Sue, Arizona Law is that a company cannot Garnish your wages
Sue,
Arizona Law is that a company cannot Garnish your wages without out first obtaining a Writ of Ganishment from the Court and before that, the company has to obtain a Judgment against you first. So basically they have to take you to court. But many of these company's have Wage Assignments that you may have agreed to when you took out the loan, therefore, I would suggest that you revoke any wage assignment you may have agreed to with each company. Send a fax, certified letter and e-mail to them right away. However, if you have internet payday loans, the only two that come to be head as being licensed to lend in Arizona is Pay Day One and Cashnet USA. It would be helpful to list all the payday loans you have outstanding and how much in fees you have paid to date. Arizona law on unlicensed Payday Loan companies is that you are not responsible for paying bakc the principal and/or fees. However, most of us have paid back our laons and then some in just the fees that these companies charge. If the payday loan companies are licensed in Arizona, they are required to make some type of payment arrangement with you, although they will not immediately tell you that. Finally, Arizona law prohibits criminal prosecution if you stop pay or your check is returned NSF. But the company can sue you in civil court...

I would like to add that most of the internet companies that are illegal will not want to take you to civil court. And if you do revoke your wage assignment...definitely...give a copy to your HR person..must be done before they send the assignment through...

sue, if you wish, could you please list out all of your pdl's for us? There may be others who will require you revoking any wage assignment. If we know who they are, we can advise you as to how to handle them, if they are licensed/legal, etc. We can help you with this. :D
