 2007, which states; "If your offices are able to provide the proper documentation as requested in the following declaration, I will require at least 30 days to investigate the information and during such time all collection activity must cease and desists. No where in the letter dated July 14, 2007 does it provide for an immediate cease and desist. Further, no where in the F.D.C.P.A. have I found that if the debt is validated then I have to give her 30 days. To the contrary of Ms. xxx complaint: it has also been held that a collection agency does not necessarily have to stop it collection efforts during the validation period so long as the efforts do not threaten a consumer's right to dispute the validity of the debt" See Smith v. Computer Credit, Inc., (6th Circ 1999) 167 F.3d 1052, 1055.
In Ms. xxx states in her complaint that she contacted our office on July 14, 2007 and requested validation in regards to this matter. She further stated Ken Chandler , was very unprofessional and kept telling her to hire an attorney (which he did and it is recorded :twisted: ). Rannefeld & Associates take all allegations very serious when someone acts unprofessionally, but Ken Chandler can give no legal advice to her, (only to keep interrupting me and telling me to hire an attorney :twisted: therefore her demands for validation of debt were inappropriaate then Ken Chandler can not give her legal advice and must advise her to seek her own council (that is a total lie I did not ask him for his legal advice :twisted: ).
According to the F.D.C.P.A. "the Act anticipates that some debts may not be able to be verified and thus gives a debt collector the option of either providing the requested verificatin, or ceasing collections activities without incurring liability for violating the Act. (I THINK THIS IS EXACTLY WHY I HAVE NOT HEARD FROM THEM SINCE) (See Jang v A.M. Miller and Associates (7th Cir. 1997) 122 F. 3d 480, 483; Smith v Transworld Systems, Inc. (6th Cir. 1992) 953 F. 2d 1025, 1031)

This man is so blatenly lying it is isn't even funny :twisted: . I did not received their letter until July 14, 2007 and the letter is dated June 27, 2007.
I have no idea where he is getting the date of June 30, 2007 as my first communication with them. I sent them a fax on July 15, 2007 (which I have the coversheet to prove it) stating that I wanted them to only contact me through the mail and that I wanted validation of this debt not verification. This was also sent certified/return receipt requested and were received in their office on July 18, and July 19, 2007. ( have copies of everything that I sent to them.)
To this date I have received nothing in regards to validation.
The BBB is giving me 5 days to respond to this. How should I handle this one.
I am so mad I am spitting FIRE right now...

I had one Attorney/Collecot start giving me alot of cr$p and I quietly started reading from my notes I had and he quickly shut up!!

I will prepare my response this weekend. I am a little more less worked up then I was yesterday. I think I will also send my response to Mr. Blue Rannefeld or should I just send it to the BBB. I defintely do not want them to close this complaint agains them. I am going to tell the BBB that his allegations are false.
I am assuming since they couldn't provide me with proper documentation that they will not be pursuing this matter.
I think I will also send a copy of my response to Budd Hibbs to see what his take is on it.
I figure it can't hurt. How dare these debt collectors claim that they do not have to abide by that fair debt collections act.

I responded to the BBB by telling them that I am not accepting Mr. Blue Rannefeld's response to this matter and that I have actual phyiscal proof of what transpired.
I am sure that they won't continue to pursue this debt as we all know they can't prove they own it.
I can hardly wait to see what I get in the mail next :lol:

I suggest if your are a PROCOLLECTOR you can actually recite the debt collection laws that you so knowingly think you know, and don't ever use illegal tactics in your collection efforts. :oops:

Sorry for the abusive language but everyone owes somone and fact of the matter is that we all have to pay someday i can go to my grave knowing that i have helped many debtors get out of debt the right way and yes i have owed somone before but i went about the right way of paying it no loopholes if you create debt than take care of responsibilities and yes there are some law breakers but treat people with the same respect you want and you will have a much better success on becoming debt free

So...if your whole purpose in life is to help debtors get out of debt, why are you being so rude to ladybug? THis forum is here for people that are in debt, want to get out of debt, like you said the right way, but are having problems with unethical collectors or scam artists trying to get them to pay more than they owe, or are being taken advantage of by collectors, etc. We do not tell people to NOT pay a debt they owe. We tell them to validate the debt they are TOLD that they owe. Don't trust anyone on the phone that tells you that you owe them money. Ask them to validate the debt, ask for addresses....you know what I'm talking about. Would YOU send money to some company or business you've never heard of just becuase they said they represent another company you owe money to? Have some empathy, dude. (Or dude-ette)

I notice that collectors and collection attorneys are always citing case law, when in fact, you can find like five other cases disputing what they quote. Just another scare tactic, and to make it appear that they know what they are doing.
