E-max bought accounts from Ellis Crosby

I received a phone call from 3 people from E-max that don't stop calling. First a Mark Ford called saying he wants $688 due immediately from a deby due from Bahamas Marketing Group. I told him to give me his telephone number and he gave 1-800-458-9081. Then I asked him where he was located and he said Somerset, NJ. (Kind of strange when all 3 people have an Indian accent and couldn't even provide me an addressof his location). When I asked for the address he placed me onhold and hungup.

Round 2 (10 minutes later), I get a call from Sophia stating she was from Emax. I told her I do not know who you are and not to call again. I hung up on her.

Round 3 (5 minutes later), Sophia calls back and says my manager wants to talk to you named Keith. I get Keith on the phone and tell him to give me his location, address, phone number, license number, agency number, also to mail me a validation that he has the right to collection in my state. He claims he mailed me a leeter on 9/1/05 stating that I owe $638 for a debt from PPGC (Premier Processing Group) I said what? Keith said ok it's $526.50. He changed the price again. I told him the phone line is being recorded and he said no do not record the phone line. I said do not call me again and only mail me documents he said, "I will keep calling you everyday until you fax me a cease and desist letter to 732-748-4381". I then said, "don't order me around. why don't you give me your address and i'll have my attorney send you a legal document." he said, "you don't need my address. you just need my fax number."

I just started laughing at him and said, "Keith you are funny. Are you sure you are with a real collection agency? You are just making me laugh to hard." He said, "stop it. it's not funny. Ok give me $500 dollars." I told him keep calling and wasting your time because I have better things to do then to waste my time on the phone with you and he said, "you will see when the documents come in the mail". I said, "go ahead. mail them and we'll be in touch then."

This is just so ridiculous and I think we can all agree that these documents will probably never come in the mail. This company called E-max apparantly bought the accounts from Ellis Crosby and Associates. Now they are trying to act like a real collection company but they won't provide you with a mailing address. This is because they are so illegal.

If you receive a call from E-max I guess its just going to be a funny call. just tell them you are recording the line whether they like it or not. You will only continue the conversation with them if they answer questions for you and provide you with a mailing address.


According to my phone conversation with them.....I remmber them saying they would not provide their address but I remember Mark Ford said to me they were located in Somerset, NJ which is located to Princeton, NJ. But now I look on this website and look what I find:

Hi Dale,

Welcome to the forums. E max seems to be working with a bunch of unprofessional representatives who does not even know how to deal with the consumers.

As a matter of appreciation, you handled their call very confidently and were sure that they cannot be dangerous. However, always be alert as you never know how these people can come back.

I am going through very hard days in my life having financial problems and have not been able to pay many of my bills. My creditors are calling my neighbors whom I even don't know properly and they leave a note saying to call me back. They are not calling me as I have an answering machine in my phone. I fear they will keep calling everyone else in my neighborhood.

Folks:

This could also be the companies prior address:

Emax Financial Group LLC 1123 King Street Christiansted, St. Croix USVI 00820 License # 2034 issued - 03/19/2004 expired - 7-1-2005.

Apparently these calls are coming from OUT OF AREA so it is possible this company may be operationg out of the US Virgin Islands and may no jurisdiction to collect in your state. (especially with everyone from the compnany having a foreign accent).

I still find it hard to believe on how a collection agency can not provide you an address.

I don't mind paying the loans but if the original loan companies want nothing to do with these loans and keep forwarding me to these illegal places i just might keep dodging these calls until we see what happen with the Ellis Crosby case. Maybe we will win a settlement to pay off the legitimate company and have nothing come out of our pocket.

The fdcpa law does not permit the creditors to call your neighbors more than once and also gather personal information about you. Please send them a letter telling that they should not call you or your neighbors about the past debt. They need to send it through registered mail. If they continue these activities, you can go to your local aid. There are tons of laws for the protection of the consumers and the penalties to the companies are severe.

I specifically asked the people where they were from and he told me India. Everyone I have spoken to or has left a message has a very thick accent. In fact, at times it's hard to understand what they are saying. So if they are operating from outside of the US, can they not collect in the states? Or is it a state by state juridiction? I've asked for validation several times. First they told me they mailed a letter a few weeks ago and then they told me "we mail one 2 day ago" I bet I don't get one, but I will fax them a cease and desist letter on Tuesday.

It appears Emax is trying to charge extra than what the original loan was. The fact of the matter is that they bought the loan from the loan company. Let's say the loan was for $300 and with fees every payday you would be charged $90. As you know the $90 is interest and nothing gets applied towards the $300 unless you choose to pay down or pay off.

Regardless if you default on the loan or not with these scam companies. The most you really need to pay back is $390 maybe even only $300.

Emax is trying to add extra fees to our loan and will not give reasoning for it. They buy these loans for a percentage usually 50%. So they want to charge me over $600 on what they only paid $150 (if they paid that as it might be on consignment). The moist you should be obligated to pay is the original loan amount.

But this company like all the other scam companies really have no jurisdiction to collect in many states. I noticed EMAX has an office in Princeton, NJ but the contact telephone number is in Nevada. I don't believe they are able to collect in the states of New Jersey or New York this is why they use an alternate telephone number. I might just walk into the EMAX office in Princeton, NJ on Tuesday morning and see if any office is really there or if it is just a phony address for postal mail.

I don't know where you live so it will be tough to tell but I can tell you that any collection agency looking to collect a deby will be happy to provide you anything you need and give you telephone numbers and mailing addresses.

Emas is just a spin-off of Ellis Crosby and Associates and will be the next company to be investigated. The only thing I can tell you is that Ellis Crosby were Americans and were slick in how they carefully delivered their choice of words to you as you know many Americans won't put up for sh-t! You can tell these people were from outside the country because they had no rebuttal. They displayed a great example of the terribal illegal collection agency with no skills. That's why I was laughing at them.

I would not pay anything to EMAX or Ellis Crosby or anyone until we know of what outcome will occur from the lawsuit from the State Attorney General's office in Florida on the Ellis Crosby suit.

Just think about think:

You take out a loan for let's say $200 and you have to pay back $260 but now you are in collections from an illegal company and they want $500 or more. Just file a complaint with the BBB and State Attorney General's office. If Ellis Crosby is sued and the Florida State Attorney General wins the case then according to the legal documents borrowers that haved been harrassed will receive $1000 as a settlement.

Next, if EMAX becomes the next Ellis Crosby then they could be sued as well and you may receive another settlement of say $1000.

Eventually, either the original loan company will write off your debt, take whatever you can give and write off the balance or will just pass it along to another illegal company and the same will happen over and over again.

Fact of the matter is you will evetually collect enough money from all these lawsuits to payback all your loans without any money ever coming out of your pocket.

If this keeps continuing you may never have to ever payback the loan.

The thing is Dale...I've already paid Ellis. I paid them $560 for a $200 loan before I found this sight. I have the money gram receipt for it. I've told the people at Emax that I've already paid it. I'm going to fax them a cease letter on Tuesday and maybe they will stop harassing me at work.
Also, if anyone goes by their office in NJ, I would be curious to know if they actually have an office there.
BTW, I'm in Arkansas.

Michele...i live in NJ and not too far from that office but it's funny how that telephone number is linked to a voicemail in Nevada which I even bet noone ever picks up. This place is just another shady scam.

Watch the movie the Boiler Room - If you have then I believe this is what this place really is. It is probably an empty office space that they pay rent and used only for deliveries which are probably returned anyway. I will try to check it out this week. If there is anyone that works there it is probably just a receptionist. It sounds way too shady.

As far as Ellis is concerned, you feel you paid too much right? Make sure you give your story to Summer Saladino of the State Attorney General's office in Florida at myfloridalegal.com. She will listen to your story as she is an attorney and add to the Ellis Crosby complaints already out there. You will be on the list with all of us on getting paid probably our $1000 if the Attoney General (Charlie Crist) wins the case. so you will profit from the deal.

Didn't you have another account Ellis was bugging you about? Reason I ask is I immeadiatley paid hat as due of me, have all my receipts, that was almost a month ago and also confirmed my account is paid in full with the loan company. I am ondering is Ellis selling paid accounts? That would be awful. How did they react when you told them yoy paid it? Or are they referring to a seperate account. My stomach has been in knots for weeks, but I have recieved no phone calls as of yet, and I owe nothing. Do you think I'll still hear from them?Ellis was ok to deal with in my situation.

Ellis was decent to me, I paid very quickly, they signed for all correspondence I have sent them, it was fine dealing with them. I just worry that I'll be abused at work for something I have paid and I can't take the thought of that. So it's your thought that they sold your paid account? Have you been able to speak to the original creditor?I did pay the loan in full plus the applicable fees and confirmed all payments and have documentation from EC as well. Do you think I am worrying for nothing if I haven't heard from these folks yet I probably won't?This is just such a source of stress for me!

How is it that you have confirmation of all documentation when there are over 120 complaints filed with Charlie Crist (Florida Attorney General) and noone of the 120 have ever received any documentation from Ellis Crosby?

I am very suspicious of what you are stating.

I have simply tried to work out this unfourtunate situation in the most expidicious and professional manner possible and would be bummed if I ended up being asked to do it again.I just came here with questions and that is the truth. I also just wanted to state that the fees are applicable, if you read the loan agreement you agree to be responsible for all outside collection costs, legal proceedings, etc. It is very simple. Pay your debt due in full and it is gone. The uncomfortable contact will cease. It's a pretty simple solution.

The problem isnt that these people dont want to pay their debt. The problem is that ellis crosby broke the law in so many different ways. For one the way this company called these people was inappropriate and the threats made were uncalled for. Secondly, the company would not validate any of the debts. There are people who sent money to ellis crosby and the creditors are still after them because ellis crosby did not pay the creditors the money sent to them!! So as you can see, it is not a somple solution.

There are also people who have paid the debts and been left alone after doing so, you can find them in these forums. There are also folks that weren't harrased here too. All I am saying is if you are responsible and follow up you will find the whole experience easier. I can not speak to any inappropriatness as I did not run in to anything like that at all. It's not that you are making anyone uncomfortable, but we hear this type of posting a lot. Some people come on here and categorize us as being irresponsible, when the truth of the matter we are trying to get out of this rut we are in which is why we are here in the first place. Your opinion is always welcomed!! But we have to also look in the eyes of the one in debt and offer good and sound advice without coming down hard and pre judging.

I am not categorizing anyone.Everyone has different circumstances. I myself borrowed money from a freind and sold some items of value to get myself out of all payday loan debt as defaulting on one was an unpleasant enough experience that I was not going to go there again. Alot of the stress I felt, to be honest was from reading these forums befor I even contacted the CA, who did work with me to clear things up quickly. As for valadation, I haven't recieved it, but I knew the debt was mine and did not question the validity or feel like I was being scammed. The irony is the default was due to my bank posting my deposit to the wrong account which caused a return and by the time I caught it it was too late.
There is alot of good info here on how to protect yourself from harrasment, and I definatley learned alot that helped me act as an educated consumer, however in the end it as not neccesary .I think that if you are going to share bad experiences with this and other companies, you have to be fair and show the other side of things too.

I agree.There are people who work with these companies and don't have bad experiences. They deserve the benifit of the doubt , just as the consumer does.If people are allowed to come here and post their experiences, shouldn't that include the good ones too? They are doing a job, and they would'nt be contacting you if there wasn't a default on a debt.The best thing to do is be informed, but do your damndest to pay the debt of as quickly as possible and learn from your mistakes.

mark ford called me and acted as an investigator said my husband was going to be arrested said he has contacted the magistrate and sheriff in my town said all kinds of abusive things called my usband at work said they were going to prosecute him for fraud and bad checks because we had a pay day loan for 200.00 and my check acct closed they said now we had to pay 635.00 by 3:00 or they would send the papers over to my county court. It was 1:00 then I called my attorney and he said do not talk to them theyn can not arrest you for a debt. I also called attrny generals of my state and of fl also bbb also I checked with the local sheriffs office and they never rcvd anything from these people they said they can not arrest for this. He never said that his company name but when I called the number back 1-800-491-8615 it was ellis crosby and assoc. We did not send them the money and we are willing to pay the original creditor but to be harrassed like this is intollerable. I am 6 months pregnant I have 2 kids allready and this man was threatining me and my husband. I can not believe people are like this. I contacted everyone I could to make a claim against them. I just had another call from them and let them have it. then I found this site about emax is this the same thing?

Welcome to the forums. It is very nice that you did not pay anything to Ellis Crosby. They have once again used the same old tactic on you to recover the money from you. Even if you pay them this time, it will not go to your debt account.

You have done the needful by informing the BBB, State attorney General Office and also file complaints at the FTC.

Also, next time, if they call you, tell them that you are well informed about their suspension and that a lawsuit has been filed against them. So, they don't have the legal right to recover the debt from you. If necessary, you will hire an attorney to deal with them.

Be strong and everything will be fine.

Ben be sure that u advise these people to be responsible. whatever legal issues ellis crosby has,these people borrowed this money , defaulted on the contracts and they actually are liable. its not going to dissapear. there is no such thing as free cash!!!! these folks need to be taught to budget & be financially responsible.

no i try to be carefull who i borrow from & super carefull that i pay it back to aviod high intrest. i try to teach my children the same scruples. you guys are not "wasting money" you are paying back a loan that u defaulted on with intrest & late fees..now i would like to see any agency that abused anyone to be accountable but you see i used to do collections for a bank & i have first hand experience with deadbeats.
if any of u people had 1 payday loan & got in a bind i can certainly understand...but for those of u that have numerous defaulted payday loans give us a break!
your debt are not going to dissapear.i can relate to some of u but some of u are deadbeats,druggies and/or very irresponsible people with a long history of not paying anyone.this site has opened the flood gates for alot of so called victims looking for a free ride.
if i was a deadbeat freeloader i would be first in line on this site with numerous complaints on how these collection angencys "harrass" me & lie to me to. some of u deserve it! take a financial class & get a life!!

If anyone here has a long history of not paying any of their debts, don't you think the payday lender would not give you a loan ? You would think...but they dont care nor do they consider the consumer's ability to repay the loan. There are no credit checks...all they care about is if you have a steady paycheck and direct deposit.

Anyways, the problem discussed here is Ellis Crosby & Associates and their illegal and abusive collection practices. Predatory lending or "payday" loans is a whole other subject.

NO ONE DESERVES TO BE HARRASSED SANDY! The point here is Ellis Crosby & Associates breaks the law and consumers need to be aware of this to protect themselves. EC is extorting money that is not legally owed AND they are lying, humiliating, intimidating and scaring the crap out of people. There is no need for that and there are laws against it. The day we consumers give up our rights and allow such activities is the day we might as well all say "we dont mind being screwed, come and take us for all we have!!"

I agree Sandy, stop getting payday loans, read the contracts, arm yourself and use common sense. The best thing to do if you do decide to get a payday loan is PAY IT COMPLETELY off on your next payperiod. Then you only incurr (1) finance charge.

However, this is too often not what financially strapped consumers do. They end up refinancing on top of refinancing before they even begin to pay down on the loan. Its a vicious cycle and ends up costing the consumer more than 3 times the original loan by the time they are cleared of the debt. Granted, no one forces anyone into taking a payday loan, an unexpected financial hardship does, and yes, consumers default on the loans, but that does not give a third-party debt collector the right to attempt to collect money in an abusive and illegal manner.

I hear ya KATIE, I wont be taken for all I have either!! I pulled my credit report to find out what I owe, since EC refused to tell me, and it is ridiculous. It says I owe $918. The original amount was $300, I have paid over $400 in finance charges AND I still owe $918? OMG, I sent a letter to the orginal creditor asking them to send me my detailed account information. I want to know what the heck they say I still owe is.

Once I can validate it, then I will be more than happy to work with them, but until then, I am not paying one red cent, especially not to EC!!

Hi Sandy,

Being in debt is not a fault, I think. The thing which is important is paying it back timely. But, if someone fails to do so, do the collection agencies have rights to harass them? I think they are also aware of the rules stated under fdcpa. They cannot violate those rules.

Yesterday I saw a post in this forum that collection agency is harassing an elderly lady who has lost everything in Katrina and is an Alzheimer's patient. Do you think this is ethical?

All that I would like to say that collection people should differentiate between an escapist and a person who is really in trouble.

bryan if this lady losy everything in katrina how in the heck are the collection angencys contacting her?
at the shelters or at a nice strangers home who welcomed the elderly lady free room & board? u see my point bryan. we have the fdcpa to protect us along with rule of law but there are always people trying to take advantage of any situation.some of these complainers and lawsuit chasers are professional debtors and they make it bad the the ones with legit issues.

Seriously, maybe you'd like to walk a mile in our shoes before you post such inane comments as you have.
All of us here that are in debt, be it as the result of payday loans, car loans, home loans, etc etc...we WANT and TRY to pay back what we borrowed...but sometimes something happens where we just can't do that immediately. Desperate times call for desperate measures and sometimes we have to resort to things such as payday loans in order to EAT.
I've paid back a few of my payday loans...but not more than I borrowed, plus the interest. And that sounds damn fair to me.

We are not pathetic
We are human, we are learning from our experience and I think we're pretty intelligent and awesome to be posting on this forum, helping eachother out and learning, in order to better ourselves and our situation.
Apparently you don't have a debt problem, because if you did, you'd know what it was like and you wouldn't have bashed us like that. THis board is for those who want to learn HOW to get of debt and how not to repeat the same mistakes again.

Sorry if these seems harsh, to everyone one else that is reading this, but I know we try and I'm defending us and our reasonable financial statuses.

lindsey why is it that everytime someone on this post has a slightly different point of veiw they are accused of working for a collection agency or ellis?
i said before that i collected years ago for citibank so i have more of a insight on both sides of the issue. years ago folks with a different veiw point were called communist . we can all agreee to disagree and still be cordial.
