Three questions - Should I do a debt validation with LVNV via certified mail?
How much should I offer as a settlement, or should I let them go first.
I also want to file an answer with the court - should I just tell the court that I have contacted the creditor and am waiting for debt validation and enclose the copies of the letters that I sent?
I am in NJ. The debt is mine, but I don't really want to pay monthly - the best I would do is 3 payments over 90 days on a settlement amount.
I will continue to look over the forum for the answers I need. Thank you inadvance.

Have you called your court house to make sure this is real and when the court date is?
LVNV usually doesn't validate- at least the proper way.
If you make settlement arrangements you are affirming this is your debt and the Debt Validation becomes null and void- if I am not mistaken.
Last- be sure and show up on your court date, they will get a default judgement if you don't.
If you decide this is your debt, they are the ones who are legally bound to be able to collect, and you want to pay-you can offer a settlement proposal to the inwriting. They may not accept it- but what ever you do, get everything in writing before you make a payment..Good Luck..KAren

Accepting YOUR DEBT
You borrowed the money, and as they lent it to you, they also trusted you to not be scared to contact them if you ran into a hard time, such as loss of job, or a reduced income.
Just give them a call find out your options give it a few days and think about it and call back...
think about it this way.. what if somone owed YOU that money, and they were not paying YOU back...
Also remember if you settle it does show on your credit and if you have the money try to pay it in full so you can keep your credit score for another loan later on in life...

Even stranger is the fact that LVNV is one of the worse collection agencies in the country!

I agree with the point that if you owe to someone you should try to repay it, but the issue is with the unfair means that these collection agencies practice to rip-off people. That is the reason why people are scared even to call them up.
HSBC Tatics
I have a Defaulted (after courts ) case against me from HSBC. I had a CC, used it occasionally. was making Regular, monthly payments. then as i got close to my credit limit (under 100.00 credit avialable) my payments started to get tagged with a late payment fee (my payments were ALWAYS sent 10 days Prior to being Due), but this late payment fee, put me over the credit limit, so then there was an over limit fee attatched. from this point on, my HSBC Credit Card was a Mess. i called and argued and called and argued. i did get the late payment fees removed, but they would refuse to remove the over fee limits, even though it was their fraudulent tatics of holding the payment until after the due date to open it that put my balance over the credit limit. ofcourse, this started a couple years ago.
i was so pissed off, i told them to take their card and shove it. quite making payments as every one always mysteriously arrived LATE, even though it was sent in my customary 10 days prior fasion. 4 months later, they offer me a fair payoff, left a message on my answering machine over a weekend while i was gone. so i call them back, and get told sorry, the end date to accept payoff amount was yesterday, which was a sunday, and the payoff offer was revoked.
what can i do, they are garnishing my wages, in what i feel is a totally unjust way, afterall, it was their lewd and low tatics that started the bad part of this account anyways?
any help you can offer would be great.

yes it is =) but i want people to know that just not paying the money back its the worst way to go, and yes we all know tht but sometimes it needs to be read.
Ofcourse its not as easy as its sounds if your self employed and didnt have money saved up for the slow months, but if all of a sudden overtime is gone or your company doesnt want to pay bouses anymore, that was never money you should of counted on.
Whether if you owe the money to HSBC or another bank you will receive the same phone calls to see what has change and why you cant afford your payments anymore, but the worse thing is to go to a debt consolidation company and pay them to pay your bills. (Look for a non-profit, and get educated on it first, it can be a good option)
I just think people give up too quickly before asking for help, or they only ask once and let it go. I also believe people forget why they borrowed the money in the first place, and how happy we were when we got, did not think do i really need this much or do i really even need it? the first mistake is we dont read the the rules and we dont ask the questions we need to and then when something happens we blame the lenders, im not saying its always the borrows faults, but i know more people that were careless with the amount they borrowed and had no plans if they did go over the limit or were late if they would be able to afford the fees and continue to catch up the loan with the high interest rate you were aware of if you did default. But thats just my opinion.
Im never always happy with my banks answers but hey my bed wont pay me interst and who else would lend me cash and call me to remind me to pay my bill.. NO ONE

From what I can figure if they baught your debt, you pretty much loss your options on an working something out? and should get a DV, to make sure who you are dealing with, never give your info to a company your not familiar with =/...
Usually my lender will call me and be like: You didnt pay your last month bill...and I'll pay it and apoligize for being late, and then set it on automatic payments to make sure it doesnt happen again. Its my responsiability and Im willing to accept it.

Well, Kat, in my case I was laid off and immediately contacted every one of my creditors to let them know and see what I could do. Each and every one told me nothing could be done until my account was past due by at least 30 or 60 days. By the time I qualified for any hardship program I was still unemployed and didn't have the money or consistent income to allow me to commit to a set monthly payment. And circumstances still really, really suck.
I'm sorry if I'm coming off rude, but it drives me crazy after having paid every one of my bills and debts responsibly and punctually for years and years and years only to fall on hard times, then have someone say, "Well, if you'd only paid your bills..." or "If you weren't such a deadbeat...".

I know what your going through, I fell on hard times too, I still have a job, but mine were family medical X2, anyway, I did what you did I called first thing to try and get help and was refused. Needless to say now I have three charge offs on my credit report and all turned over to collection agencies. I do hope someday I will be able to get it all paid off, but at this point I don't know how, they have made it nearly impossible, one of my creditor finally came around with a reasonable offer, which was a hardship program, so I did save that one, but the other three would not. Anyway, I just wanted to say hang in there, its easy for people to come on here and say "if you'd only paid your bills, etc." I hope those people never have to endure what we have been through. I can say one illness in a family can ruin you, and we had two back to back, and it has been tough. But you know what, I'm making peace with it, people can call me a deadbeat whatever, but karma can come back to bite ya, so people need to watch what they say and how they judge. Sorry, for rambling, just make me mad when people come on here and judge other people, if it was that easy to "just pay your bills" we wouldn't be here now. Good Luck

I just got a summons too for about the same amount $2600. The court processor told me that he would recommend fighting it because since all these companies got bailouts they should have to work something out. To boot it was a charge off or i.e. tax write off so they made there money 2 fold now...so were saying they get to make it back 3 fold.....really? so he suggested that and to look and see if in your state the statute has run out. In many states it's 5 years statute, but they may try to suit anyway...so what you have to do is just point out it's over the statute of limitations. Now I looked up law on debt and according to 1 article if the debtee can prove you had a contract and owed them and are in default you will lose, but if you have a valid legal arguement then you stand a chance of a reduced settlement and or maybe not to pay at all. One coudl always file bankruptcy too and go that route. If you let the courts know you did they cannot collect and they are stuck.
