HELP! Payday loan trouble-Westbury Ventures

I have an old payday loan from 2002 that I forgot about and now I am getting numberous calls from Danny George at Westbury Ventures saying I need to call him or his attorneys will be serving me a subpeona in 7 days for a civil trial. He said the payday loan was for $200 back in 12/02 and I need to send $500 by moneygram immediately to avoid further action. Well after me demanding proof multiple times he finally faxing me paperwork where I had a $100 payday loan in 2002. Not $200, not sure where that came from. What should I do? What further action can he take? I am in Northwest, FL. Should I send money by moneygram? Please help me!!!!

Do NOT send them any money via moneygram. They are insane. Demand debt validation. VALIDATION not VERIFICATION. They will have quite the time trying to validate the debt.

Hey cannr remember we couldn't figure out who or what VC Funding was....they dba as Westbury Ventures. I actually have an email address for a live person at VC Funding. I didn't think I had saved it, but I found it in my sent items on my yahoo account today. Just a heads up in case anyone ever needs the info.

So I do not need to send any money by moneygram? How do I get them to quit calling my work? Plus they say that the only way I can pay is moneygram and they will not give me a physical address, I asked multiple times. They also told me they didn't have to go by the Fair Debt Collection Practices Act because they aren't a third party. Is that true? Is there an agency I can contact for help? I am sorry I am asking so many questions but he is very rude and pushy and has me scard I am going to jail. Thank you for any help!

This is the letter I got from them.

You received a $200 cash advance on 12/16/2002, but the account is now severely delinquent. To avoid any further action against you, please call Danny George at 1-800-859-6439 ext. 3360 to make arrangements to clear you balance.

You have 15 days to pay $500. If this total is not received in 15 days, you will be reported to the CL Verify Database. This database is an online credit bureau that contains information about transactions with lending institutions that specialize in cash advances. Negative transction history could preclude you from ever receiving another cash advance.

You obtained a loan with our company and have neglected to pay it back. You signed a written aggreemant: you are now in breach of that agreement.

Make an immediate payment at the nearest MoneyGram outlet!

Honey, you are not going to jail. I promise you that. Do not let this man and his email scare you. I can't promise that he won't continue to call. Once they have your phone number, they will try to hound you to death. And try to scare you to death, which is what he is doing. No. Do not moneygram him any money. Obviously their records are all screwed up. He doesn't even know the amount of the loan you borrowed. There's clue number one that "something is up." The second clue is their refusal to give you a physical address. Now, I'm not telling you what to do, but my personal experience (and this is just me) is that if they would not give me a physical address, they did not get any payment. Sorry about their luck. These guys are hiding for a reason, okay? Now, we can send them a letter demanding that you be left alone. Can't promise it'll work, but you'll have something in writing. And, try to get everything in writing from these people. No telephone calls. You need documentation of EVERYTHING. You can file complaints (and do this) with the BBB, the FTC, and your state AG. Remember, try desperately not to take the phone calls. Let them leave messages. Email them and tell them you will only communicate via email. The more documentation you have, the better off you will be. Please post with any questions. :D

1-SO they will report you to CL which will prevent you from getting another cash advance..whooppee!

2-They CANNOT force a method of payment...Was a specific method of payment indicated in the contract you e-signed....NO.

3-SO you know you took out at least a $100 loan...where the heck is the $500 amount coming from?????

DO not send these people a dime until the VALIDATE the debt..not just tell you that you owe it. Please do not be scared and you are not going to jail. SO NOW its seriously delinquent after 5 years??

Do you have a letter you can send them to stop calling you??

Here is some food for thought. The SOL on this "so called debt" has also expired (or is close to expiring) according to this:

Florida Statutes of Limitation

Contract or written instrument and for mortgage foreclosure: 5 years. F.S. 95.11.

Libel, slander, or unpaid wages: 2 years.

Judgments: 20 years total and to be a lien on any real property, it has to be re-recorded for a second time at 10 years.

The limitations period begins from the date the last element of the cause of action occurred, (95.051). NOTE: The limitation period is tolled (stopped) for any period during which the debtor is absent from the state and each time a voluntary payment is made on a debt arising from a written instrument.

Almost all other actions fall under the 4-year catch-all limitations period, (F.S. 95

Does this sound correct?

Well I faxed them a letter because they wouldn't give me a mailing address and asked them to please quit contacting me at work. They have already called 4 times today and sent a fax also. They just called back and told me the letter went in the shredder because he said they are 1st party lenders not 3rd party lenders and that the fdcpa doesn't apply to them. He said that he could call me as many times as he wanted and at midnight if he wanted too. He now says he will settle for $350 but I only have 14 days to moneygram or he will pursue further actions.

Okay, this guy is an a$$hole. Now I'm starting to get mad. Here's the deal. He didn't give you an address? Tough crap. I posted the address on this thread for you. You have an address. Do not communicate with him any further. Mail him a letter demanding debt validation. Period. If you can AT ALL, do not take his calls any longer. Put your phone on silent. Turn it off. Whatever. If you're at work, let all calls go to voice mail. Do not let him continue speaking to you in this manner and threatening you. Do not. And file complaints on this a$$hole to every friggin agency there is for harrassment. File them with the BBB, the FTC, and your state AG. They need to know about these "collection practices" of this company. And do NOT talk to them on the phone again if you can avoid it at all. Don't take the calls. Mail them a letter demanding debt validation.

I have a letter from them also, stating they purchased my debt from Crown Lending, which is located in the Bahama's. They want $480 on a $300 PDL, which I already paid $90 on. I just sent them a debt validation letter, I'll let you know what the response is...in the mean time they can kiss my butt! Cannr is soooo right, don't take the phone calls, if I don't know the number I don't answer, and I don't call them back.

I never recieve a loan. but they tried to take out $260 out of my checking account on October 9, 2007. I probably applied with them, but they turned me down cold. So what is the email address? Anybody know?

mary j, did it say "westbury" next to the debit? Or did it have another name? Or a telephone number? Did you have any pdls out that were not paid that may have been turned over to these people? If you never received a deposit (or did you), how and why would they debit your bank account? As volley asked above, with a little more information, we can help you figure this out. :D

This is very disturbing, this "company" is emailing me and threating me and telling me that I have two days to pay a certain amount, for a loan that I took in 2003 and paid off already.
I am so scared because I have no job and the little money that I get from unemployment could be taken away by them

These people are hounding me also. I had taken out a loan just back in May. In July I was injured in an auto accident. I am disabled cannot work and I have applied for all sorts of assistance. This Westbury Ventures, (I had to listen to the message 3 times just to get the name) calls and leaves a message that me or my representing attorney need to contact him, that they are investigating a fraud case with the social security number ending in ****. The last time I talked with him, I said I am not working I was in an accident, he said can you at least send $200.00 by Friday? His name is Michael James

I have had the same problem with Danny George. He has threatened me as well and stated that fdcpa doesn't apply because they are 1st party. He had me in tears today because he said that I was going to go to court for check fraud which is a felony. I don't even know what the heck to do. I tried to be cooperative because I owe the debt, but he's being an a$$hole. I said I could make a payment on 11/9 and he said I had to make one by this friday.

After I posted this I emailed the supervisor who's name I got off of the forum. It was forwarded on to Danny George's supervisor who has now subsiquently been fired after making the threats. The supervisor I spoke with today (Angie, the floor supervisor) was great. She apologized for everything and stated that what he did was incredibly inappropriate. She helped me set up a payment arrangement and waived the loan fees. I feel sooo much better. Don't put up with the abuse!

Be very careful, NY seems to be the haven for payday loan scammers, which is the new big internet scam. Look up news articles on google about payday loan scams! Some people that work or used to work for payday loan companies and/or information breaches from payday loan companies is the large cause of all this. They will have old application information and try to collect on a loan that is years old that was paid off in almost all cases, they use scare tactics to try to get you to wire money by the next day. Check your bank records and fax or mail them a copy (with other info redacted!) that the loan was paid and any further calls will constitute harrassment and legal action will be taken by you. Do not agree to ANYTHING over the phone, just tell them your concerned this may be a scam and that you will have to check your banking records because you do not recollect this debt. Many times they will say the loan is from 2 or 3 or 4 years ago and that you have been contacted by the loan co many times when in fact you have never been cause the loan was paid off. BEWARE THE SCAMMERS! This is identity theft, please report it to your state atty general, the ftc, the state atty general of the state that the co is calling from, the fbi, and if they use insinuate threats of physical harm call your local police to file a report!
