treefrog, are you sure they aren't operating under maybe a "main" license number or something along those lines? I know they are licensed. And to have every address listed except the one you have a loan with is odd. Is this maybe a "new" store? Maybe it hasn't made it to "the list" yet? I'm just throwing out ideas here, because I would be surprised that all are licensed in your state except one. You know?

I have had my loan there for over a year..so they are not a new store. I don't have a list of all the locations in AZ. There may be others not listed. AZ Rev Stat. 6-1259 states:
A separate license is required for each location from which the business is conducted.
So that can't be under a "main" license. I went back to the license list and it only has 10 addresses in Tucson. But on the Advance America website there are 12 locations in Tucson. I haven't check the other cities yet. So it looks like some of the storefonts either lost their license or didn't renew.

Ahhhh, very interesting. So you have a loan with them. Can you walk in there and look to see if their license is posted? It's supposed to be posted for all to see. Hell, I'd walk in just to see. If you're right and they have lost their license, well, here goes another fight!

That's what I was thinking of doing. I sent them a letter offering $125.00 a month for to pay-off my loan and I haven't heard anything back. My loans was for $500.00. But if they lost there license then they just might owe me money. I have had the loan for appox a year and a half, paying $75.00 every 2 weeks. We shall see...If they prove they have a current license then I am more then happy to make arrangements to pay them.

alittletreefrog - does this location of Advance America have their license on the wall? Most states with storefronts require that lenders display their license where customers can see it.

I was up and around early this morning to get my van to the shop for an estimate...I've been approved for a grant to get it fixed, but the repairs are going to exceed the grant, it looks like. And it's SO cold here....I refuse to turn the heat on just yet, don't want to see my gas bill start going up already, so we're all bundled up...but my fingers are freezing and I can't type!

I would absolutly go see if they have their license up on the wall. I'd write down the number, then do a search by license number. If they are an unlicensed location, you have them by the balls!

Sounds good to me--but let me throw out something else to consider: would they possibly be covered under a corporate license in another area? And I don't know if Advance America offices are franchised or not, but would it be under the owner's license? If not, go get em!!!!

Well, I went over to the Advance America store and guess what...The store is CLOSED!!! They moved the office as of Sept. 10th. I went back and look at the license database. All the other locations renewed their licenses. The old license expired on 7/31/07. Which mean...when I went in on 8/10/07 and re-borrowed they were UNLICENSED and therefore ILLEGAL! They never said anything about closing or moving. In fact I just received a letter date 9/8/07 saying my check had been returned from the bank and I needed to go into THAT store within 10 days and pay.
So...acording to AZ Rev. Stat 6-1262 which reads:
Any deferred presentment trasaction that is made by a person who is required to be licensed pursuant to this chapter but who is not licensed is void, and the person has no right to collect, receive or retain any principal or other fees in connection with that deferred presentment transaction.
That mean that my last payment of $75.00 should have been applied to the principal. And if they would like the rest of it they will work with me on payments or I can invoke my rights to th transaction being void and they get nothing.
Awesome! I would also report them . . . . They could be fined f
Awesome! I would also report them . . . . They could be fined for operating a store without a valid license. They probably thought they could get away with it since the store was closing . . . . . Nail them!

Amen, Goudah. And if they call you (and they will), most likely from their corporate offices trying to collect, cite this law to them and NAIL THEM!!!!!!!!

Oh, treefrog! What a nice productive "ride" you took! This is awesome! Not surprising, but awesome! Thank goodness you were doing your research! I think this is great! You rode by and they were closed. My God. Just amazing. But now you've got the law on your side. This is great news! :D
