In desperate need of a second chance loan!?
Date: Thu, 09/13/2007 - 13:44
I am in Florida, and last month I was given a $1500 PDL from this company. The funds were unavailable at the beginning of the month to pay them, so we called and notified them of the situation. They told us to call back the next day to arrange repayment.
When we checked the bank account the following day, CashNet took $1500 from our account without authorization. At the time that they took the money, there was only $1400 in the account. This, in turn, sent our account over $900 under. I have already filed a complaint with the Attorney General regarding this.
The problems that we are facing now are resulting from this. Our rent is past due (received eviction notice yesterday), our child support is past due, and none of our other bills have been paid. Basically we're looking at being homeless, without a vehicle, with 2 children under the age of 11 living at home full time.
My husband has poor credit due to divorce. I am unemployed due to just moving here. No local lenders will touch us, even though I have a good credit score. My husband is on VA Disability with regular reliable income, and i receive reliable court-ordered child support, both of which are direct deposit.
I've run across several second chance lenders online who are scam artists. debt consolidation will be beneficial in the long run, but we have an immediate need for a loan of $2500 on a payment plan for at least 24 months.
Can anyone direct me to a reputable lender who works with these kinds of situations? I've been through Citi Financial and American General, both of which have turned us down. Help??

You can check with your cities programs to see if they have assistance for things such as this. Check with the Red Cross also, they do small loans that can be repaid gradually, with no interest. Check with them, and explain the situation. Ask your landlord for a little time to make things right, and that you will not be late anymore after this.

I have done as you suggested. Unfortunately we live in an apartment community that has no amnesty for late rent. If it is not paid within 3 days of the eviction notice, they begin eviction proceedings.
Red Cross, United Way & all of the local programs have an income limit which we exceed by $300 per month.
I'm at my wits end and am trying very very hard not to let this send me into a depression spiral. My 10 year old knows nothing of our financial woes (as it should be!) and my 2 year old is oblivious as well.
Thank you for the suggestions. I'm sorry that I couldn't bring back to you happy news.

Are you a member of a church? Sometimes church communities get together to help a fellow member out. Do you have any family that might be able to help out with some of it? I was extremely lucky because my mortgage is held by my aunt so I was able to work out payment arrangements with her or I would be in the same situation as you except that I needed close to $4000. It is a hard situation to be in.

truthfully my situation is going from bad to worse. All of my family is in the low-income bracket and in another state, so there's no money there. My husband's family is primarily blue collar, so they don't have it to lend either.
wishing I had a generous rich uncle right about now..
As for the church, I do not belong to one, nor do I know anyone around here who does. We JUST uprooted everything and moved here 1 month ago. I still get lost driving to the closest gas station ;)

Your next option is to contact your mayor's office and seek assistance in any way that city hall can. Explain that you are having an extremely difficult time right now, and any amount of help, in anyway would be appreciated. The last option, which no one likes to do, is to contact the state welfare assostance and see about temporary public assistance.

There is nothing wrong with seeking assistance from the state welfare agencies as that is what our tax dollars pay for. Do not be embarrassed, they will be able to provide you with some ideas that can help you.

These government agencies are trying my patience. I did as you suggested, and unfortunately they all go by income rather than "out-go". By their standards, we should have no problems paying the bills. We are only eligible for share of cost medical with no cash, food or rent assistance. I feel awful that I keep negating everyone's wonderful advice. I truly appreciate all of your suggestions and am genuinely making the necessary efforts to obtain the assistance suggested. I just keep slamming into brick walls.
I have faith that things will work out. It's just a matter of "when". I have found a local homeless shelter that is willing to accept us once the apartment completes the eviction process. I spoke with the office staff and was assured that I had until 9 AM Monday to rectify the situation. If no money has been received by that time they will be knocking on our door with a sheriff.

How does eviction work in your state? In Alaska, the tenants can prolong the eviction process by going to court and seeking all kinds of delays. There are so many different by-laws that undermine the main laws, and you need to find those.

Spy, I am confused. If you did not have 1500.00 in your account, why did the bank pay Cash net. Wouldn't they have sent the debit back NFS?
Did't you tell the bank that this was a fraudulant charge, and ask that the money be refunded to you?
I hope your situation improves

The bank should have refused the charge and I have not gotten an answer yet as to why they did not. I am currently disputing the charge with the bank as well.
My bank account is still sitting at $900+ in NSF fees.
I found out that the eviction process in Florida is lengthy and involves court dates and such. I was able to get a collection (thanks to some internet friends) to pay the rent, but we were not able to come up with money for child support, gas or food. I found a local food bank but in order to use their services I have to drive to their location, so I'm still working on getting money up to go their. Thank God for Ramen Noodles!
As far as child support is concerned, the children's mother and step father both work full time for a women's prison making good money. I'm not so much concerned about the children doing without as I am about their vindictive mother trying to punish my husband for non-payment. Oh, well. This too shall pass.

Banks can be just as unethical as a payday loan company. They will allow the NSF fees to accrue to an amount which justifies seeking a judgement in small claims. Banks are in business to make money, and consumers who are having financial difficulty are easy prey for them. They know there is no money in an account, yet they will allow a payday loan company to make several attempts in a day, simply to let the fees get racked up. So one ends up being victimized twice, first by the payday loan crooks, and then the bank. Its all wrong.

*UPDATE*
The dispute with the bank went through. We received confirmation on Saturday that all of our bank fees are being returned and the money that was fraudulently taken from our account will be re-credited!
Woohoo!! ;)

Spy, that is great news. I an glad that you fought this and certainly glad that you won. Is everything ok as far as your rent?.The eviction is stopped?
Keep us posted. Close your account and open another so this wont happen again. Is that possible for you to do? There is a sticky regarding closing accounts in the payday forum. Please read it

First of all, spy, I am happy everything turned out ok. I know how stressful it is dealing with payday loan companies and banks. My bank has let payday loan payments go through, even when I was out of money (I have overdraft protection, but there is a fee charged).
Now I have a question for you. You said that CashNetUSA is a fraud, why do you say this? I am asking because I have a $345 pdl with them. I am planning on paying it out on my next payday, but I needed to know if I should be concerned about them. Thanks and good luck with your situation.
