What happens if you get a court summon? Can you still go the the creditor to work out a payment plan? Thus avoiding court and a judgment?

Yes u can still settle with the CA beforehand but they will add additional fees and such. But if u did get a summons make SURE to answer it before the time is up! If u need help doing this let us know and i can post a sample of how to answer a summons for u.

i have a question regarding settlement with a collection agency. i just recently did an out of court settlement but when they send me bills inthe mail it does not reflect the amount i was told. i failed to write down the name of the person who told me that so i have the feeling i got screwed on that. ive asked them once to send me something showing the agreed amount, shouldnt they have a record of that? i havent received anything. also, i am not able to pay ontheir terms, but i am sending in payments. i just paid $300 2 weeks ago and i just mailed $400 today, but today a guy called saying he needed to hear my side of the story for the case, he was implying he was a lawyer or something. but it is from the same phone number so i think the guy really isnt a lawyer or something. so now my question is can they really take action on me since i am cooperating and sending them payments. this is also the 2nd collection agency trying to collect this account- i think i read somewhere they really can sue me? but i am paying them. any help?

Well i guess yea they could sue u if they chose to do so but since ur paying them and a nice amt the way i see it, if u keep this up i don't see why they would sue u.... they ARE getting money from u! also, if they did choose to sue u can always bring in ur payments and prove to the judge that indeed u HAVE been paying them!!
I'm not sure ur bill would reflect a settlement amount. DO u remember the amt u settled on? Maybe send them something in writing stating that u and the CA agreed to $xx. amount that way u have it in writing. Maybe put a place on there they need to sign and send back to u. They may not send it back but even so u would have ur letter to them.
Also, maybe on ur payments put in the memo section payment x of xx.
