Need help negotiating with Capital One

I'm new to this site but thought I should throw out my question. Long story short, we got into some financial trouble and consequently were unable to make our payments to Capital One credit card. It has been over 6 months and we have now received an official letter that they are going to take legal action. The letter came from Capital One not their collection agency (I think). In about a month, we will be in a position to start making some kind of payment to them on a regular basis. Of course now our balance is close to $10,000 due all their fees and our lack of payment. Any advice of how to handle this would be appreciated or what we could expect?? We certainly don't want to be taken to court or have our wages garnished. What to do???


Capital One Bank, Capital One Services, Capital Recovery Services, Westmoreland Agency, all a part of a money machine that is reminiscent of Providian Bank and their defunct First Select operations. They prey upon the weak and unsophisticated consumer with offers that end up screwing those people who least can afford it. These vultures will pick your wallet clean if you allow them.

Capital One, F.S.B. apparently cannot gouge enough money from consumers from their credit card operations; they are now crossing over into the scavenger debt collection field. Letters are being mailed nationally stating that Capital One Bank, F.S.B. has purchased your charged-off debts and assigned them to their wholly owned subsidiary;THE WESTMORELAND AGENCY.

CAPITAL ONE:
Q: ???????What do they have in your wallet???????
A: Their hands; BOTH of them!

How bad is it, when a sub-prime lender likes Capital One becomes a bottom-feeder, vulture, debt buyer? The smell from this group of parasites should be nauseating to everyone.

Capital One and Westmoreland Agency are greasy-slick in their approach to consumers. They operate as vultures who grab at every bite that is available off your money tree. From seemingly incredible offers on their promotional literature, to the sky-high fees, late charges and annual percentage rates they charge when you have problems. Dealing with Capital One is almost guaranteed to cause you financial hardship at some point. Remember those old western scenes with the buzzards waiting on the trees for the poor guy to die; didn????????t those buzzards have a Capital One logo on their wings?

There is nothing good to come to anyone who deals with these vultures, so my advice is stay far away. If you are unfortunate enough to have believed their bulls*** and suffering the consequences of those actions, use the information from this site.

Capital One and The Westmoreland Agency??????? Just say NO!

I had a capital one card and they were rude and NEVER made arrangements that were feasible. I really tried to pay them off, but in the end I had to give up the fight. They eventually charged off the debt but not before one of the collectors, while talking to me on the phone, actually put me on hold and called my bank (needless to say I'm not with them anymore) and verified that I had enough money in the account to pay what he was asking me to pay. Nevermind that I had written checks that needed to clear and there was not nearly as much disposable money in the account as what was reflected in the balance. Bottom line...They did not get my permission to call the bank..the bank certainly didn't have my permission to give them info...They are slimey and don't care if you are in a tough situation. They just want their money...even if you have to steal to get it!

Most credit card companies wont give you problems until you have a little hic-up and thats when they get put to the test. It really pisses me off when I call a CC about a BS fee they charged and they tell me they have to put it into the system and whatever it says is what the operator has to do when I know darn well the op could remove it if they wanted to. Another one that drives me nuts is when the argue with you and say the fee is valid. I received a $39 late fee on a $100 balance a few months ago and the stupid op was trying to argue with me that the fee was valid because the payment was a couple days late according to them. Come on thats a freaking %40 fee on my balance. I really think we need a class action lawsuit against all major credit card companies for abusive fees. No other company I do business with charges $39 for a bill that is 1 day late or more and they certianly do not try to charge you a fee for going over some ficticious limit they set.

I know. I have been caught with a late payment before (1-2 days), and the late charge put me over my limit and I ended up with both a late charge and an over the limit charge. It is ridiculous (sp?). With the fees that were tacked on, I could have made a double payment. But, they refused to remove them.

Yes, the domino fee effect is something to watch out for. How about this: lets say you ahve $100 in your checking account. You are sending out a check for $80 to pay your cc. Then you forget about the $80 and you charge $30 for gas. So now you hve $70 in your account. The check gets to the credit card processing dept. They cash it in. You checking account goes $10 negative. Your bank charges you $30 for going over the limit. Then your cc company refunds your $80 because your bank doesn't cover checks when you have negative balance. Your bank charges you another $30 for a bounced check. Now the cc company has received a check that bounced. They charge you $30 for a bounced check; $39 for missing a payment. This throws your cc account into a negative balance. They charge you $39 for that.

So, you can see, ladies and gentleman, how the domino effect works. You have made one $10 mistake, which will cost you $168 in fees, plus a messed up credit score.
