i have about 10 or so internet payday loans in Virginia. i've checked my states laws and determined that these loan companies are operating illegally. I have had some of these loans for over a year and at this point i am in so much debt that i've almost lost all hope. i've closed my bank account but now these companies are calling me constantly. Please help.

Hi Marlo-You have come to the right place and we are here to help...you mentioned that you reviewed the laws, but here they are again. Also, can you please list who the loans are with, how much the loan was for and hwo much you have paid, also if they are internet or storefront.

You will find the Payday loan Virginia here (just select your state),

Nice job Marlo! I know that was a lot of info!

From what I can see you have paid the principal back on these multiple times over!

So, you say you bank account is closed? Have you send these pdl's letters letting them know not to contact you anymore and to revoke any wage assignments (just in case)? If not, I can PM you a letter to send them. Be prepared for the constant calls.....some will stop after you send them the letter, some will not.

OMG...you poor thing!! I can't believe how uch they have taken from you...this crap just makes me cry sometimes.

All are paid except your last with MTE...make sure you get and keep that bank account closed...send cease and desist letters to all of them...demand refunds from the ones you grossley overpaid!!!

You said you checked and none are licensed?? Correct??

Marlo, Be sure you do as Volleyballmom says and send (use certified mail} and e-mail and fax these pdl's letters and include the things she told you to. Also let your payroll department know about your revoking any wage assignemnts you may have signed. A couple of the companies you listed can be difficult to deal with. They have already started calling you. Try not to take the calls. Take messages for yourself it you need to. Document everthing and try to only correspond to them in writing...for documentation purposes..you can put that in your letter when you tell them not to call you. All the documentation will help you when you file. At the time you send the letter you can inform them that you overpaid and tell them you demand a refund. Biker Girl has been luckier than most. Like you I way overpaid mine (I had 8) and I have only seen two refunds and they were for the two smaller amounts. If you have any questions or need any help, just post. As volleyballmom said, if you need a sample letter, just ask. There are several that members have shared. I really hate that you have so overpaid your loans and I hope we can help you get them resolved in your favor. roxy

Okay. Your bank account is closed. They can't debit any further. You now need to kick some butt in the letter writing department. They're going to call your head off, as the majority of these are illegal/unlicensed pld's. Okay? So, you need to write letters to each one revoking any debit authorization, any wage assignment you may have signed, only contact you via email or USPS - no phone calls. Try not to take their phone calls at all if possible. You NEED to get these letters out ASAP. Your ROUTE66 - you need to send a letter revoking wage assignment ASAP! And I mean NOW! Before they send a wage assignment to your employer. Wage assignments are strictly voluntary; however, most employers do not know this and may abide by it and take the money out of your check. So, right now, type a letter revoking any wage assignment you may have signed with them, their partners, or their affiliates. Fax it, email it, mail it certified to them NOW. Route66 will pull the "wage assignment" on you. Now, as for your loans. If they are all indeed unlicensed/illegal, you are going to have to fight the crap out of these people. Here's the breakdown IF they are unlicensed/illegal. These amounts are based upon owing the principle amount only. As, if they are unlicensed/illegal, you only need to pay back the principle amount. Are you ready?

UNITED CASH LOANS - borrowed 400/paid 945/OVERPAID 545
(unlicensed/illegal)

PAYDAYSERVICE - borrowed 500/paid 1775/OVERPAID 1275
(don't know about this one)

AMBASSADOR - borrowed 500/paid 690/OVERPAID 190
(unlicensed/illegal)

ROUTE 66 - borrowed 225/paid 455/OVERPAID 230
(way illegal)

GENEVA ROTH - borrowed 300/paid 1440/OVERPAID 1140
(unlicensed/illegal)

SPEEDYPAYDAY - borrowed 1000/paid 1250/OVERPAID 250
(don't know about this one)

National Money Store - borrowed 1000/paid 1762.50/OVERPAID 762.50
(don't know about this one)

WORLDWIDECASH - borrowed 400/paid 1090/OVERPAID 690
(unlicensed/illegal)

MYPAYDAYLOAN - borrowed 800/paid 600/OWE 200
(don't know about this one)

AIP - borrowed 200/paid 289/OVERPAID 89
(unlicensed/illegal)

MTE FINANCIAL - borrowed 300/paid 0/OWE 300
(unlicensed/illegal)

PAYDAYAVENUE - borrowed 4300/paid 5303.22/OVERPAID 1003.22
(don't know about this one)

BikerGirl, were you able to obtain refunds from any of the companies i listed? what is my best bet to get money back from these companies? if thats not possible, does anyone know if these people are willing to accept my accounts as paid in full and just end the contract? the companies i've talked to are demanding that i pay much more than the principle (finance fees, late fees, NSF fees, etc.), but now i want to turn the tables on them and demand some of my money back. as you can imagine, the last year of my life has been completely ruined by this mess. i am still struggling just to eat regular meals lately and a refund from these companies would at least allow me to get back on my feet.

AIP will usually give refunds, but please file a complaint against them with the BBB . . . . For some reason they seem to respond really well the complaints from the BBB . . . .

The other companies are not really known for giving refunds, but it is always worth a try. If you are owed it, go for it. You can always settle for PIF . . . .

Hi Marlo...I will be sending you a PM shortly with a sample letter.

Also, I have to tell you that from what I have seen, refunds are few and far between :( but it is worth a shot!! The goal for now at least would be to get these pdls' to agree to mark your account PIF since you have definitely overpaid!!

Typically you can go to the company website to find the addresses, but hang on and I will see what I can find.

Anyone have these addresses handy for Marlo??

Marlo, I still owe a couple that are on your list, in process of trying to work with them. Here's addresses for MTE and Ambassador. I have heard that MTE is very difficult to work with too. I offered Ambassador $170 and they came back and said $100 to pay loan off, sent them a check this morning. I started with 10 pdls and now down to 3 that are wanting to play hardball.

These addresses posted above are from the BBB site.
Can not locate paydayavenue, mypaydayloan, or route 66. You may have to do another sort of search for PayDayAvenue and MyPayDayLoan. Route 66 is going by another d/b/a, I'm sure. They are overseas. Geneva Roth has multiple addresses. Not sure which one you need. :D

Route 66 may be the same as BIG, Cash2Day4U, etc... They use many d/b/a's. And I know they are illegal and overseas. They use a US address as a "drop box" for their mail. If this is the case, the address is:

1005 Terminal Way STE 110
Reno, NV 89502-2179
Telephone: (800) 680-2177

Cannr and Volleyballmom, i cannot thank you enough. i will send the letters out today.

update...i spoke with someone from geneva roth...although my loan was $300 and i've paid over $1400 so far, they informed me that my remaining balance to close the account was $1200. i told them good luck.

i cant fathom how these people sleep at night knowing how they ruin others' lives to earn a living.

I live in Virginia- are the 2 companys even lega?

NO! One Click Cash and United Cash Loans are d/b/a's of MTE Financial. They are Satan. I'm posting your state pdl law for you to see. However, One Click and United are NOT licensed/legal to lend. Illegal. I'm going to post your state pld law and then post information regarding closing your bank account. You need to get your bank account situation under control ASAP so that these companies can no longer debit. They will not stop. Hang on.

Please read this carefully and post any questions that you may have!

Quote:

Before you close your bank account due to payday loans eating away at your paycheck, please read this.

Some banks have a policy regarding ach transactions that allows them to force open closed accounts if any ach transactions go through within a certain time frame after the account is closed. This can leave you owing a legal bank $1,000's and reported to chexsystems, instead of owing barely legal (or not at all legal) payday loan companies. Not a good thing. Ask your bank what their policy is on ach transactions on closed accounts before you close the account. It's best to go in person and talk to a branch manager.

If your bank does have this policy, tell them your situation. Don't be embarrassed. Take letters with you showing that you have revoked authorization for each of your payday loan companies to debit your account. Tell the bank to put your account on deposit only, an ach block, or a hard hold before they close the account. Your bank can do one of those, don't take no for an answer. This will prevent any payday loan ach's from reopening the bank account.

It'a always best to close your bank account. Leaving it open gives ways for the payday loan companies to continue to take money out. These companies have many different dba's, so blocking them won't work. They will also produce paper checks and run them through your account. Closing the account is the best way to prevent these companies from taking money out of your account.

Some state laws do allow for prosecution if you close your bank account, but that is usually in cases of fraud. But it's always best to check with your state's attorney general or department of financial institution before you close your account. You want to make sure you are not causing more heacaches!
