I think that it applies to third party collectors under the fdcpa. Are the calls coming from an original creditor or from a collection agency?
I told the pdl's in writing not to call and MOST of them stopped

You can verbally tell them and I think its temporary but the will need something in writing.
In terms of 1st party vs 3rd party, I know the fdcpa goes govern 3rd party and if you tell them no calls, they cant call but I would follow up with a cease and desist.
Original creditor (1st party) I dont know...for a work #, I think they have to stop calling.

I think it depends on the company. I did send cease and desist letters, and for the most part they abide by them. If you think about it, if these companies have already gone against what is legal, by lending the money, why should the abise by anything that the fdcpa mandates? They may stop calling for a while, but chances are it wont last.

Well i sent CACH a dv letter along with cease letter and a couple of weeks ago i called them to settle this judgement and was told i'd have to fax something over to them saying they could call me back with my name address and ss# on it. I was a bit shocked that they actually may follow the law, ok sometimes! ;)

That's cool Ang. At least they paid attention to you and at least they were willing to comply with your request to not call. Maybe the heat is coming down on some of these companies, or at least it's getting enough attention that they figure they better start obeying the law or get shut down....(If only dreams came true) :-)
