What state are you in, and when was the last time you paid to the original creditor before the account became delinquent and turned on to this CA?
Do you really owe this debt...that should be your first concern.
Do you really owe this debt...that should be your first concern. I mean if tomorrow someone named George calls you up and says that you owe money to him wont you first ask him about the details of the debt. So,in this case too you should first ask them to validate the debt.
Take care

You will want to send them a debt validation letter.
The best way to handle any collection agency is over the phone, unless they are willing to talk with you in a decent manner. I have had some that will speak with me professionaly, and others who have called me everything but my name, so be carefull!
Let us know the info- and we'll help!..KAren

How to handle them is based on how they handle you. If it's something you know you owe then work a a budget out to get it taken care of. If you don't then you will have to take some different steps to get them to stop calling.

Ok, as far as additional information:
I'm pretty sure the lady I spoke to violated the Act that governs these things.
She left a message on my voicemail saying it was a courtesy call to inform me I was going to be sued by [the creditor]. When I got off work, I called the number back, asking for the Dept. # and she proceeded to yell at me that I was in the beginning stages of "adjudication" where I was going to be sued by her and her "client." I told her not to talk to me like I'm a criminal or an idiot because I'm pretty well-educated, just poor.
She informed me that I am going to be "adjudicated" and that she was going to send a letter to the address on file, but I hadnt lived at that address for a year. I think there were fraudulant purchases on my card anyway, but either way I couldn't afford to pay.
I currently live in Florida and have experienced hardship since I had to drop out of college, and had a serious death in the family. I applied at over 30 places in the town where I live and was not hired because of a depressing economy and the fact that everyone out of college works in the summer.
I want to pay back what I owe but I have a low net discretionary income. I live in a tiny apartment and the only asset in my name is a 15 year old car. I just need some help from someone who wont charge me.
Also, how delinquent is the card they are trying to collect on?
Also, how delinquent is the card they are trying to collect on? Chances are that if she is breaking that many fdcpa rules that they might not be at the point of taking you to court. It might be a scare tactic.

The voice mail smacks of fdcpa violation. Also a collections agency can't threaten legal action unless they intend to do so.
Now, if it is the creditor in house collection agency you are dealing with then that is a different story.
If you had fradulent purchaes on your card, or any card for that matter, you get 60-90 days to dispute those purchases. Unless the card is stolen then you will need to go file a police report so that way if the person who is responsible for that will have charges pressed against them.
