I am assisting my Sister-In-Law on some debts on her credit card. It appears most of the charges in the last two years are charges over the Internet, which she does not know how to use. It appears **** and drugs were charged on the card. She reported the credit card as stolen; however, she never lost physical possession of the card.

I had her call the CC Company, and try to get a lower interest rate, and the refused.

The plan I think we should do (and would like your input on), is the following:

1 -- Send a letter to them, certified return receipt requested, and disputing the charges. She owes about $ 3,000; however, I think the fraud damages is in the $ 5,000 range.

2 -- Stop making any payments on the card.

I assume they will deny the charge, and will do the following:

1 -- Make them document every charge, payment, interest, and fees for the life of the card.

Now I have some questions..

1 -- During the first dispute, I know they cannot report delinquent, but if the second dispute is filed, must they report the amount in dispute?

2 -- What is the effect on one's credit score if the original dispute is denied, and we have notified them we are still disputing the charge? Must the creditor report that the amount is in dispute.

3 -- They are not registered, as a Foreign Corporation in my state, is that something I can use to my advantage? (They may have acquired a company that is registered, but must that be updated?)

Hi...same thing happened to me. My wallet, being stolen, I mean. Had a check book, debit card, etc. First things first......good, you filed the case with the police. Do you tell them what EXACT items ( debit card, bank book, etc.) you had on you?? Did you call the Credit Bureau and put a 'freeze' on your credit report?? Do you have copies of the 'Dispute etters', or copies of e-mails ( if that's how you sent them?).

Phone-Harold..........I would make as many disputes, as I need to make. Keep ALL copies. If this DOES show up on the CR's, send a copy of dispute and a letter to the Credit Bureau. Each 'dispute', that they have, they do an investigation on. If you are 'disputing' this AND you make payments, I would think that would 'look funny'. I mean, if you DID pay on the CC, I think, that would tell other people, that YOU charged the ****,etc. on this card, instead of someone else. That's another question I have.....how can you report a CC stolen, when the person HAD possession of the CC???

cc numbers can be compromised over the internet servers. That would show you have card but number has been stolen. To the original poster,if you did not make these charges quit fooling around with the bank and cc company. Go to www.ftc.gov and click on the identity theft link.Follow the directions and download the id theft affidavit.Fill out this form and file a id theft police report.Send copies to all three bureaus and the original creditor and this will absolve you of any responsibility for fraudulent charges.
