how do i get out of this mess?

Karen, I am in the same boat. At this point in time I am considering changing my number. I had 7 missed calls and voicemails today. 4of which I could not understand what was said. At work and on my cell. I keep responding in writing only but they keep calling. I hope they will give up but not so far.

i just don't get the process. if it it illegal to continue calling after c&d letters are sent, and complaints have been filed with every agency out there, then why doesn't somebody do something about it?

Well, karen, most likely this is a nice illegal collection agency. So they're not going to give a flying crap what the law states. Don't you love them? As far as filing the complaints, have you filed again regarding the harrassment from this company? You can always file again against them informing the agencies that you have sent them a C&D and DV and they continue to harrass you via telephone. If you haven't done this, do it now. File against the company again. I know it takes the agencies time, so in the meantime you're still getting calls. Do not take the calls. Let them leave their messages. Do not answer them. They will contact you via USPS if they can not get you via telephone. I've gotten contacted via USPS because they do not have my phone number. So, I will receive everything in writing. Do not return their calls. They will contact you eventually. If they have you're email, it might be via email. However, most likely it'll be via USPS. But do not be afraid to file complaints again. Just state this time that they are harrassing you.

Are you sure they are licensed? Did you check? I'm just assuming they are not. But I never actually checked because I'm not sweating it. They're trying to collect on an illegal debt.

yeah, i checked. i'm not really sweating it either, they are collecting for quickest-cash-laons, and i'm not too sure if they are even legal. to the best of my knowledge, they are not.

They are trying to collect on an illegal debt. There is no way in hell they can validate this debt. No way. Illegal. So they're going to try to intimidate you instead of validating. Do not take their calls. Have you filed complaints regarding the collection agency?

yes, i filed all the necessary complaints. i also sent nca a letter telling them how truly sorry i was that they bought an illegal debt, but however, it they were able to give me debt validation on this illegal debt, they we could discuss this matter further.

Good job! I also stated that I hoped they were aware that this was an illegal debt that they are attempting to collect. Then set about filing all complaints against them to all the agencies. Let them have a fun time trying to validate the nice illegal debt they bought. Sorry about their luck. Guess that's money down the drain for them. But watch out. They might report on your credit report. If that happens, dispute, dispute, dispute and file complaints again. Lord, these agencies are going to know me by name soon.

i feel the same way. this is the second ca i have filed complaints against. the funny thing is, once a sent the other ipdls copies of maryland state laws, they seemed to have disappeared. not a single word in 3-4 weeks. and the ca collecting for tjf corporation never contacted me again after sending c&d and dv, i also enclosed the laws with those letters. everyone has disappeared except for nca and marauder corp.

some jerk called today saying he was representing united cash loans, so i informed him that he should have received all 3 of my cease and desist letters by now, and that if he had any debt validation that he wanted to give me, that he could send it through the mail. so then he tried the bad check thing, and i informed him that i have already been in contact with the ag, and ftc, and that i already know that i can not be held responsible for a bad check, b/c i did not write any bad checks, and once again, if you have any debt validation, please forward this through the mail. but of course, go figure, they don't handle anything through the mail, so he guesses he will have to go ahead and process this, but he needs to verify some info first, can you please give me the last four digits of your social #, yeah right! so i politely told him one more time to send me debt validation, and by the way, don't forget to remember that pdl's are prohibited in maryland, but hey, have a nice day anyway. i'm sure he'll try calling again tomorrow, but i am on a mission to send him my letters again. even if he apparently is not smart enough to know what a cease and desist(b/c he said he can not promise me the phone calls will stop)

Good job, karen. Remember, this is an illegal company. Keep that in your mind at all times. If he calls you again, tell him you will only communicate via email. You want all his crap in writing. If he states that they do not "do anything through the mail", then you can certainly state that you do not "do anything over the telephone" and tell him to only correspond via email. Get everything you can from him or any other person in writing. You need documentation of his "words" that he is using. You need to not take his calls if at all possible. Email only.

for whatever reason, this site is not allowing me to log in. i sent mr so and so,(i didn't care enough to remember his name) but anyway, i sent him an email letting him know once again, this is the only way i will communicate with him. i also let him know that after doing some research, that i found out that united cash loans is operating illegally, and asked if that was the reason he continues to call instead of just sending me the debt validation i requested. needless to say, about 5 minutes after i sent the email, my phone rang, and i did not answer, he never leaves voicemail messages, b/c then i have documentation, so i guess i will just continue to ignor his calls, just as he continues to ignor my cease and desist, and my debt validation. wow! i can see this is going to become a power struggle.

Oh, yes. You have to love the unlicensed/illegal companies. Do not take any calls. Anything they want to tell you, they can tell you via email or USPS. You're doing great! Keep standing your ground. Eventually they will break down and communicate via email if they want to contact you bad enough.

nca responded to my bbb complaint saying that i am just trying to not take responsibility for my bills. that i am over exaggerating, and as soon as they received my cease and desist, they stopped contacting me. was it my 1st, 2nd, or 3rd c&d are they talking about? b/c the calls did not stop coming until i started filing complaints against them. they responded that the pdl already gave me notification that nca would be taking over my account. that is such a lie. i have not received one single thing from anybody, giving me debt validation, or any kind of paper work saying this account is going to a ca. but whatever, i will just continue to push for a dv, and if i do not get one, i will not pay any money

KAren, as I was told under a post I have in dealing with collection agencies, the burden of proof is on the CA. Make them work.. And a pld wouldn't lie, would they :wink:

Second what Roxy said here...and also, I would send a copy of the response NCA sent you to the BBB. Isnt the goal to resolve complaints not be accusatory? But hey, we are dealing with pdl's here I guess so the norm is out the window. :shock:

I think so...but I was not sure that is why I asked...I am having such a crazy morning and this site is not letting me post again..which I think may be our computer system so...

Either way, when the BBB provides the response from the company, you have a chance to respond back, she should atleast for documentation sake, put the info that she put in the post in her response back to the BBB.

Not clear if NCA just responded on their own or the BBB actually forwarded the response on behalf of NCA....either way, doesnt sound like NCA is taking the posture to want to resolve. Or maybe their BBB rating is so bad that they dont care anymore :shock:

Karen, I know this will sound stupid, but have you been checking your spam/bulk email folder for replies from these people? I learned to do that the hard way. These people keep using different email addresses and sometimes the spam filters it out.

Roo, that is a good point. I have to check my junk mail daily becuase I have them set to go there but they do e-mail under different domains sometimes.

i check my spam everyday, just in case. so anyway...i filed with the bbb, and that was the response nca sent back to the bbb. i haven't received any email messages, however, i did have a certified letter trying to be delivered to me today, but i was not home. i'm not sure if i should waste my time going to the post office to pick it up

I received a written response from BBB today. They could have kept the stamp. But atleast I have it for the AG. It is worth getting so you have the documentation in case you want to file with your state agency.

karen-Unless you are expecting something or if the senders name is on the note, I wouldnt accept it or go pick it up.

definately not expecting any refunds. it says the sender is rts. i have not idea who that could be.

If you do not know the sender and are not expecting anything, then let it go undelivered. Is RTS related to your pdl's in any way. Was the zip on there, you could see if there is aconnection between the Zip and company. Why do all these idiots use initials.

no state, zip, address, nothing. so i don't know who rts is. it is definately not any of the ca's that have been contacting me. could be a new one for ucl. b/c they are very ticked that i will not deal with them over the phone. but whatever, i guess they will have to contact me another way

United are idiots....well Iknow they all are. They were very difficult to deal with, but they did respond to my bbb complaint. Suprisingly.

good, b/c i filed my complaint against them last week. so we'll see if i get a response. they tried calling again yesterday, after 3 c&d letters, they still try to call. i just ignor it. they never leave any messages. so the only way they can settle this matter is through the mail
