how do i get out of this mess?

i don't know how to get out of this payday loan mess. i have tried to make payment arrangements with these people, but they all say i have to pay in full through western union. i had one company call my job yesterday and threaten my boss. they told him since he verified employment, that he became part of the contract, and that they would be serving me and him summons to appear in court today, in california. we live in maryland. can they do this? my boss has nothing to do with this loan.


ok thanx. been a very long frustrating day. but on the bright side, i actually got to go shopping today and buy some new stuff for my house. i used the money i was going to send collection cps for my cash club loan. but since they went ahead and reported to my credit without yet giving me any debt validation, i decided that they apparently didn't want it. so off to walmart i went. it actually felt good to beable to buy myself some things. sorry mr white.....

karen, did you file complaints against the collection agency that hit your credit report? If not, file complaints with all agencies regarding this.

CL Verify compiles information on:

*Payday Advance MICR indexed fraud file

*MICR/Name/Address and SSN/Name/Address verification

*DDA Fraud Closure File

*Bank account-opening activity

*Deposit account collections history

*Check order history

*Retail NSF check-writing history

*High-risk address

*Drivers???????? license validation and verification

What CL Verify does is compile information from both your Chexsystems report and your SCAN report. They are mainly used by Payday lenders, so the chance of them affecting your check writing is low, but it is possible. If they have a two way street with SCAN, they report info as well as compile, then they absolutly could make it so you can't write a check somewhere. In fact, it has happened in the past.

so the ca responded to my bbb complaint by saying the need the letters i sent them to contain my signature. none of the letters they sent me contained any signatures, so why do they need a signature on the letter? they said my debt validation letter, and my cease and desist letters are not valid b/c i typed my name at the bottom instead of signing it. do i really have to physically sign the letters i send them?

I was thinking the exact same thing. the ca has rejected each and everyone of my letters for one reason or another. on top of saying that i did not sign them, they are also saying they are form letters, and how the ftc frowns on frivalous form letters. they are just one big joke. never the less, they have already reported to my credit, and as far as i am concerned, it can't get any worse than that. so therefore, they will never have any chance of collecting any money from me. i will just have to suffer the hit on my credit

karen, your CA is giving you the run around. I've been dealing with mine that reported me via email. I have faxed the documenation to them and have done all communicating through email. They have nothing with my physically handwritten signature. They are "working with me" (if you want to say that) and it's all through email. If you haven't already (and I think I already told you this somewhere), you need to file complaints regarding the CA reporting your account to the credit bureaus without validating the debt. File the complaints & really give detailed information to your state AG. They will get on it and the CA will have it removed. You don't have to "suffer the hit" on your report. This has to be removed. You just need to get your AG involved in this. Your CA is obviously not going to cooperate (and I do hope you're getting everything in writing - not phone calls). If you can show everything in written proof, send all copies to the AG. They will be on it.

thanx cannr. i already did that, i filed a report with the fair 1, and an attorney did contact me yesterday. i made him send me all verifying information of who he was b/c i was so paranoid that it was a scam. anyway, he says i have a case and he wants to sue that ca, but now i have national credit adjusters calling me. do you have an email address for them?

yeah me too. i already sent them letters, and they got them, and i am keeping my paper trail, but somedays i want to pick up the phone and cuss them out. nothing so far as to any debt validation, but if you don't mind, can you let me know what you said to them? i am getting ready to start typing some more letters, and i know quickest cash advance is an illegal ipdl, and never mind that i live in maryland. i have already told them i am willing to pay the last 70.00 i owe them(according to my calculations)but of course, no written response to that either. so maybe it is time for me to play hardball

It's WAY time to play hard ball. Your quickest-cash-advance. Did you already file with the BBB, the FTC, and the state AG? They will respond to the BBB with lies and a 'settlement' amount that will curl your hair. Do not accept it. Respond that they are illegal and you are not going to pay that amount. They will refuse any other offer except their own. The BBB will end up closing it. However, you'll have documentation. Print it all out. Your AG will contact them. They will most likely not respond the first time to the AG. The AG will contact them again. This is when you'll get the lies from quickest-cash-advance; however, they'll back down from the AG. Whoever you are dealing with, keep stressing the unlicensed/illegal fact regarding them. Your best bet is going to be the AG with them. On National Credit Adjusters, they "buy" loans. Basically tell them that they "bought" an illegal debt and it is uncollectable. However, after stating that fact, demand debt validation. They will NEVER be able to validate the debt. It says on there you have 30 to dispute it/ask for validation in writing. Write them. Tell them they "bought" an illegal debt (idiots). However, still ask for the debt validation (which they will NEVER be able to do). Anthony has an excellent debt validation letter on his posts. If you can find one of anthony's posts, there's a link to a debt validation letter. Use this. But put in your remarks regarding the fact that the debt is illegal and uncollectable.

well...i sent nca more letters today, and suprisingly, this time they did not call afterwards. the last time i sent them faxes, i started getting calls 2 minutes after i got the confirmation sheet back. this time...nothing! maybe they are finally getting the hint that i did not want to talk on the phone. or could it be that i asked them if they were just as illegal as the ipdl they are trying to collect for?

Fraud alerts are done by the individual, am I correct? When I was disputing my reports, there was the option of putting a fraud alert on my report. My brother did a fraud alert on his at one time. It's done by the individual, correct?

karen, I'm going to assume that you did this alert unknowingly. I did the same thing you did and there isn't an alert on mine. But I do remember it giving me the option of doing it. I just didn't choose to. I think it'll stay on fraud alert for like 30 days or something? Then you'll have to do it again if you want it to stay on there. I'm not positive. I'm just trying to remember what I said when I was disputing mine.

Oh, yes. Keep on checking it. I'm going to look at mine again in about a week. Just to see what other idiot hit it. I hope no one, but never take things for granted! As we have found out! Karen, i pay true credit 15 bux a month and they monitor my report on all 3 bureaus for me... I love it and dont' find it all that expensive for them to do the work... anytime anything changes on my report they alert me via email and u can cancel at any time. I'm keeping it on mine as i like knowing when someone looks at it or if there is any changes in it!

ok i have sent national credit adjusters two c&d letters and they still continue to call me. mr david lassiter called me today, even though he just got my letter last week. i have already filed all of my complaints, and they still continue to leave messages on my voice mail. what else can i do?
