Do you remember when it went deliquent?
I would send them a debt validation letter asap.
They need to prove this is your debt and that they are legally able to collect on it.
Can you tell us what company this is, and what state you are in?

i followed your suggestion and sent a dv letter to midland credit in September 2007 but no response however it still shows on my credit report what is my next step?

when you sent that letter, did you send it certified mail? I hope you did because you will then have proof that they received it. Otherwise its just your word against theirs.
If you did, and you still have the receipt signature card, then you have them in a corner. By law they cannot continue to report on your credit files, or continue any collection activity once they get your DV request, until they satisfy that request. Then they can start up the phone calls again. Now, this doesnt mean that they have to remove the entry from your reports--it means they cannot update it with the same delinquent status, and if you dispute it with the credit reporting agency, then they cannot verify it as a legitimate debt. That is against federal law if they do.
My best suggestion is this--if you cannot prove that you sent them DV before, send one now, ASAP, by certified mail, return receipt requested. Cost is less than $6 last I knew and it will save you a ton of headache later, possibly even put money in your pocket if they screw up again.
