Ok, I called them back. The Kirstin girl I talked to before transferred me to her "boss." I asked for the address. He gave me the run around and didn't want to give it to me. He kept asking me for my attorneys name. Told me NOT to try and control the conversation. I let him know quick that I wasn't controlling anything just simply asking for information. He said my SS# was my account number. How is that so? I don't want to put my SS on the cease and desist letter. Oh well. I guess I'll have to. I don't even know who the orginal creditor is. I am going to have to do some digging. The threatening to take me to court is really getting to me. I mean I know they can't just COME GET ME but good lord.

When I asked them the name of the original creditor they said SSM Company. I'm going to have to look at my records and figure out who that is. I thought it was Global Payday loans, but I took out two, each with different companies. One of them is totally paid off. They debited from my bank account.

Like I said, I took out 2 loans the beginning of this year when times were really rough. One of them is completely paid off. I am pretty sure I still have the money order receipts from where I paid the second one.
The threats yesterday on the phone were horrible. Talking about carrying stolen money across state lines or something like that. Arrest...court and they are located down in St. Mary's, Georgia. It was like squeezing blood from a turnip getting that info from them. They didn't want to give me any of their information. I thought that was a bit shady. I have not been contacted by mail by them either.

The "supervisor" kept telling me NOT to try and control the conversation. I was like excuse me, but if you're going to try and get me to pay something then I need the information to work with. So anyway, I am THINKING this is for Global Payday Loans. That's the company name I remember. I could be wrong. I am sorry I don't really have this information right here with me at the moment. Okay, redneck. SSM is apparently related to SJM Marketing. Which is related to Platinum B Services, Ellis Crosby, and others. Apparently they are notorious for using illegal tactics. You need to dig out your old paperwork and find out who the original loan was through. Here's what I found just by doing a search. But it old information. It may no longer be correct. But it might be a "starting point" until you find your documents.

red, they use these tactics to scare the holy crap out of people so they pay ungodly amounts of money because they're afraid not to. Now, I don't know how accurate that information is, as it's old information I found on a search. But try to find your documents. Whatever you find, see if there's a name/address/something that we can use to do a search on. We can find out more information once you do this! :D

Umm I am making payments on this, and f there was justification for legal action it would have to be done in the state of Arizona. There is no non-intent to pay. Are you sure you are a paralegal cause the Attorney General's office isn't quite sure of that. Who told me if this continues to be harrasment to let their office know. You will continue to get $50 from me on payday, which is the way it is. This is a debt. in no way a "legal matter" I am sure we can do a 3 way call with the AG's office if you like.
Your detailed phone calls which everyone in the home listens to, is also illegal collection activity. Which the AG's office is fully aware of. In addition I have an e-mail dated prior to that letting you know all communication must be done in writing.
Also payments on any bad check in the State of Arizona shows intent to pay, you accepted the $50.00 as a payment, thus you have accepted payments on the debt. Which makes it no longer a bad check case, although in Arizona a Post Dated check for a Pay Day loan is not considered a Bad Check. There was no intent for fraud, nor was there ever at any point that decision.
The state law that allows these companies to operate makes it very clear that the individual who writes the check is "not subject to criminal prosecution." You however have made such a claim to me. This is a payday loan issue not a bad check issue.
The debt I have is an Arizona debt, you want to flaunt Texas still? Texas has the same views:

For example, debt collectors may not:
use threats of violence or harm;
publish a list of consumers who refuse to pay their debts (except to a credit bureau);
use obscene or profane language; or repeatedly use the telephone to annoy someone.
False statements. Debt collectors may not use any false or misleading statements when collecting a debt. For example, debt collectors may not:
falsely imply that they are attorneys or government representatives;
falsely imply that you have committed a crime;
falsely represent that they operate or work for a credit bureau;
misrepresent the amount of your debt;
indicate that papers being sent to you are legal forms when they are not; or
indicate that papers being sent to you are not legal forms when they are.
Debt collectors also may not state that:
you will be arrested if you do not pay your debt;
they will seize, garnish, attach, or sell your property or wages, unless the collection agency or creditor intends to do so, and it is legal to do so; or
actions, such as a lawsuit, will be taken against you, when such action legally may not be taken, or when they do not intend to take such action.
Debt collectors may not:
give false credit information about you to anyone, including a credit bureau;
send you anything that looks like an official document from a court or government agency when it is not; or
use a false name.
Unfair practices. Debt collectors may not engage in unfair practices when they try to collect a debt. For example, collectors may not:
collect any amount greater than your debt, unless your state law permits such
a charge;
deposit a post-dated check prematurely;
use deception to make you accept collect calls or pay for telegrams;
take or threaten to take your property unless this can be done legally; or
contact you by postcard.
Be happy I am sending you payment, and not choosing to continue the process at this point to file
illegal collection activity charges against you and your company. If this continues, I will. You will see another payment on 9/27/07. I will also continue sending you payment. I expect your future e-mails to be nice.

Found 100's of people getting same exact calls...I think these people search out people who have had payday loans and randomly call them threatening that they still owe and if they dont pay they will have these ungodly charges brought against them. They use bully tactics to scare you into paying. I was told by my attorney, if they do not have a signed waiver from the actual company that you did your payday loan through with an actual signed contract by you there is nothing that they can really do to you.
