Served a summons from Love, Beal and Nixon

I am being sued by Love, Beal and Nixon! I did call them and set up a payment arrangement, but it still goes on my credit report as a judgment, they say. I could just cry. This was on a credit card and yes, I did default, and had been meaning to pay on it, just had let the pdls take over for so long that I had no money to pay anything else. Does anyone have any advice about clearing it off my credit report after I get it paid?


How do I answer the summons? Do I write up an answer and my proposed payment and take it to the courthouse to be filed? Does that cost anything? Or do I just literally answer Love, beal and Nixon in writing? Thank you!

To answer the summons you need to follow the directions, usually found on the summons. There is usually a charge, depending on what the answer is. If you want to request a hearing or trial, there is usually a charge of between $75 to $200.

Usually you are only given 3 options to answer the summons with. They are:

1. You agree to pay in full the debt.

2. You request a hearing.

3. You request a jury trial.

No, if the case doesn't go to court it SHOULD NOT (can not legally) go on your credit report as a judgement (you never went to court, no judgement was ever made).

However, if you do not stay on them they'll not fill out the dismissal forms. It took two years for them to dismiss our case (they didn't file the forms until we were notified that we were on the October 2007 docket to appear). Thankfully, I had all paperwork & receipts (from October - November 2005). I called them (September 2007)& they said they filed it but that was a lie, the dismissal wasn't filed until Septembetr 2007, five days after I called them!!! Keep good records.

Google them. Rip-off Report has some things as with several others. One lists an attorney that may be able to help you.

YOu have to ead the fine lines on the settlement agrrement. I had one that put it in there that it was still a judgement. If I had signed it it would have put a judgement on me. I caught it and called them and told them that is not what I agreed to at all. The whole intention of my paying was to keep from getting a judgement. They reworded the document and sent it back to me.
