Date: Wed, 10/03/2007 - 19:20
I used the debt verification letter as suggested by Cajun with the CA whn I goit the initial Letter. The CA had already sent info to CA before I sent out Debt Verification request SO I did not have the 30 days???
The CA (arrow) ahas sent back al etter saying they wil cease and desist any collection effort until such time as the comply with legal requiremnt for debt verification to me in writing as I requested. I have this letter, MY cert letter copy and the receipt from the cert letter ( signed) Is thsi enough to get the collection removed by the bureaus.. BY the way the dat has now been exceeded by 90 days on the verification request.

They have to the end of the world to validate this debt. You will want to do a dispute with the credit bureau now. If they verify their trade line without providing validation, they have violated law.You can use these violations to force them off your report.Send everything written certified return receipt mail. You will want a good paper trail.
Cajun...Advice?
CAjun,
They have yet to validate but are updating trade line. Any suggestions on letting them feel the pressure of failure to handle this properly?

They do not have to remove the TL but the must notate that it is in dispute. Since they have not added the notation and your DV was timely, I would try that approach and maybe you can score a delete.

the thing is this--they cannot update the report to still show as a valid collection account on your credit report with that DV still hanging over them. So, if they dont validate, but three months from now they update your report to show the updated delinquency, thats both an FCRA and an fdcpa violation at that point. Also, with the current dispute with the CRA, if they verify it as your debt, that is the same violation. The only thing you can do right now is sit back and wait for the results by the CRA. When that happens, let us know what they say and we will go from there.
Also, I could be wrong, but it seems to me that this is an incomplete report to begin with. There is nothing entered in for a lot of the information. In particular, though, I do recall that there MUST be a date reported as to when the account went delinquent, according to the FCRA. Since they didnt report one, that is another violation of that law.
