Before I became disabled in 1999 I always paid my debts.

Now that I am totally disabled I have been contacted that they intend on sueing and placing judgement on me.

I have no money to go bankrupt. I need advise how to handle this. I already spoke to them and told them my situation. It didn't seem to matter.

Any suggestions? Thanks in advance for any help! I'm desperate!

I am on disability and I know for a garnishment to happen to your disability check it has to be for a federal debt that you owe such as back taxes, child support and things of that nature.

Do you own any property that perhaps a lien could be placed on it in order to pay the debt if that property is sold or a retirement fund, which I think that some of that can be attached for a garnishment?

I am not totally sure and someone will be along shortly to advise you.

If I am incorrect please accept my apology. Other's will be responding to your post to advise you further.

They can not garnish your disability check but they can make your life difficult. If you owne property, any assests, 401k plans, stocks bonds.. freeze bank accounts. You aren't the only one they can go after either, if you are married in a community property state and the debt was created durring the marriage your spouce can be liable as well. Now given all of the bad things that can happen lets try and see what can be come up with.

You may want to consider debt counseling- This is a serivce that will negotiate with your creditors/collection agencies for a reduces monthly payment, no late fee's along with little to no interest. MAKE sure you research any company you decide to go with. Something you need to be aware of is that collection agencies and creditors do not have to accept any proposal but most usualy do.

debt settlement. This is a company who can help reduce det by half or more. You will pay money into an account and when enough is avaliable they will negotiate for a settlement. Again research any company you choose.

Bankrupcy- if your debt outweighs more than what you make in a year but you can't afford an attny then you should seek your legal aid office.

Hello DEBORAH,

Welcome to the Forums!

First of all, what kind of debt is that you have, and of what amount?

Second, if you really want to get help, register here. You will fill out a form with your contact information and a counselor will contact you for a free consultation.

Third, summarize your responsibilities. Put everything down in a list - your creditors, what you owe them, what are your monthly payments, fees and aprs. That will show you what you owe and how much it costs per month.

Good luck and keep updating us! :)
