I recieved a **Notice of summons in action for money only** letter from Franklin Co (ohio) Municipal Court, Small Claims. It was filed from Advance Pay of Ohio, a store front lender. My court date is not until 10/02. Im filing for Bankruptcy. I'm paying my retainer on 09/28. And don't know if I still have to go ? I plan on talking to my lawyer about it tomorrow, but I'm going nutts just thinking about it tonight, and I know I'm not going to get a wink of sleep until I find out.

I would definately speak with your attorney about this ASAP and do what he or she advises. One thing I know is that you should never ignore a court summons but possibly, since you are filing bankruptcy, the attorney could help you with this.

Just paying your retainer will not stop the suit from continuing. Only when you pay your filing fee and actually file for bankruptcy will the suit stop.
