How do you find out if a pdl is licensed? Do they have to abide by the state laws where their customers reside or the state laws where the company is based?


No problem! :)

Hopefully someone will come along with more info on your particular PDL companies. I haven't dealt with them personally, but I can make a pretty safe bet that if they are internet lenders, then they aren't licensed/legal. How much have you paid them to date?

Long story short; not too long after the inception of the loans; I received a letter from Certegy Check Services advising that an employee of theirs had sold tons of personal info; checking acct #'s; debit card #'s, date of birth, address. Basically all the info needed to financially ruin me! Someone applied for a mortgage !! Im a single mom living check to check. I was & still am petrified that someone did this! Subsequently I had to close out my checking account. These companies were never able to get any $ from me. Ive been putting off calling them back. I feel more confident now. Loan to PaydayAvenue.com was for $200
and then Impact USA was $ 300. Oh yes! One more Avantis Financial for $ 250.

Jen - per conversation with PaydayAvenue; they state that they have a wage assignment I had electronically signed when I initially took a loan 4/07. I re-loaned in August & signed a new loan agreement, there is nothing in that agreement about a wage assignemnt. It actually reads that security for this agreement is the ACH thru my account. I've asked for a copy of this supposed assignment & their rep is referring me to an office in MALTA !!!!

Hvn, you have to revoke any and all wage assignments ASAP!!! They are completely voluntary!! Don't let these jerks get away with that!

ETA-if they are overseas, then they are totally illegal. I am dealing with one of those myself, Staradvance. Located in Costa Rica. Unreal.

HVn, you need to do as jen says and revoke any and all wage assignments even if you do not think you signed one and take them to your payroll person asap. Do this for all three loans.

Am I understanding this correctly, you have not paid anything as of yet?

I have impact cash, they are a pain, they call and e-mail but nothing too mean or nasty..yet.

hvn, are these the only pdl's that you have? Have you checked to be sure they are not licensed? I'm thinking none are, but I'm coming in on this at the tail end obviously. You haven't paid anything on these loans yet? When are they scheduled to debit your account? If all this has been covered in another thread, someone please tell me because there is missing information here. :shock:

Has anyone had dealings with this company? A rep called me @ work; she wouldnt give me a # to call her bacak (I was in the middle of helping a client - GO FIGURE - IM AT WORK). I hung up on her. I faxed them a letter requesting my balance in writing; revoking a wage assignment and also not to call me anymore. Not 30 minutes letter someone from a different extension at the company calls me and says 'sorry wrong number' and hangs up. Have they ever heard of CALLER ID !!!
I live in Illinois; they are in So Dakota, basic question: which state law(s) applies?

I have traced the companies to their origins. One is in Canada & one in Malta. As neither are located in Illinois - how far can they take the collection process? I have no issue paying back what I borrowed - but their EXTRA fees are I-N-S-A-N-E !!!!!

You are awesome - please bare with me. Im repeating questions & Im frazzled. To weed thru my multiple (sorry) enteries; 1) how far can the overseas companies take collections? Do they have to abide by IL law? 2) The companies in So Dakota & Utah - do they abide by their own laws or IL ?
Thanks for arming me with this info - If and when I interact with them; with your responses & knowledge; they are not as rude. Mind you rude & pushing; but not as much. Being a single mom is the hardest job Ive ever had !!!! Where's the winning lottery ticket when you need it ?!!!!

Hvn, I have tried to answer you several times but am having trouble. Hopefully it will work this time. I am thinking becuase Cannr stated that the companies were not licensed in IL, they have to follow IL laws. I f I am wrong someone will correct me. As for the overseas companies..They will do everything they can to scare you into paying. They will harrass you until you are insane. Do not believe a thing they say. In fact, if you can avoid talking to them altogether, do so. Try to do as much as you can in writing.

PaydayAve is connected to Northway which is connected to: SONIC!!!!!! Can we say SATAN??????? Sonic, which is the parent of the Voluntary Wage Assignment, imho...
Revoke, revoke, REVOKE this bogus document IMMEDIATELY!!!! Write a letter to Payroll now, walk it down to their office or fax it, because trust me, they're going to try and use it.
Voluntary wage assignments have to be signed in person and I know you didn't fly to Malta to do it, right? Also, are you in California? If you are, the Sonic companies have been banned from doing business in this state.

ks, heaven is in Illinois. heaven, the people that are giving you the hardest time are the people that are overseas. Be very cautious. Revoke everything in writing to them. They are so illegal, it's disgusting. You need to only pay the principle amount of the loan only. None of their fees. They can kiss off when they tell you otherwise. As far as them collecting? Well, they will certainly try. But most likely will use an illegal collection agency. Even if not, they're still trying to collect on an illegal debt. So, I hope that makes you feel a little better anyway. The only way to get these people to stop harrassing you via telephone is to stop taking their calls. They are soooo horrible. They will call 20 times a day and argue your head off.

Again, thanks for the info. Im a very laid back person; raising a 5 yr old solo I have learned a great deal of patience. However, these reps can send me orbital in a nano second !!! I have every intention of paying back the principal. Granted not all at once. Please correct me - I am going a limb here and thinking that I can make payments to them or does it have to be one lump sum. Also, there's no way in HECK that they're getting my new acct info. Would you suggest money orders? In their conversations they want Moneygram - @ $ 9.95 a pop. The answer is NO on that. Any advice?

heaven, good job! As ks stated, they have addresses. I refused to send moneygram. Flat out no. And I've told them if that's the only form of payment they will accept, then they are not going to get any payment. You would not believe how quickly some of them coughed up a physical address for me.

There were those brief moments when the collector would announce some off the wall action to be taken; or that they'd contact my employer; that you'd almost believe them because they say things with such conviction! It is amazing how they are speechless when you respond and speak of the legality (did I just make up a word?!) at hand. I wish any and every one who has dealt with PDL's knew of this site. They do prey on needy; broke people. Any word on regulating this overseas companies that hide behind company names here in the states? The gov't should regulate the state side ones, too. Some people do everything, but stop at filing the complaints. FILE THE COMPLAINTS. These government agencies need to know this information. File, file, file! Okay. Done now. :wink:

I feel like a moron. Here you go friends; around Cmas I entered (of my own free will) internet PDL hell. About the same time, my employer had a laptop stolen; I closed my checking acct & reopened another. Initial PDL loans and what I have discovered to be; subsequent ACH payments were taken. I honestly missed this. With the information on this forum - I've overpaid !! At one point I did receive 'collection' emails & calls from the PDL's. To date nothing! I panicked & contracted with a debt company/attry. I paid them too (idiot!) and they are supposed to be trying to negotiate settlements for me!! Friends, I wonder why the debt company would not pursue the illegal avenue; or violations of my state laws with the PDL's. Now (with info from this forum) I dont want them to pursue any 'settlements'. Here's my game plan; Im thinking of calling the debt company & saying thanks but no thanks; cancel my contract (Ive paid them in full) and pursue the overpayment avenue on my own. Imput ???????

Hvn - I just posted info for SD in the "payday loan laws made simple" sticky for you . . ..

It's really up to you - Refunds can be VERY difficult to get. But it can be worth the effort.

Has the debt company already paid the pdl's? If they have, I'd say let it be. If they haven't, then it's well worth the effort to fight them yourself.
