Do not do business with ICS otherwise known as international cash services. They are a payday loan company and it will not do anything but hurt you. I have defaulted on a loan from them and although they dont call and harass me, i have to pay so much in fees because i defaulted. Chmartinbaby06 do whatever you can to avoid doing business with places like this. I believe they are affiliated with Cash today Limited. I have no address or anything on ICS, they called me twice and I cant seem to get through on the number.

I actually spoke with ICS today about repaying my loan with them. They were very understanding and have agreed to payment arrangements over 6 payperiods and I would not incurr in addtnl fees for this. I was given an address that I could send a money order to, because I told them that I did not feel comfortable giving any account info over the phone.
It feels good when you are able to work with the companies that you are in debt with in a pleasant way. Especially if they are not harassing you. They basically just asked me what I wanted to do. Considering how long I have defaulted on this loan, I only have to pay back 289.00. Just thought I would share this with everyone.

Thanks for sharing this info. It really feels nice when the creditors are willing to work with the consumers. I think many people are still not willing to realize the sense of responsibility of the consumers towards paying of the debt.

I just rec'd a call at work from these foolish people.
Someone called my "employer" and said they were getting ready to garnish my wages. ICS: 1.800.865.3703. International Cash Services. They were calling to verify my employment. They don't know I'm a subcontractor, not a direct employee, so they can't garnish my wages! Their fax number is 1.800.865.3704. We must stop these people from England who fail to abide by American law!

While the law does allow contact from people you have an active business relationship with, I would think since they denied your application, that relationship is effectivly terminated.

I am an employee of Cash Today for the collections department who try and get the money back from defaulting americans who take the money we loan them in good faith and then don't repay.
In the transcript, (that's the phone conversation) it states, and i quote 'do you understand that the loan you are receiving is being made by I.C.S./Cash Today Ltd of London England, that the terms and conditions are subject to the laws of England, and that you submit yourself to the exclusive jurisdiction of the English Courts? If yes, please state your full name and today's date.' When you agree to this, you agree to submit to the laws of England, which includes wage garnishments. We actually don't give out the loan to people who are self employed so by misleading our company into believing you have an employer, you have committed fraud.
as for the person who was not accepted for the loan due to the amount of hours they worked, i have no idea why this was the case. We only refuse loans to people who have worked at their job for less than three months, maybe this was the case and the representative did not explain what they meant properly.
You can lodge your complaint with the FTC and the BBB and anyone else you like, as we are not an american company, we lie outside their jurisdiction.
as long as someone meets our requirements to take out the loan and makes the payments when agreed, you should have no problems with either of the companies you complain about so vociferously.

Regardless if Cash Today is a British company subject to British Law or not, If they are doing business in the US, they are still subject to the laws applicable to their business in the United States. If anything, I would think being subject too two jurisdictions would make it harder for them to engage in in business.
However, it would probably be a a good idea to see if anyone can find out if there are laws similar to the fdcpa and FCRA in England, and what Agency is responsible for thier administration there.

This topic really got me thinking. So I called the FTC consumer help line (877-FTC HELP) and spoke with a lady named Erica, very nice and helpful. I asked her in a case where someone takes a payday loan (say over the internet) from a company based over seas are they still protected by American law? I was surprised in deed when she replied no. She stated financial transactions, loans, etc are subject to the jurisdiction and laws where the transaction took place. So I started surfing payday loan websites and looking at disclosures. Some examples I found:

cash1.........Utah, USA
Obviously am by no means advocating the use of payday loans as a means of balancing your budget. Quite the opposite, run far, far away. However if you are left with no other alternative. PLEASE protect yourself and check the disclosure statements, find out what jurisdiction the transaction will fall under, and protect your self under American law, or even from a store front operation in your state, so you know you are covered under your own states laws. For example in Illinois, you can only have 1 payday loan out at a time (verified through a statewide database) and can only renew 3 times before it must be paid off).
I may suggest for those who have payday or cash advance loans in collections, you may want to look over your disclosure to see what jurisdiction your transaction falls under, and then do some research to find out what right you have under that jurisdiction. That may be how companies like Ellis Crosby are getting away with doing what they do.

If they are doing business without their permission, it is definitely a legal crime. They are required to follow the terms and conditions set by the government here and all the consumers disputes have to be dealt here.
If cash today claims that they do not fall under US jurisdiction, it clearly means that they don't have permission from the Federal government. In that case, they are violating the laws. Do we still need to pay our debt to a company that might be alleged 'illegal?'

In the case of Cash Today, they state they are subject to the laws of the United Kingdom. Becasue the transaction will be deemed to have taken place in England, the consumer is NO LONGER PROTECTED uner US law, but subject to the regulations, provisions, and rights and any protections afforded under British law.
Now if an overseas comapny is doing business in a physical location with in the US (say for example Cash Today has a store front operation in Chicago),And loans are exicuted at that location then they are subject to US (and Illinois) state laws.
I stated in my previous post many of these internet payday loan or cash advance operations have discloseures which state the transactions are deemed to have taken place at their offices in Granda, England, Scotland, Utah(USA) , Delaware(USA), New Mexico (USA) etc. and not in the jurisdiction of the location where the computer which was used to initiate the transaction.

I am really behind on payments too, but luckily they haven't tried to garnish.

No matter what verbal disclaimer they give you when they speak to you, they still must come up to the American standard of doing business when they are dealing with Americans.

Hello, I have recently taken out a loan from ICS and Cash Today Limited. Both were the same, state your name and today's date and both were said to be in England. However, I unfortunately defaulted on both of these loans due to a loss in income when my fiance lost his job. I contacted a lady from ICS 10-11-05 @ 800-865.3703 and she gave me an address to mail a money order to. I don't think these people work out of England because the address I was given to send payments was: ICS, 2207 Concord Pike, Suite 417, Wilmington DE 19803. This is not a England based company that has a Deleware address?!

Keep your payment receipts intact as it is only proof of your payments made to them. You might be required to prove it later, just in case.

The delaware address is a mail drop. What you agree to via the phone is a voluntary wage garnishment. If they try to garnish, I believe they would have to go to US court to force the issue, they may be able to obtain a judgement in an enlgish court and then ask a us court to enforce it, either way it will cost you more than repaying it. I too got myself into trouble and defualted on a loan to them. However, I was able to stretch out paying it off over almost a year. No matter what they say, tell them what you can afford to pay and then follow through. The fact remains that if you accept a loan from them, you have agreeed to their terms. I you cannot accept those or do not understand them do not accept the cash. Having dealt with being almost $3000 in the hole to payday lenders,and having paid them all back.. I say stay away from them, however if you do use them and get into trouble, be honest, be sincere and follow-through on whatever you say.. .you have what they want.. money and they will take the easiest way to get it that they can. Most will threaten, but few will actually take the steps to take legal action because they have to spend money to get yours. If you give them an easy way to repaid without having to spend their $$ they will accept.. they may complain, and threaten, but they will do it.

I had a loan through ICS and they have been one of the better companies to work with as far as harassment goes. They will let you mail a money order for payment to the address posted earlier in Delaware. You do have to fax them a copy of the money order to 1-800-865-3704 on the day you mail it. They are pretty agreeable and let me set up a payment plan.

Harrassing Phone Calls
I have people calling me all hours of the day asking for someone who I dont even know. I have told them repeatedly to stop calling and they have the wrong phone number yet they still continue to call!

I just mailed a money order in for $378.00 to cash today, ltd for payment in full, SIGH!!!!! i spoke to a guy wednesday from their office and told me $400.00 to close account, oh well i am $22.00 short, but when i called monday 10-24-05 at 9:30 am i spoke to a gentlemen named brian, evidentally my account went into investigations, i told him that i mailed a money order to their reno nevada office. i have not received any calls monday or tuesday from them (OMG, a really big SIGH). the way i see it they just made $178.00 off of me for a $200.00 loan and to tell you the truth i really could careless at this time. money is tight but i couldn't deal with the calls any longer. as far as i.c.s, i sent in a $25.00 m.o last week and i am sending another one in this week. i am only going to pay face value of the loan that was given to me. i hope to pay the $150.00 off next week, again SIGH. LOL, how stupid could i have been, i just paid cash net the face value of that loan monday, i w.u $150.00 for a $350.00 loan. for all you guys that have more then 1 loan, please take it from me they are a headache and cause so much heartache. i am also in the process of making partial payments to collection agencies. i am not going to give myself a nervous breakdown, like i have been doing for the last 2 1/2 weeks, i am going to make payments each week and try to pay 1 off each week. these loans will go away soon as long as i pay so much a week. thanks to all the moderators for this group, you guys don't know how much i have learned in the past week since i have been actively reading and responding to the different forums. i can look at collection agencies in a whole new light and know that all the brawling and threating they do each time they are breaking the guidelines under the fdcpa. thanks again guys!!! 2 1/2 down, 6 more to go....lol

Bennett and Deloney has been sued by the attorney general some time back for charging excessive fees to the amount of debt. They sound like a scam and still are doing their business. I head they charged $800 on a $20 debt that was not paid. So, you should be very careful while dealing with them. Get your debt validated before you agree to pay on it.

ICS is a fraudlent company. By giving them any information they want, your account is in jeopardy. They will take money out of your account, unless you block them from doing so. They weren't supposed to do anything until a week after they called me, but did so anyway. PLUS, they know of ways to delete their e-mail messages. Don't get an ICS payday loan. They aren't supposed to be offering their services in the US anyway. It's illegal.

I am just so confused by this whole thing. My girlfriend's loan was for 200 dollars a just 5 month's ago. She has already had over 1000 dollars taken from her account.
ICS says she owes another 379 dollars.
Foreign company or not, 1000 dollars for a 200 dollar loan must constitute payment in full. What kind of interest rate are these people allowed to charge?
I want to close the account they are tapping into, but are they just going to garnish wages.
Can anyone offer a suggestion on how to stop this madness?

You have paid much more than the loan amount. Now, the company has to give you a financial statement of all your payments made. After having the statement, you should claim for a refund also for the excess amount paid.

I feel that ICS is doing illegal business by keeping themselves out of the US laws. Maybe, they want to take out money like this only. I am assuming that even though, this company will try to contact you and force you to pay more but it won't have any leg to file a case against you. They don't have legal reasons to do so.
You will do the right thing by closing the account. Wish if you have done some research earlier, you won't have suffered this much loss even.

Nothing will happen to you. If you keep your account active, you are sure to lose your money. But if you close your account, you will be proactive of saving some.
When you will need to defend yourself if at all required, you have all the necessary proof. Regarding the negative mark appearing in your credit file, I think that you should explain it to the credit bureau. Hopefully, they will suggest you better ways as they are authorized to help the consumers.
