Can someone provide a sample letter to PDL companies that will result in being able to arrive at affordable payments? I have already paid almost $100 over the amount originally borrowed on one and they say they will set up arrangements for the remaining $450 if I first pay them $216 in past due fees???????????????????????

To: XXXpdlcoXXX To Whom It May Concern: Regarding: Loan Number XXXXX After doing research on payday loan laws in the state of (whatever state you live in)I have found the below laws to be true: (Put your state's laws here) I also found out that you are not licensed in the state of (your state here)to issue loans. I have currently paid $XXX on my $XXX loan. The LEGAL amount that could have been charged on my $XXX loan, if you had been licensed in the state of (your state here), would be the principal of $XXX and an $XXX finance charge. I have OVERPAID my loan in the amount of $XXX. I am demanding a refund of that overpayment. I also demand that my loan be marked as PAID IN FULL and that any actions to collect more be stopped. I also demand that any contact to me must be done through EMAIL ONLY so I can keep accurate copies of any correspondence in case I need to file a formal complaint. I also demand that you may no longer contact my place of employment, or my references. You are hereby notified that I am revoking any voluntary wage assignment. I no longer authorize you, your company, or an affiliate to attach any part or my wage or contact my payroll department for your collection purposes. Please be aware that I will be contacting my payroll department of this correspondence. I am revoking your right to debit my checking account. Please be aware that I will provide a copy of this revocation to the branch manager at my bank. Any further attempts will be rejected by my financial institution. If the above demands are not met I will have no other option than to file a formal complaint with the (your state here) Attorney General and the Better Business Bureau. I expect a response no later than (give a day and date for the response)or I will have no choice but to file the complaints. Please be aware that I have sent this correspondence via fax, email, and certified return-receipt mail, as well as have kept a copy for my records in the event that formal action needs to be taken. I expect my refund to be issued in a timely manner. As long as my loan is marked with a PAID IN FULL status and my refund is issued quickly, I will not file a complaint with either of the above mentioned parties. Cordially, (Your name here) |
