I have been sued for a credit card debt, but they can't produce a promissory note. Can they still win?


Hummm now that is an interesting question! My personal opinion, which is only that, my opinion, is NO. How can they win a suit when they can't even prove u agreed to pay it back??? I'm sure someone who has more knowledge will be around shortly and have more definate answers for u so stick around! I'm very interested to hear these answers!

Welcome to the Community :D HAve you validated this debt with them, and are you sure this agency has your debt?

If it is the original creditor, you don't need to answer-it doesn't matter. But if it is a collection agency, you want to make sure they legally have the debt.

Also, did you respond to the summons yet? Be sure and respond, and to show up on your court date, or they will get a default judgement.

One last thing- are you sure this is a real suit, and not just a paper generated to look like one? You can call your court housr to verify this.

It is a requirement that they produce the original note.

Strange though that they sued you for a credit card and alleged a note. Looks like a mistake. Make sure you do not miss your court date.
