I have read other peoples stories on this site and I am there too. I am having to move, I am loosing my house...I can't pay rent and I will be homeless. The fees alone exceed my paycheck...I don't know what to do. I looked into consolidation, however it doesn't seem possible... if I could qualify for a loan I would have never gotten in this mess. Maybe you can help somehow? The homeless part doesn't bother me as much as my two black labs which I love more than anything. I don't know what to do. I feel so stupid for doing this...it was so easy...I don't know what I was thinking, I was just so desperate. Is there anything that will make this manageable? An attainable consolidation loan? Anything?

Okay...couple of things to get you started-

1-Register on our site here...this way we can send you messages and send you copies of letters to use.

2- Can you close your checking account? This is the only way to stop them from debiting for sure. Attached is a thread that gives you good info about that.

Did you sign a lease/rental agreement with the property owner? If so, he has to go through the proper channels to have you evicted. Have you been given a 3-day pay or quit notice as required by CA law?

Please, volley. Is there something we can do so that this guest and her dogs are not out on the street? Anything? We've got to be able to keep her and her dogs from being out on the street. If there is anything I can do, make phone calls, do research, whatever, please just tell me. We can't let this happen.

There are definitely 2 issues here-the pdls and her rent.

I need to know what the arrangements are she has with her landlord and if he had her sign a lease/rental agreement, whatever. There are strict tenant laws in CA. This will help gauge how long she really has in her place.

The pdl's....need to get that account closed first.

I hope she comes back....

Kim...that is awesome! My eyes are welling up a bit :oops:

I hate to bombard you with questions, but lets get those PDL straightened out and have them stop taking your $$ that belongs to YOU!

When are the next scheduled debits? Can you close the account right away?

I need to send you a letter that you can send to the PDL's...if you can, please register with this site so I can PM it to you.

I thought I did register?? I will try again. My next scheduled debits are Friday, my bank said they could close it right away and not let anything thru, I will go do that once I leave work. Then get those letters out as you suggest. Thank you so much! You all have restored my faith in people, you are truly wonderful! I am scared of what happens next, but I was more scared to be out of a home for my dogs...and I no longer feel so alone.

I just went to my bank and they said that they still may go thru....they legally have to pay them. It would re-open the account. I did not close it yet...I guess I have to loose my whole paycheck again? and there goes the house. So with this letter, I can stop the next round from happening? What a nightmare!!!

Kim, please hang in there we will do everyting we can to help you. Did you explain that these debits are fraudualnt and the companies are illgeal? Volley knows more about how the banking works. Hang in there she is usually on later. Just know that you and you doggies were on my mind all day and we eill be here for you.

Why wont they close the account? Unless the debits are pending, which I doubt they are at this point, and you close the account, thats it!!

Please go in and talk to the branch manager....please.

At worst case, and this is what I had to do because I couldnt redirect my direct deposit in time to close my account, I went early in the morning and took out all of my $$ on payday because the PDL's had not yet submitted thier debits.

kim, please post as to what's going on. Can your bank put a hard debit block on it rather than close it? This way nothing will go through instead of them closing it to be "forced" back open again. kim, please stress to them the importance of this! I don't care if you have to break down on your knees and cry in front of them! You need your money. You need to prevent these pdl's from taking any more of it. You have direct deposit? If you can not do ANYTHING regarding this by tomorrow and it looks as though your account will still be open and looks as though the pdl's might be able to go through, try to see as soon as you get your deposit if you can go to the ATM machine and suck out every last dollar it will let you. This is a drastic, last minute move, but if that's what it comes down to, do it.

Welcome to the forums! We are glad to have you here and you have already been given great advice. A few things: I am also in CA and know of several programs that can help with back rent and getting you on track. Have you looked into programs like the Salvation Army and Shelter, Inc? They might be able to help you.
I think it will also depend on how far behind you are and whether you are on a lease or month-to-month. Even though your landlord will work with you, which is great, I would still research tenant rights so you know where you stand with this.
Now are these PDL's you have storefront or internet? If they are IPDL's, California has been very tough on them. You also want to go to the California.gov website, click on Dept of Corporations, and go to their database to see if these PDL's are licensed in CA. If they are not, they are operating illegally. Although you still morally have to pay back the principal, what you actually borrowed, you are not, by any stretch of the imagination, required to payback at outrageous interest rates. And by looking at your list, it looks like you have almost paid back several of them. So things are already looking up for you.
If these companies continue to harass you, file a complaint with the California Dept of Corporations. We can help with that. Good luck and keep us posted, OK?

Good morning. My bank will not do a hard debit block I told them that someone got my information and there is fraudulent activity. They will do nothing but pay them even if there is no money in the account or if it is closed. Why do they have to pay it even if I don't have money in there? Guarenteed if it were something that I would want them to cover for me they would not....they returned my electricity payment two times and it was an over the phone automatic debit..so why are these PDLs so powerful???

If I had the answer to that question, I would be debt-free. :( I think it's because the PDL's are shady and know how to get around the system.
Since your bank's not going to work with you, what you need to do is find another bank. And the challenge here is that if your current bank closes the account due to overdrafts, you might be reported to Chexsystems, which is kind of a like a blacklist for banks. It reports everyone who has had accounts closed due to overdrafts.
There are some banks in California who do not report to CS. PM Goudah who has a list sorted by state and she can help you with that.
The other thing you can do for the time being is open a savings account at another bank and pay bills out of that. You might have to deal with money orders, but at least you would have your paycheck back.

It will be overdrawn like $2000 with all the pmts plus $30 each for NSF fees???? I need to get those letters out to stop it for the next one. Will the letters stop them or will it just be the same situation next payday...that my bank will just keep paying them???

If your bank is forcing the account open everytime a PDL hits it, even though you're in the hole, then I don't think it would stop it. But still, get those letters out. You need to start a papertrail here. And if there's anyway you can pay a visit to the branch manager of your bank, I would do it. After telling him or her what's going on, I think they would want to help you, because I know they hate the PDL places as much as we do.

I do not understand why your bank is doing this. I can not, for the life of me, figure out why they refuse to put a block on the account. You need to get in there, in person, and speak with that branch manager. If you have to, ask them to call the corporate office while you are sitting there. You need someone who is going to help you out of this. There is no reason on this earth they can not put a block on the account. No reason. kim, if your check is going to be put in direct deposit still (or did you stop it?), you need to act quickly and see if you can get that money out before the pdl debits post. I know it sounds awful and it sounds sneaky, but I do believe you need your paycheck. You need to have a home. I can not stand the thought of you and your dogs in your car. Please, go to the bank and talk to the branch manager in person. Call the corporate office, if need be. However, try to get every last dollar out of there so you will not be left out on the curb with your dogs. Please. We will try to do whatever we can to help you.

Hi Kim!

Just to agree with what else has been posted here, the letters will not neccsarily make them stop.

I wish you were registrered so you could PM me the name of your bank.

The bank needs to SHOW you their POLICY around account closure...not just what some teller or customer service rep thinks it is. Do they endlessly continue to allow the account to be forced open forever? There are guidelines and you need to demand to see them and have them explained.

Hello there Kim! Keep your head up! Everyone here will help you figure it all out...they helped me! I'm with Cannr....go in there, and keep asking for different people to talk to. There has to be someone who will really listen, and help you out. Make sure you really disclose what is going on. Again, if nothing else, cancel your direct deposit, and resort to cashing your payroll check if you have to. Of all the things I have learned from people here, is to take care of yourself first! Those PDL's can all wait! Good luck, and keep the questions coming. It'll get fixed!

Kim-Got your message....like I posted, you need to be shown the policy....when you opened the account, there are rules of engagement between you and the bank.

What they are telling you is not clear and subjective.

At this point, so you can have some $$ in your pocket, go withdraw all you can early tomorrow AM. Heck if its going to be overdrawn anyhow, at least you have $$.

Great! Take it to a check cashing place if you have to to cash it. Better yet, if it's drawn on a local bank, take it there and they will cash it for free. It's a pain, but it's worth it if you are finally getting control back.
Until you get another bank account, it sounds like you are going to have to go the money order route, but that's OK. You can also go to Accountnow.com, which I have done and get your check direct deposited and get billpays, up to 7 a month before you're charged.
