I received a settlement agreement from their lawyer and a refund but two months later they are still trying to collect. I even signed a confidentiality aggreement. They sent one of those Shawn Wiggins / Michael DePriece form emails about an "important decision" that will effect me. I called Michael and explained how his info was in error and to call their lawyer to verify. He said, "Are you sure you called the right company? This is Geneva Roth or Loan Point.
Yes I am sure! I emailed their attorney as a reply to the agreement sent to me two months ago and politely asked him to have them cease collection. The next time will not be as polite. Talk about the tail does not know what the head is doing!

There nothing to get.I have a PIF and got a refund. If they pursue however I will reopen the case against them with the AG in Kansas and possibly sue if I can find a lawyer that will act on a contingincy basis. Their lawyer was a really nice guy from a huge law firm of Bryan Cave! I am sure he will take care of it.

Frogpatch:
I am just beginning my fight with Geneva Roth/Loan Point USA. I just got the Michael DePriest email about a decision today! May I ask just what exactly did you do to get your PIF? I just filed complaints yesterday with the Kansas BBB and with Oklahoma (my state) Consumer Credit, which is where they refer all the AG complaints. I also sent an email to Geneva Roth/Loan Point USA today in response to the Michael Depriest letter where I revoked my ACH, (I had already sent this by reg. US mail) and quoted my state law on the interest rates and all, and informed them about the complaints I had filed.

File a complaint with the Kansas AG stating that you have over paid and that they refuse to stop the ACH withdrawals. The Kansas AGs office is very aggressive and will subpoena them if they do not respond. Also you will probably get an email from a Reese Price saying that they will not stop the ACH withdrawals. Save that and send it to the agencies that you filed a complaint with as an addendum. Have you overpaid them. If so demand that money back. I will PM you a copy of the laws that make cumpulsory ACH withdrawals illegal that you can refer them to also. Just keep hitting them harder than they hit you and you will beat them.

Oh frog, thank you so much! I know I have overpaid them, but I will have to drag out my bank statements and get the exact amount.
