Good morning about two weeks ago I got a call from an Alex Divine saying he was from US National Bank Crime Divison and they were going to download charges on me if I couldn't pay $2000 now these loans were over 2 years ago I honestly don't remember if there is anything left owed on them and I know I paid something on them, but that particular bank account was closed over 1 and 1/2 half ago due to NSF fees, The only thing I heard was about a year ago from Ellis Crosby and I sent them a request for debt validation and never got one and the never called back ... Well then this guy calls my cell phone and now his name is Harry Johnson ... I have ask for debt validation and he said I was questioning his autority so far I have been able to avoid the calls, I have a call in to my AG, and trying to contact a lawyer to find out what I should say to these people.. I also got an e-mail yesterday from Geneva Roth saying they had been trying to reach me by phone with no success and they needed me to call about a deceision that renders my future could this be the same people as US National Bank sorry to ramble just trying to figure out waht to say to them when he calls.. If I owe I will pay but I need a debt validation and this was in 2005 and I am also in NC what are the laws on that, can they take me to jail ??


asr, there are several posts on here where the member has experienced exactly what you have described. No they can no take you to jail. Here is the NC state law for your reference (just select your state),

You are on the right track with them by asking for the debt validation and contacting the AG. Just know that legal companies do not act this way. And they can not take you to jail.

thank you for the info however they just called me at work again and I got stuck on the phone with them they are $150 a week starting today and I told him that would not be possible and he said what about tomorrow and I said no and then I ask for the debt valadation again and I told him I had a call in to the AG office didn't seem to phase him I said if I owe I will pay but I am not sending over $2000 unless I know what its for ... by the way these were for internet payday loans, So he said at 5:00 pm they will be here to get me can they do that or is it a scare tatic ??

ARS, scare tactic. They want to scare you into paying. To come get you and have you arrested they would have to have a warrant for your arrest. A legal collection agency would have no problem with telling you what the money is for and would have no problem with the debt validation request and would have no problem givng you information about their company. If you wan to see other stories, you can use the search box in the top right corner of the page . Just type in US National Bank. You will see some good ones. Next time, tell them you will be waiting for them at 5:00 with a police officer becuase you have filed a complaint against them for harrassing, threatening and stalking you. And to come get you.

Well, there is that too. If you knew you were going to be arrested would you not go somewhere and hide. They only want you to get so scared you will pay them just to get them to go away. And besides, have you ever, ever heard on any crime drama show on tv or known anyone in your life the term being "downloaded"? Last time I checked, and I know people in law enforcement, they do not "download" charges on people.

True LOL!!!!! It is just very scary even when you are armed with the information when someone says they will be there at 5:00pm.. I want to file a complaint but I have having a really hard time finding contact information on the so called US National Bank I am waiting on my states AG to call back but the last traceable number he left on my cell phone was 484-220-1053 and that was in PA when I did a reverse number search it came up as nothing avaible but did list it as a resident, then today he told me they didn't have incoming calls

I Checked the OCC (Office of the Comptroller of Currency) records...nothing on file for a US National Bank...

Dont get me started on the downloading issue....and "were going to process you at 5pm today", had someone post that one too.

I dont know what either of those processing entail but I can tell you that its a bunch of BS! Big words for people trying to sound smart.

Just wanted to let you know I spoke with the AG and the gentle there that actaully handles payday lenders in NC so this may be helpful if you are in NC, he said that we are covered under chapter 24 of the law regarding payday loans and he said that because of that all contracts with them are NULL AND VOID and in the state of NC they do not allow wage garnishment unless it is for IRS for state of NC.. He said that if I wanted to try in get in touch with the orginal lenders I could and pay back only what I borrowed but I am not legally obligated to do that and he said if they call back be strong and stand my ground and let them know they are illegal and he say no you can not be arressted HOPE that helps anyone it helped me :)

asr-That is great news! Please note this....its not a wage garnishment, but a wage ASSIGNMENT rather that the pdl's will try to execute. Sure in most states they are illegal or there is a special process the pdl must go through, but that will not stop them from sending a letter to your HR dept for a wage assignment.

I am getting so sick of these lenders pulling the "You're going to be downloaded" crap repeatedly!! Call their bluff and actually call the local PD to see if there are any warrants for your arrest and when they say no, hit them with that one the next time they call.
Also, why isn't US Bank, which is a legit bank, getting upset over these lenders using a DBA which is very close to theirs? Just wondering.....

Calls telling you that you must call 484-220-1053 are a scam. You likely don't owe these people a debt. If you call the number, a big charge will show up on your phone bill. If it was a real debt, the would send you a letter. So tell them to send you a letter. If they ask your address, they obviously don't know you. Tell them to use the address in their file (which they don't have).

It's a scam!

asr03782004-ahhhhhhhhhhhhhhh the infamous "alex devine" I've dealt with him as well....He called my place of employment several months ago telling me the same thing. The kicker was after he told me the same thing he told you-that US National DID NOT WANT MY MONEY! Then I'm like then why did you call me? I asked for validation from him as well and got no where. I too filed complaints and they ignored them.

They told me this evenign that the phone conversation was beingrecorded directly to the courts and do I want to be seen in court. I was so surprise taht they had my SS3, bank accout (old one) and my phone number. I am glad that I did not give up this evening and keep searching and stumbled upon this site. Can someoen let me know if my cashnow is legal 866 645 1661

Special K, My Cah Now (MCN) is not legal and there is no such thing as your phone call being recorded directly to the cour. They do this to try to scare you into paying them. There are many people on this site that have used MCN and they have not been taken to jail or been downloaded or arrested. They have been scared, aggrevated and harrassed, but no jail time.
