E-max bought accounts from Ellis Crosby

I received a phone call from 3 people from E-max that don't stop calling. First a Mark Ford called saying he wants $688 due immediately from a deby due from Bahamas Marketing Group. I told him to give me his telephone number and he gave 1-800-458-9081. Then I asked him where he was located and he said Somerset, NJ. (Kind of strange when all 3 people have an Indian accent and couldn't even provide me an addressof his location). When I asked for the address he placed me onhold and hungup.

Round 2 (10 minutes later), I get a call from Sophia stating she was from Emax. I told her I do not know who you are and not to call again. I hung up on her.

Round 3 (5 minutes later), Sophia calls back and says my manager wants to talk to you named Keith. I get Keith on the phone and tell him to give me his location, address, phone number, license number, agency number, also to mail me a validation that he has the right to collection in my state. He claims he mailed me a leeter on 9/1/05 stating that I owe $638 for a debt from PPGC (Premier Processing Group) I said what? Keith said ok it's $526.50. He changed the price again. I told him the phone line is being recorded and he said no do not record the phone line. I said do not call me again and only mail me documents he said, "I will keep calling you everyday until you fax me a cease and desist letter to 732-748-4381". I then said, "don't order me around. why don't you give me your address and i'll have my attorney send you a legal document." he said, "you don't need my address. you just need my fax number."

I just started laughing at him and said, "Keith you are funny. Are you sure you are with a real collection agency? You are just making me laugh to hard." He said, "stop it. it's not funny. Ok give me $500 dollars." I told him keep calling and wasting your time because I have better things to do then to waste my time on the phone with you and he said, "you will see when the documents come in the mail". I said, "go ahead. mail them and we'll be in touch then."

This is just so ridiculous and I think we can all agree that these documents will probably never come in the mail. This company called E-max apparantly bought the accounts from Ellis Crosby and Associates. Now they are trying to act like a real collection company but they won't provide you with a mailing address. This is because they are so illegal.

If you receive a call from E-max I guess its just going to be a funny call. just tell them you are recording the line whether they like it or not. You will only continue the conversation with them if they answer questions for you and provide you with a mailing address.


I have Faxed 2 cease contact letters to The number for Emax, and they have called me once at work since then, and several times leaving messages at home since then.
I wonder if it is the wrong fax number??

Also, I always get messages from what sounds like the SAME person, with different names each time.....anyone else get that too??

When E-Max was calling me consecutively, I unplugged my phone. I shouldn't have to do that, especially since part of my job description is taking calls. And not THEIR calls.

I don't want anything from Ellis, no money, no apology...I just want to see them go under big time...and leave us all alone.

I am wondering the same thing Katie. Their comments dont do anyone any good here so what do they have to gain? No one here is a deadbeat, we are all trying to get back on track and the advice we get here helps us to do that.

First of all ANGRY MAX, we didnt call Ellis Crosby & Associates, they called us. It was them who chose to lie and harass us. And its not just people here who have had a bad experience with them. Try over 120 complaints just in the state of Florida.

An inability to pay is not a refusal to pay. EC has seriously and repeadidly violated consumer's civil rights for over three years and they need to be stopped.

You have to be respectful to all the users regardless of opinion.

(3) I'm wiling to bet with a little bit of research you are a collection agency that is upset with the fact that we've found a way to deal with ignorant and unlawful collections.

How can you come to a support forum with the intention of badmouthing people and causing trouble and not expect to be censored?

You are ALLOWED to disagree. You are ALLOWED to have your own opinions and opposing views. You are ALLOWED to defend yourself.

You are NOT ALLOWED to intentionally stir up members. You are NOT ALLOWED to make posts that have no relevance to the subject other than to badmouth people.

You may have been taken a bit more serious if you would have taken the time to register an account. For someone that is so concerned with "free speech" and is "so concerned" about our members, then why not create an account and join in our conversations with some constructive criticism or respectful feedback? I would encourage you to do so.

To be honest, why even post here AMAX? The opposing side is Ellis Crosby and their abusive and illegal collection tactics. If you have something to say in their behalf, then let's here it. I am curious why they harass, lie and intimidate consumers when they know it is against the law. I am curious why they extort more money than what is legally owed when they know that is against the law.

Well it's confirmed...Ellis Crosby and Idiots are as immature as we discovered via phone.
I'd like to say to Ellis & Crosby: Thanks for the laughs, the hilarious threats and the calls from your "Investigators." Next time, make sure you aren't calling a LEGITIMATE investigator before calling yourself such. I hope you enjoy working at Burger King.

Btw, why so ANGRY? You've taken several innocent peoples' money for no reason. You should be happy, right? You'll never get ANY of my money, that's for sure.

Correct on the fax thing, I receieved 2 more messages and another call at work today. I have faxed 2 letters, but I do not know their address for a certified letter.....And when they call me at work he does not let me get off the phone, I have to hang up on him. I cannot take personal calls at work!

Anyone know Emax's address???

Anytime you feel the call is getting out of hand at work, mention that they're calling a business and all calls are logged and recored. Mention again that you've asked for the calls to stop at work, say have a nice day and hang up.

If they call back, tell them they need to hold while you call the state attorneys office...

They can't keep calling ONCE (meaning one time) when they've been told.

Tracy...tell me how do we go about a lawsuit against Ellis Crosby and Emax? I didn't pay either one of them a dime but I received a call I still have saved on my answering machine by Ellis Crosby's (so-called laughable)Investigator. I laso received a threatening call from ECA and Emax. How much do you think I can sue ECA for? I was thinking if I sue ECA personally then maybe I can make enough money from ECA to pay off all my debt with other compnaies. Let us know what we should do to sue ECA.

Dale, I contacted an attorney in my State, Texas and he didnt charge me anything. He reviewed my complaint and said that I had sufficient cause to file a lawsuit. He recovers his attorney fees, etc from the Defendent in the lawsuit (which is what our finance code allows). In the state of Texas, statutory relief is different from Florida. In Florida it is up to $1000 and that is it (unless you are over 65, then it is up to $15,000), in Texas it is $100 PER violation.

Contact an attorney in your state and do some research on your state's finance code and fair debt collection practices act. Both should tell you what you can sue for.

Word of advice, keep records of all calls you receive from EC and EMAX, if you can record them, do so, write down everytime they call,what time they called, who you spoke to and what the call entrailed. Keep all documents (letters, etc) they have sent you.

Also, you should attempt to contact the original creditor and see if you can work payments out with them. I did, I havent gotten a response, probably because they will transfer the account to another collection agency, which is fine with me, as long as they are reputable. Either way, filing a lawsuit against EC or EMAX wont resolve the original debt, but it will prevent them from making any further abusive and illegal collection calls to you. It will also bring some statutory relief, just depends on your State's law.

I should hope that the original creditor will transfer the account elsewhere, but from what I have been reading, I may be getting a call from EMAX at some point. Can EC sell accounts they are trying to collect on to another collection agency, such as EMAX? I thought only the original creditor could do that.

Debts get sold from one collection agency to another without the interference of the creditor. The creditors are in the picture only when the debt is with them or they have hired some internal collection agency for it.

There should be some kind of legal thing publishing that the debt is now owned by ...company.

I dont think a collection agency can legally "own" a debt. I am not sure how it works, but if a consumer has a valid debt with say a payday lender, then they have a contract with that lender. That lender can not sell the contract to a collection agency or it would be null and void because the consumer did not sign the contract with the collection agency. Thus, I am thinking the collection agency does and can not legally own the debt. They can only collect on behalf of the original creditor. Now, the creditor may have "sold" the debt to the collection agency, but I think that is mererly giving them the legal authority to collect on it and nothing else. The collection agency probably gets a percentage of what is collected or a flat payout, who knows.

It is true that the collection agency cannot legally own the debt. They are just hired to recover the debt from the consumers. In case, the debt is sold to the collection agency, they are required to produce the following details to the consumers before they have the legal rights to collections.

  • The details of the account.

  • All the calculation should be shown of the amount that is owed.

  • Any copies of the papers to be furnished that shows the payment agreement.

  • Provide a verification or copy of any judgment if applicable

  • The original creditor needs to be identified.

  • The Statute of Limitation needs to be proven for the collection of the debt.

  • The license of the collection agency applicable in the state is to be furnished along with the license numbers and Registered Agent

  • Proof of the agreement that the debt collector has purchased the debt or has been hired by the creditor to collect the debt from the debtor as this is the basic contract law.

  • Complete payment history showing the details of the creditors, payment history, amount of the debt, break up of fees/interest should be provided in paper.

  • A copy of the original signed loan agreement between the debtor and the original creditor establishing the debt between both the parties also has to be produced.

OK, at least I know that if they threaten to take me to court then they have the right to do so. That is if they even have legal right to the debt they are trying to collect from me. I have no idea if they do or dont, because I have not received anything from them regarding the debt. They called me back on 8/25 and intimidated me with arrest and said I was being charged with internet and check fraud. I told their "investigator" that I was recording him, he got pretty mad at me because of that and hung up. I have not heard from them since.

Thanks Katie for the website. And yes, I am in Texas and I was thinking that a collection agency could not sue me regardless if they legally owned the debt. I know that is different for every state, some states may allow for it, but Texas does not. The link you provided says that a bank or collection agency can not sue you in a civil court, but that I can and I have. I have a lawsuit pending against EC for what they did to me.

Things are a bit different here though, EC will only be fined up to $100.00 per violation and I may receive a little restitution, but not much. I am not so concerned about the money, I just want them off my back. I dont want to deal with them whatsoever. I have contacted the original creditor to try to work out payment arrangements with them, but they have not responded yet. Just have to wait and see the outcome of my suit I guess.

Kremaley, thanks, I found the website. I am not being sued by Ellis Crosby & Associates, but they intimidated me with a lawsuit and arrest. They told me I was being charged for a serious federal crime in Texas and that an officer was standing by to process me. To make a long story short, I freaked...then I went looking for answers. I found this forum and everyone here has been absolutely awesome. I contacted a private attorney who has filed a case against EC, the suit is pending. I was just curious on whether or not if EC had the right to take me to court.

Only the original creditor can take you to court.

collection agencies are basically just that. A collection agency.

When the creditor sells it to an agency such as ECA, they can attempt to retrieve the money. If a settlement is not made, they may refer it to their legal department, but I don't believe legal action can actually be taken since they are not the creditor. They're just a collector.

I am not so worried about EC anymore, I just hate to read all the horror stories that keep coming in about them. Everyday there is a new posting. EC is still attempting to collect debts in an abusive and illegal manner. It is obvious they dont care about the lawsuit agasint them. They are not going to stop until someone makes them. I cant wait until EC gets what they deserve in court and hopefully, they will be shut down for good.
